s1 5 s3 Local Government (Areas) Regulation 2005 Local Government (Areas) Regulation 2005 [as amended by all amendments that commenced on or before 1 January 2006] Part 1 Preliminary 1 Short title This regulation may be cited as the Local Government (Areas) Regulation 2005 . 2 Commencement This regulation commences on 1 September 2005. Part 2 Local government areas 3 Declaration of local government areas etc. (1) This section and schedule 1 declare the following information about each local government mentioned in schedule 1— (a) its class; (b) its area and any divisions of the area; (c) the assignment of councillors to each division; (d) its composition. (2) A local government’s area, and any divisions of the area, are shown on its area map under schedule 1. (3) Each area map is identified by a map number marked on the map.

s4 6 s5 Local Government (Areas) Regulation 2005 4 City of Brisbane (1) The electoral wards of the City of Brisbane are named in schedule 2. (2) The external boundaries of the local government area of the City of Brisbane are shown on map LGB1 edition 6, sheets 1 to 4. (3) The electoral ward boundaries are shown on map LGB1 edition 6, sheets 5 to 30. (4) For each ward, the boundaries are shown on the sheet number of map LGB1 edition 6 stated in schedule 2 opposite the ward’s name. 5 Area maps must be available for inspection (1) The chief executive must— (a) keep a copy of the area maps open to inspection; and (b) ensure the following have a copy of its area map— (i) City of Brisbane; (ii) each local government mentioned in schedule 1. (2) The City of Brisbane and each local government must keep a copy of its area map open to inspection. (3) In this section— area map means— (a) for City of Brisbane—the map mentioned in section 4; or (b) for a local government—its area map under schedule 1.

s6 7 s8 Local Government (Areas) Regulation 2005 Part 3 Joint local governments 6 Declaration of joint local government area—Act, s 42 The part of the State consisting of the local government areas mentioned in section 2 of a part of schedule 3 is declared to be a joint local government area. 7 Establishment, operation, jurisdiction and membership of joint local government—Act, ss 43–45 and 48 (1) A joint local government is established for each joint local government area. (2) The joint local government has the name stated for the joint local government in section 1 of a part of schedule 3. (3) The number of representatives to which each component local government is entitled on the joint local government is stated in section 3 of the part of the schedule. (4) The joint local government has the jurisdiction stated for the joint local government in section 4 of the part of the schedule. (5) An additional section of the part of the schedule has effect for section 44 of the Act. (6) In this section— additional section means a section other than sections 1 to 4. Part 4 Repeal 8 Repeal of Local Government (Areas) Regulation 1995 The Local Government (Areas) Regulation 1995 SL No. 61 is repealed.

24 Local Government (Areas) Regulation 2005 Schedule 3 Information about joint local governments sections 6 and 7 Part 1 Caloundra–Maroochy Water Supply Board 1 Joint local government The name of the joint local government is the Caloundra–Maroochy Water Supply Board. 2 Area The joint local government area consists of the areas of Caloundra City Council and Maroochy Shire Council. 3 Composition The joint local government is composed of 3 members from each local government. 4 Jurisdiction The joint local government’s jurisdiction is— (a) to plan, design, construct, manage, maintain and operate— (i) water supply headworks consisting of a storage dam on Obi Obi Creek; and (ii) any other facility required for the supply of treated or untreated water in bulk to the joint local government area; and (b) to treat water in bulk in the area; and (c) to supply treated or untreated water in bulk to—

25 Local Government (Areas) Regulation 2005 Schedule 3 (continued) (i) Caloundra City Council and Maroochy Shire Council; and (ii) other consumers inside or outside the area; and (d) to sell treated or untreated water in bulk, on conditions the joint local government considers appropriate, to— (i) Caloundra City Council and Maroochy Shire Council; and (ii) other consumers inside or outside the area; and (e) to provide, maintain, protect and operate recreational facilities at the water supply headworks and on any other land owned by, or under the control of, the joint local government. 5 President (1) The members of the joint local government are to elect 1 of them as president of the joint local government. (2) An election for president must take place at the first meeting of the joint local government held after the conclusion of each quadrennial election for the councillors of Caloundra City Council and Maroochy Shire Council. (3) The presidency must alternate between a member who is a councillor of Caloundra City Council and a member who is a councillor of Maroochy Shire Council. (4) However, subsection (3) does not apply if at least 5 members of the joint local government vote against it.

26 Local Government (Areas) Regulation 2005 Part 2 Schedule 3 (continued) Dalby–Wambo Aerodrome Board 1 Joint local government The name of the joint local government is the Dalby–Wambo Aerodrome Board. 2 Area The joint local government area consists of the areas of Dalby Town Council and Wambo Shire Council. 3 Composition The joint local government is composed of 3 members from each local government. 4 Jurisdiction The joint local government’s jurisdiction is to establish, maintain and regulate public aviation stations for the starting, landing, housing, and repair of aerial craft in the joint local government area. Part 3 Dalby–Wambo Library Board 1 Joint local government The name of the joint local government is the Dalby–Wambo Library Board. 2 Area The joint local government area consists of the areas of Dalby Town Council and Wambo Shire Council.

27 Local Government (Areas) Regulation 2005 Schedule 3 (continued) 3 Composition The joint local government is composed of 4 members from Dalby Town Council and 2 members from Wambo Shire Council. 4 Jurisdiction The joint local government’s jurisdiction is to establish, maintain and conduct a library facility. 5 Contributions The cost of the operations of the joint local government must be paid as follows— (a) if the cost is less than $225000, Wambo Shire Council must pay $75000 and Dalby Town Council must pay the balance of the cost; (b) if the cost is $225000 or more, it must be paid in the following proportions— (i) Wambo Shire Council—one-third; (ii) Dalby Town Council—two-thirds. Part 4 Dalby–Wambo Saleyards Board 1 Joint local government The name of the joint local government is the Dalby–Wambo Saleyards Board. 2 Area The joint local government area consists of the areas of Dalby Town Council and Wambo Shire Council.

(b) to sell water in bulk to the councils of the shires of Esk, Gatton and Laidley, at points to be decided by agreement; and (c) to enter into any arrangements that may be necessary for the joint local government to be in a position to sell
