receives birth application forms for the same child from 2males,eachrespectivelystatingthatheisthechild’sfather.Theregistrar issues a notice to the
child’s mother requiring her to provideinformation about
the father’s identity. The mother replies she does notknow.6Changing child’s first name within a year of
birth—Act, s13(1)Whenapplyingundersection13oftheAct,eachapplicantmust
produce to the registrar—(a)theprescribedidentificationdocumentsfortheapplicant;
and(b)if requested by the registrar, a
document verifying theidentityoftheapplicantasthechild’sparentorguardian.Examples for
paragraph (b)—•a copy of a certificate from a
register of births•an order evidencing
guardianship(2)If a document produced under this
section is a photocopy, thedocument must be
certified by a qualified witness as being acorrect copy of
the document.7Who may be issued with a certificate
of a closed entryrelating to a person whose sex has

appointed for theperson—the personal representative;(d)anofficerof,orpersonactingfor,alawenforcementbody;(e)a person who produces an order of a
court of the State orCommonwealth,oranorderofQCAT,requiringtheregistrar to accept an application
under section 44 of theAct.(2)When
applying for a certificate from a closed entry, a personmentioned in subsection (1)(a), (b) or (c)
must—(a)produce to the registrar—(i)theprescribedidentificationdocumentsfortheperson;
and(ii)the person’s
instrument of appointment; and(b)showthatthecertificateisrequiredtodischargeafunction under the person’s
appointment.(3)When applying for a certificate from a
closed entry, a personmentioned in subsection (1)(d)
must—(a)produceadocumentverifyingtheperson’sidentitytothe registrar; and(b)show
that the certificate is required to discharge—(i)a
function of the law enforcement body; or(ii)theperson’sdutyasanofficerofthelawenforcement body.Example of
documentary proof of an officer’s identity—an identity card
issued by a law enforcement body, with a photo of theofficer, that states the officer’s name,
rank and registered number(4)When applying
for a certificate from a closed entry, a personmentioned in
subsection (1)(e) must produce to the registrarthe prescribed
identification documents for the person.(5)IfacourtorderoranorderofQCATisproducedundersubsection (1)(e), the registrar must accept

section is a photocopy,the document must be certified by a
qualified witness as beinga correct copy of the document.Part
3Change of name8Information court may consider when
approving changeof child’s name—Act, s 17Whendecidingtoapproveaproposedchangeofachild’sname
under section 17(6) of the Act, the Magistrates Courtmay,
amongst other things, consider the following—(a)the
number of previous changes of the child’s name;(b)the
views of the child’s parents on the change of name,to
the extent that the parents’ views are available;(c)theviewsofthechild’sguardiansonthechangeofname,totheextentthattheguardians’viewsareavailable;(d)the
child’s views on the change of name, to the extentthat
the child’s views are available;(e)the
likely impact of the change of name on the child;(f)thechild’scultural,ethnicorindigenousbackgroundand whether the
change of name is likely to adverselyimpact the
child’s cultural, ethnic or indigenous identity.9Documents required for registering
change ofname—Act, s 19(1)For
section 19(1)(b) of the Act, the following documents areprescribedforanapplicationmadeundersection16oftheAct—(a)the
prescribed identification documents for the adult;(b)if the adult has former names
different from the name asregisteredatbirth—1ormoredocumentsevidencingthose names, if
requested by the registrar;Current as at 1

Australia—(i)1 or more documents verifying the
following—(A)the adult’s name at birth;(B)the adult’s date of birth;(C)the adult’s place of birth; and(ii)1ormoredocumentsevidencingtheadultisordinarily resident in Queensland;(d)iftheadulthasbeenmarried—1ormoredocumentsevidencing the marriage, if requested by the
registrar.(2)For section 19(1)(b) of the Act, the
following documents areprescribedforanapplicationmadeundersection17oftheAct—(a)theprescribedidentificationdocumentsforeachapplicant;(b)1ormoredocumentsverifyingtheidentityofeachapplicant as the
child’s parent or guardian, if requestedby the
registrar;(c)if the child has former names
different from the name asregisteredatbirthoradoption—1ormoredocumentsevidencing those names, if requested by the
registrar;(d)if the child is 12 years or
more—(i)the child’s written consent; or(ii)writtenevidenceofadoctorthatthechildisincapableofunderstandingthemeaningandimplications of a change of name; or(iii)a document
evidencing that the Magistrates Courthas approved a
change of name;(e)if the child was born outside
Australia—(i)1 or more documents verifying the
following—(A)the child’s name at birth;(B)the child’s date of birth;Page

sex11Noting reassignment of sex—Act, s
23(1)For section 23(4)(b)(i) of the Act, a
statutory declaration mustinclude each of the following—(a)thefullnameandresidentialaddressofthedoctormaking the declaration;(b)astatementthatthedoctorisaregisteredmedicalpractitioner in the State or country in
which the doctor isregistered;(c)the
doctor’s Medicare provider number, if applicable;Page

11](d)the date the doctor physically
examined, or performedthe sexual reassignment surgery on,
the person who hadthe sexual reassignment surgery;(e)astatementthatthedoctorhasverifiedtheperson’sidentity.(2)For section 23(4)(d) of the Act, the
following documents areprescribed—(a)theprescribedidentificationdocumentsforeachapplicant;(b)iftheapplicationismadeundersection23(2)oftheAct—adocumentverifyingtheidentityof,andtherelationship
between, the child and the child’s parents orguardians, if
requested by the registrar;(c)ifthesubjectoftheapplicationhasformernamesdifferentfromthenameasregisteredatbirth—documents evidencing those names, if
requestedby the registrar;(d)if
the subject of the application was married—(i)evidence of the death of the person’s last
husbandor wife; or(ii)a
document evidencing the dissolution of marriage;(e)if the recognition certificate under
section 23(4)(b)(ii) ofthe Act does not state that the
subject of the applicationhasundergonesexualreassignmentsurgery,statutorydeclarations by
2 doctors that—(i)state the same information mentioned
in subsection(1)(a) to (e); and(ii)verifythatthesubjectoftheapplicationhasundergone sexual reassignment
surgery.Examples for subsection (2)(b)—•a copy of a certificate from a

who certifiesthe burial or cremation; and(vi)the initials and
surname, and the denomination, ofany minister of
religion officiating at any servicefor the burial
or cremation;(b)for any registrable event—(i)the registrar’s name; and(ii)the registration
number; and(iii)the date and
place of registration.(4)Forsection41(4)(a)oftheAct,ifahumanbodyistobedisposedofbyaschoolofanatomy,theprescribedinformation is
that the body has been received for anatomicalpurposes by the
school of anatomy.(5)For sections 41D(1) and 41E(1) of the
Act, the information inschedule 1, part 1 is prescribed
information for an applicationto register a
parentage order or discharge order.13AParticulars for registration of
registeredrelationship—Act, s 25BFortheAct,section25B(2),thefollowingparticularsareprescribedforaregisteredrelationshipenteredintoasmentioned in theRelationships
Act 2011, section 6—(a)each
party’s—(i)full name; and(ii)date
of birth; and(iii)place of birth;
and(iv)sex; and(v)relationshipstatusbeforeenteringintotheregistered relationship; and(vi)usual
residential address;(b)the full name of

registration.13BParticulars of termination to be
included in theregister—Act, s 25CFortheAct,section25C(2),thefollowingparticularsareprescribed—(a)the
registrar’s name;(b)the date and place of
termination.14Correcting the register—Act, s
42(1)When amending particulars in an entry
in a register that is indocumentary form, the registrar
must—(a)for a clerical error—(i)rule through the incorrect particular
in a way thatallows the particular to remain legible;
and(ii)add the correct
particular; and(iii)initial and date
the correction; or(b)for an error of fact or
substance—(i)add the correct particular as a
marginal note; and(ii)sign and date
the correction.(2)When amending particulars in an entry
in a register that is in acomputer database, the registrar
must—(a)for a clerical error—(i)delete the incorrect particular;
and(ii)add the correct
particular; and(iii)addtheoperatoridentificationandthedateandtime
that the operator made the change; orCurrent as at 1

the entry—(i)the correct particular;(ii)ifthereasonforthecorrectionisshownintheregisterthatisindocumentaryform—thereasonfor the
correction;(iii)the date that
the particular was entered in the entryin the register
that is in documentary form;(iv)the
name of the registrar authorising the correction;(v)theoperatoridentificationandthedateandtimethat the
operator added the information.(3)When
cancelling an entry in a register, the registrar must—(a)for an entry in a register that is in
documentary form—(i)write across the entry the word
‘cancelled’ and thereason the entry is cancelled; and(ii)sign and date
the cancelled entry; and(iii)ifanewentryismadetoreplacethecancelledentry—note on
the cancelled entry a reference tothe new entry;
or(b)foranentryinaregisterthatisinacomputerdatabase—make a
note in the database that the entry iscancelled.15Information that may be obtained from
register—Act, s 44(1)When applying under section 44(1)(a)
and (b) of the Act forinformation,otherthanhistoricalinformation,theapplicantmustproducetotheregistrartheprescribedidentificationdocuments for
the applicant.(2)Forsection44(1)(b)oftheAct,thefollowingsourcedocuments are prescribed—(a)a document given to the registrar

section 44(5)(a) of the Act, the following information isprescribedtotheextentthattheinformationisintheregister—(a)for a birth—the information in
schedule 2, part 1;(b)for a change of name—the information
in schedule 2,part 2;(c)for
a marriage—the information in schedule 2, part 3;(d)for a death—the information in
schedule 2, part 4;(e)foraregisteredrelationship—theinformationinschedule 2, part 5;(f)for
a civil partnership registered under section 12 of theRelationships Act 2011as in force
immediately beforethe commencement of theCivil
Partnerships and OtherLegislationAmendmentAct2012,thefollowinginformation in
addition to the information mentioned inschedule 2, part
5—(i)the date on which the parties made the
declarationmentionedinsection11oftheRelationshipsAct2011asinforceimmediatelybeforethecommencementoftheCivilPartnershipsandOther Legislation Amendment Act 2012;(ii)the place where
the parties made the declaration.(4)If
the information in subsection (3)(c) is stated in a marriagecertificateintheregister,theregistrarmaygivetheinformation in the form of a copy of the
certificate.(5)For section 44(7)(c) of the Act, the
following information isprescribed for a birth—(a)allinformationaboutanymarriageoforregisteredrelationship
between the child’s parents;Current as at 1

children thatare not the other person’s children—the
names of thosechildren.16Information for commemorative birth
certificate(1)The following information is
prescribed for a commemorativebirth
certificate, to the extent that the information is recordedin,
or able to be worked out from, the entry in the register—(a)theparticularsprescribedundersection17,otherthansection 17(e);(b)the
full names of a father or adoptive father of the childat
the time of the child’s birth;(c)thefirstnames,andmaidensurname,ofamotheroradoptive mother of the child at the
time of the child’sbirth;(ca)if a person is registered as a parent,
but not as the fatheror mother, of the child—the full name
of the person atthe time of the child’s birth;(d)the age of each of the child’s parents
or adoptive parentsat the time of the child’s birth;(e)theplaceofbirthofeachofthechild’sparentsoradoptive parents.(2)However,ifthepersonapplyingforthecertificatemakesawritten request for the information
under subsection (1)(d) tobe withheld for either or both of the
child’s adoptive parents,the registrar may decide to withhold
the particular.17Information to be contained in birth
extractThe following information is prescribed for

register;(b)either—(i)iftheentryintheregistershowsthechild’ssurname—the
current surname in the register; or(ii)if
the entry in the register does not show the child’ssurnameandthebirthwasregisteredbeforethecommencement of section 12 of the
Act—(A)if a person is registered as the
father of thechild—thefather’scurrentregisteredsurname;
or(B)if no person is registered as the
father of thechild—themother’scurrentregisteredsurname;(c)the child’s sex;(d)the
child’s date and place of birth;(e)the
