receiptsAfundedprovidermustensurefundingorreceiptsforahousing service it provides are used
in a way that complieswith the funding agreement.9Return of unexpended amounts(1)This section applies to an amount
if—(a)theamountiscomprisedofreceiptsforahousingservice;
and(b)under the funding agreement for the
service, the amountisrequiredtobeexpendedwithinaparticularperiod;and(c)attheendoftheperiod,theamounthasnotbeenexpended.(2)While the funding agreement is in
force, the chief executivemay, by written notice, require the
funded provider to pay theamount to the chief executive.(3)Thefundedprovidermustpaytheamounttothechiefexecutive within 8 weeks after the day the

of funded property as securityA funded
provider must not use funded property as securityfor
a loan unless the provider is a registered provider that is
acompany registered under the Corporations
Act.11Particular funded providers must
prepare annualfinancial statements(1)Thissectionappliestoafundedproviderthatprovidesanancillary housing service (theservice).(2)The funded provider must prepare
annual financial statementsforeachfinancialyearinwhichitreceivesfundingfortheservice.(3)Theannualfinancialstatementsmustbeintheform,andcontain the information, required under the
funded provider’sestablishing Act.(4)If
the chief executive requests a copy of the annual financialstatements, the funded provider must comply
with the request.(5)To remove any doubt, it is declared
that this section applies tothe funded
provider even if it—(a)doesnotprovide,orisnotrequiredtoprovide,theservice for the whole of the financial year;
or(b)stops providing the service before
fully complying withthis section.12Asset
management plan(1)Afundedprovidermustprepareandimplementamanagement plan (anasset management
plan) for each of itsassets that is
funded property.(2)The purposes of an asset management
plan are to—(a)maintain the long-term viability and
value of the asset towhich the plan applies; and(b)ensure the asset is appropriate

needs of persons accessing the service; and(iii)thecircumstancesinwhichthefundedprovideroperates the service.(3)An
asset management plan mustinclude financial strategiesfor
its implementation.(4)If the chief executive requests a copy
of an asset managementplan, the funded provider must comply
with the request.Division 3Governance and
service delivery13Compliance with information privacy
principlesA funded provider must comply with
theInformation PrivacyAct 2009,
chapter 2, parts 1 and 3 as if the provider were thedepartment.14Eligibility assessment and allocations
policy—socialhousing services(1)This
section applies to a funded provider that provides, or isrequiredunderafundingagreementtoprovide,asocialhousing service
(theservice).(2)Inassessingaperson’seligibilitytoreceive,orcontinuereceiving,theservice,thefundedprovidermustimplementthedocument,publishedbythedepartment,called‘SocialHousing
Eligibility Criteria’.Note—A copy of the

services(1)A funded provider must ensure an
application received from apersonforasocialhousingserviceisintheapprovedformand
given—(a)directly to the chief executive;
or(b)to a funded provider approved by the
chief executive toreceive an application for a social housing
service.(2)Ifafundedproviderotherthanaprovidermentionedinsubsection (1)(b) receives an
application in the approved formforasocialhousingservice,theprovidermust,assoonaspracticable, give the application to—(a)the chief executive; or(b)a funded provider mentioned in
subsection (1)(b).16Eligibility assessment—ancillary
housing services(1)This section applies to a funded
provider that provides, or isrequired under a
funding agreement to provide, an ancillaryhousing service
(theservice).(2)The funded provider must keep a policy
(theeligibility policy)statingthecriteriaandproceduresfordecidingwhetheraperson is eligible to receive the
service.(3)Theeligibilitypolicymustcomplywiththefundingagreement for

policy(1)This section applies to a funded
provider if, in the course ofproviding a
housing service, the provider provides housing toindividuals (each, aresident)
for residential use.(2)Thefundedprovidermustkeeparentpolicythatcomplieswiththefundingagreementforthehousingserviceandincludes appropriate provision for the
following matters—(a)explaining rent calculations to the
residents and dealingwith their queries or concerns about
matters relating torent;(b)giving the residents a choice of rent
payment methods;(c)preventing serious rent
arrears.(3)Thefundedprovidermustimplementtherentpolicyconsistently and fairly.(4)Forsubsections(2)and(3),itdoesnotmatterwhetheraresident pays the provider rent for
the housing.(5)However,ifaresidentdoespaytheproviderrentforthehousing, the provider must keep a
record of rent calculationsfor the resident
for the period—(a)starting on the day the resident
starts paying rent; and(b)ending on the
day that is 6 months after the last day onwhich the
resident pays rent.(6)In this section—rentpolicymeansapolicystatingcriteriaandproceduresrelating to rent
paid by residents, including—(a)setting the amount of rent; and(b)calculating rent payments; and(c)collecting rent; and(d)managing rent arrears.Current as at 1 July 2015Page

propertydetails(1)This
section applies to a funded provider that provides, or isrequiredunderafundingagreementtoprovide,asocialhousing service
(theservice).(2)Thefundedprovidermustgivethechiefexecutiveinformation,intheapprovedform,abouteachfundedproperty for the
service.(3)If information given to the chief
executive under subsection(2) changes, the funded provider must,
as soon as practicable,give the chief executive details of
the change in the approvedform.19Preparation or submission of documents
generally(1)The chief executive may give a funded
provider written noticerequiring the provider to give the
chief executive within thetime stated in the notice—(a)stated financial information relating
to a housing servicethefundedproviderprovides,orisrequiredunderafunding agreement to provide; or(b)stated information about—(i)the use of funded property; or(ii)anothermatterrelatingtotheprovisionofahousing service
the funded provider provides, or isrequired under a
funding agreement to provide; or(c)statednon-identifyinginformationaboutthefundedprovider’s
clients.(2)The funded provider must comply with a
request made undersubsection (1) within the time stated in the

register41Chief executive to keep contracts
register(1)The chief executive must keep a
contracts register.(2)Thechiefexecutivemaykeepthecontractsregisterintheform the chief
executive considers appropriate.42Particulars that must be recordedThechiefexecutivemustrecordinthecontractsregisterparticulars
about—(a)a section contract, including the name
of the purchaserunder the contract; and(b)documentslodgedwiththechiefexecutiveaboutasection contract, including when they were
lodged; and(c)registrabledocumentslodgedwiththechiefexecutiveabout a section contract, and when they were
recorded;and(d)anythingelseaboutasectioncontractthechiefexecutiveconsidersshouldberecordedtoensuretheregisterisanaccurate,comprehensiveanduseablerecord of the
contracts.43Recording ending of contractWithout limiting section 42(d), the chief
executive may notethe contracts register about the ending of a
section contract,including—(a)when
the contract ends; and(b)thereasonfortheending,including,forexample,because—(i)theamountpayableunderthecontracthasbeenfully paid;

purchaser under the contract has breached theterms of the

chief executive may keep, separately from the contractsregister, information the chief executive

register(1)A document forms part of the contracts
register from when itis lodged.(2)Adocumentisregisteredwhentheparticularsaboutthedocument are recorded in the contracts
register.46Entitlement to search register(1)A person may, after paying the fee
stated in schedule 3—(a)search and
obtain a copy of—(i)particulars recorded in the contracts
register abouta section contract; or(ii)a
document lodged but not registered (whether ornot it has been
cancelled); or(iii)a registered
document; or(iv)information kept
under section 44; and(b)obtain a copy of
the things mentioned in paragraph (a)certified by the
chief executive to be an accurate copy.(2)Subsection(1)(a)(ii)and(iii)donotapplytoadocumentdisposed of by
the chief executive under thePublic
RecordsAct 2002.(3)Thechiefexecutivemaycertifyacopyofadocumentmentioned in

document purporting to be a certified copy of a documentmentioned in subsection (1)(a) is evidence
of the original ofthe document.47Chief
executive may correct contracts register(1)The
chief executive may correct the contracts register if thechief executive is satisfied—(a)the register is incorrect; and(b)thecorrectionwillnotprejudicetherightsofapurchaser.(2)The
chief executive’s power to correct the contracts registerincludes power to correct—(a)a particular in the register;
or(b)a document forming part of the
register.(3)If a particular or a document is
corrected, the chief executivemust record in
the register—(a)the state of the register before the
correction; and(b)the day and circumstances of the
correction.48Requisitions(1)Thechiefexecutivemay,bywrittennotice(arequisition)giventoapersonwhohaslodgedadocument,requiretheperson to—(a)re-execute,completeorcorrectthedocumentifitappears to the chief executive to be
wrong, incompleteor defective; or(b)producetothechiefexecutivestatedinformation,ordepositastateddocument,insupportoftheperson’sapplication to
register the document lodged.(2)The
requisition may require a document or information to beverified by statutory declaration or
affidavit.(3)The requisition may state when it must

chief executive may extend the time for complying withthe
requisition.(5)Thechiefexecutivemayrefusetodealwithadocumentlodgedbyapersonuntilthepersoncomplieswiththerequisition and pays the fee prescribed in
schedule 3.49Registering death of joint
purchaser(1)A person may ask the chief executive
to register the death of apersonwhoisapurchaserasajointtenantunderasectioncontract
(ajoint purchaser).(2)Thechiefexecutivemayonlyregisterparticularsaboutthedeath of a joint purchaser if a
request to register the change islodged.50Registering personal
representative(1)A person may ask the chief executive
to register the death of apurchaser under a section contract and
to register the personas the purchaser’s personal
representative.(2)Thechiefexecutivemayregisterapersonaspersonalrepresentative
only if—(a)a request under subsection (1) is
lodged; and(b)1oftheconditionsspecifiedinsubsection(3)issatisfied.(3)Theconditionsreferredtoinsubsection(2)(b)arethefollowing—(a)if
the person has obtained a grant of representation—thegrant,oranofficecopyofthegrantissuedbytheSupreme Court, is given to the chief
executive;(b)ifparagraph(a)doesnotapplyandapurchaserdiedwithout a will—(i)lettersofadministrationofthepurchaser’sestatehavenotbeengrantedinQueenslandwithin6months after the purchaser’s death;

register[s 51](ii)thegrossvalueofthepurchaser’sestateinQueensland on the day of the
purchaser’s death isnot more than $150000; and(iii)the chief
executive believes the person has a rightto obtain a
grant of representation;(c)if paragraph (a)
does not apply and the purchaser diedleaving a
will—the chief executive believes the personhas a right to
obtain a grant of representation.(4)A
person registered as personal representative without a grantof
representation has the same interest in a section contract
asif the person had obtained a grant of
representation.(5)Thevalidityofanactdone
orpaymentmadeingoodfaithunderasectioncontractbyapersonregisteredaspersonalrepresentative
is not affected by a later grant of representation.(6)Ifthepersonwhoobtainsagrantofrepresentation(thegrantee)isdifferentfromthepersonregisteredaspersonalrepresentative,
the person must—(a)accounttothegranteeforaninterestinasectioncontract
controlled by the person before the grant wasmade; and(b)takeallactionnecessarytovestinthegranteetheinterestinthecontractremainingundertheperson’scontrol.(7)Inasectioncontract,areferencetoapurchaserincludesareference to the purchaser’s personal
representative.(8)However, subsection (7) applies only
to the extent that there isno contrary
intention in the section contract.51Registering person beneficially
entitled(1)Apersonbeneficiallyentitledunderawilltoapurchaser’sinterest in a
section contract may lodge a request to register atransmission of the interest to that
person.(2)However,thechiefexecutivemayregisteratransmissionunder subsection

request under subsection (1) is lodged; and(b)thepurchaser’spersonalrepresentativegiveswrittenapproval;
and(c)the chief executive is satisfied the
person is beneficiallyentitled to the interest.52Registering other dealings(1)The chief executive may register
particulars about each of thefollowing
dealings only if a request to register the dealing islodged—(a)a
change or correction of name of a purchaser under asection contract;(b)a
court order affecting, whether directly or indirectly, apurchaser’s interest in a section
contract;(c)acourtordersettingasideacourtordermentionedinparagraph (b);(d)a
power of attorney, under which an attorney has powerto
act on a purchaser’s behalf under a section contract oranother document lodged;(e)arevocationofapowerofattorneymentionedinparagraph (d);(f)atransmissionofapurchaser’sinterestinasectioncontract under a law about
bankruptcy;(g)a disclaimer of an interest in a
section contract under alaw about bankruptcy;(h)anassignmentofapurchaser’sinterestinasectioncontract;(i)severanceofajointtenancybetweenjointpurchasersunder a section
contract.(2)A request to register lodged under
subsection (1)—(a)must be in writing; andPage

Fees[s 53](b)if
the request is a registrable document—must be in theform(ifany)approvedbythechiefexecutiveundersection 53.53Form
of registrable documents(1)Thechiefexecutivemayapprovetheformofaregistrabledocument.(2)If the form of a registrable document
has been approved undersubsection (1), a registrable document
may be registered bythe chief executive only if it is in
the approved form.(3)However,ifaregistrabledocumentisnotintheapprovedform,thechiefexecutivemayregisterthedocumentifthechief executive considers it
appropriate in the circumstances.Part 4Fees54Fees(1)Subject to subsections (2) and (3),
the fees payable under theAct are stated in schedule 3.(2)Subsection (3) applies if the chief
executive believes that byreducing the application fee for a
particular loan product, ornotrequiringpaymentofanapplicationfeeforaparticularloanproduct,thechiefexecutivemayachieve,orbetterachieve—(a)an object of the Act; or(b)the administration of the Act in a way
that has sufficientregard to a guiding principle under the
Act.(3)The chief executive may, by gazette
notice, declare that—(a)the application
fee for a stated loan product is a statedamountlessthantheapplicationfeeprescribedunderschedule 3, part 1 for the loan product;

fee is payable for an application for a particular loanproduct.(4)In
this section—loan productmeans a type of
loan the chief executive decidesto make
available, including, for example, a type of loan thatis—(a)for a particular
purpose; or(b)targeted for a particular client
group.55Exemption from payment of feesThe
chief executive may exempt a person from paying a fee orpart
of a fee if the chief executive is satisfied the person issuffering hardship.56Expenses of taking possession(1)This section applies if—(a)thechiefexecutivetakespossessionoflandunderasection contract; and(b)the section contract provides for an
amount to be paid tothechiefexecutivefortheexpensesoftakingpossession.(2)The
purchaser under the contract must pay the chief executivethe
chief executive’s actual expenses of taking possession.Part

159(2) of the Act, the way inwhich an
accommodation provider must transfer or otherwisedispose of each of its relevant
assets.(2)Before transferring or otherwise
disposing of a relevant asset,anaccommodationprovidermustconsultwiththechiefexecutive about
the most appropriate method for transferringor otherwise
disposing of the asset.(3)Anaccommodationprovidermaytransferorotherwisedispose of
relevant property, other than a relevant lease, in any1 or
more of the following ways—(a)by
paying the department an amount of money that isequal to the value of the interest in the
asset held by thechief executive;(b)bytransferringtheaccommodationprovider’sproprietary
interest in the asset to the chief executive;(c)withthewrittenconsentofthechiefexecutive—bytransferring the
asset to a registered provider;(d)in a
way, other than a way mentioned in paragraphs (a)to
(c), stated in a written agreement between the chiefexecutiveandtheaccommodationproviderfortransferring or otherwise disposing of
the property.(4)Anaccommodationprovidermaytransferorotherwisedispose of a
relevant lease in any 1 or more of the followingways—(a)by
surrendering the provider’s interest under the lease tothe
chief executive;(b)withthewrittenconsentofthechiefexecutive—transferringorassigningtheprovider’sinterest under

relevant receipts in any 1 or more of the followingways—(a)byreturningtheamountofthereceiptstothechiefexecutive;(b)withthewrittenconsentofthechiefexecutive—bytransferring the
amount to a registered provider;(c)in a
way, other than a way mentioned in paragraph (a) or(b),statedinawrittenagreementbetweenthechiefexecutiveandtheaccommodationproviderfordisposing of the receipts.(6)Thechiefexecutivemayimposeaconditiononawrittenconsent
mentioned in subsections (3)(c), (4)(b) or (5)(b) if thechief executive considers the condition
reasonably necessaryto protect the asset.(7)Anaccommodationprovidermustcomplywithanyconditions imposed by the chief
executive.(8)In this section—relevant
leasemeans relevant property that is leased by
thechief executive or the Queensland Housing
