bench charge sheet under section 12 must state—(a)thenameofthedefendantandofthecomplainant,ifany;
and(b)theoffencewithwhichthedefendantischargedandadequateparticularsofthechargetoinformthedefendantofthenatureofthecharge,including,forexample, the following particulars—(i)particularsoftheallegedtimeandplaceofcommitting the offence;(ii)particularsoftheperson,ifany,allegedtobeaggrieved;(iii)particulars of the property, if any, in
question; and(c)anycircumstancesofaggravationonwhichitisintended to rely.(2)Whenstatingtheoffenceinthebenchchargesheet,itissufficient to describe the offence in
the words of the CriminalCode or the Act defining it, or in
similar words.(3)A description of persons or things
that would be sufficient inan indictment is
sufficient in a bench charge sheet.(4)Subsection (1)(b) does not apply if section
42(2) of the Actapplies to the charge.Note—Section 42(2) of the Act already
requires particulars of certain chargesto be entered on

person’s authority under a non-Queensland driverlicence to drive on a Queensland road is
suspendedunder section 79B(3) of the Transport Act
becausethepersonhasbeenchargedasmentionedinaprovision of section 79B(1) of the
Transport Act;and(b)a decision is
made under the Act to dismiss or strike outthe complaint
