s1 3 s4 Nature Conservation (Protected Plants Harvest Period) Notice 2004 NATURE CONSERVATION (PROTECTED PLANTS HARVEST PERIOD) NOTICE 2004 [reprinted as in force on 1 April 2004] 1 Short title This notice may be cited as the Nature Conservation (Protected Plants Harvest Period) Notice 2004 . 2 Commencement This notice commences on 1 April 2004. 3 Definitions In this notice— “bioprospecting activity” see the Nature Conservation Regulation 1994 , schedule 10. “harvest period” means the harvest period declared under section 4. “protected plant” see the Nature Conservation (Protected Plants) Conservation Plan 2000 , schedule 3. “protected plant part” see the Nature Conservation Regulation 1994 , schedule 10. “salvage” see the Nature Conservation (Protected Plants) Conservation Plan 2000 , schedule 3. “stock plant” see the Nature Conservation Regulation 1994 , schedule 10. “whole” , for a protected plant, see the Nature Conservation Regulation 1994 , schedule 10. 4 Harvest period for protected plants A harvest period for all protected plants starts on 1 April 2004 and ends on 31 March 2005.

s5 4 s6 Nature Conservation (Protected Plants Harvest Period) Notice 2004 5 Limitation on application of harvest period (1) The harvest period does not apply to any of the following unless it is the subject of an approved commercial or recreational taking— (a) a whole protected plant of the genus Microsorum ; (b) a protected plant part for a plant of the genus Microsorum . (2) In this section— “approved commercial taking” means— (a) for a whole protected plant of the genus Microsorum— taking the plant, under a commercial wildlife harvesting licence— (i) as a stock plant; or (ii) under salvage; or (iii) for a bioprospecting activity; or (b) for a protected plant part for a plant of the genus Microsorum— taking the plant part, under a commercial wildlife harvesting licence— (i) under salvage; or (ii) for a bioprospecting activity. “approved recreational taking” , in relation to a whole protected plant of the genus Microsorum , or a protected plant part for a plant of the genus Microsorum, means taking the plant, or plant part, under salvage under a recreational wildlife harvesting licence. 6 Condition on commercial taking of particular protected plants (1) The maximum number of whole protected plants of the following genera that may be taken during the harvest period under all commercial wildlife harvesting licences is as follows— (a) for protected plants of the genus Cycas —68; (b) for protected plants of the genus Lepidozamia —113; (c) for protected plants of the genus Macrozamia —2 550; (d) for protected plants of the genus Xanthorrhoea— 27 000.

s7 5 s7 Nature Conservation (Protected Plants Harvest Period) Notice 2004 (2) The portion of the maximum number mentioned in subsection (1) that may be taken under a particular commercial wildlife harvesting licence is the number stated on the licence. 1 (3) Subsection (1) does not apply to taking whole protected plants— (a) as stock plants; or (b) under salvage; or (c) for a bioprospecting activity. 7 Expiry This notice expires on 1 April 2005. 1 See the Nature Conservation Regulation 1994 , section 119 (Meaning of number on relevant authority).
