s1 3 s5 Transport Operations (Passenger Transport) Interim Standard 2005 Transport Operations (Passenger Transport) Interim Standard 2005 [reprinted as in force on 4 July 2005] 1 Short title This standard may be cited as the Transport Operations (Passenger Transport) Interim Standard 2005 . 2 Commencement and expiry (1) This standard commences on 4 July 2005. (2) This standard expires 6 months after it commences. 3 Definition In this standard— relevant bus means a bus fitted with seat belts for every seated passenger. 4 Application To the extent to which this standard prevents the carriage of standing passengers on a bus, this standard applies despite the Transport Operations (Passenger Transport) Standard 2000 , sections 12(2) and 21(2). 1 5 Operational safety of relevant bus A driver of a relevant bus must ensure the bus does not carry standing passengers. 1 Transport Operations (Passenger Transport) Standard 2000 , sections 12 (Operational safety of vehicles) and 21 (Ensuring operational safety of vehicles)

s6 4 s7 Transport Operations (Passenger Transport) Interim Standard 2005 6 Ensuring operational safety of relevant bus An operator of a relevant bus must take reasonable steps to ensure a driver of the bus does not carry standing passengers. 7 Exception A driver of a relevant bus may carry a person as a standing passenger on the bus if the driver reasonably believes not carrying the person on the bus may expose the person to risk, including, for example, because— (a) the person is a child or another vulnerable member of the community; or (b) the person would otherwise be left alone on an isolated or dangerous stretch of road. Examples of vulnerable members of the community — persons with a disability, women, pensioners
