s1 3 s4 Duties (Transitional) Regulation 2003 DUTIES (TRANSITIONAL) REGULATION 2003 [reprinted as in force on 19 September 2003] 1 Short title This regulation may be cited as the Duties (Transitional) Regulation 2003 . 2 Commencement This regulation commences on 19 September 2003. 1 3 Transitional declaration For section 550 of the Act, this regulation is a transitional regulation. 4 Repealed Act applies to particular instruments relating to particular leases etc. (1) This section applies if— (a) stamp duty under the repealed Act was chargeable or paid for any of the following (each a “prescribed lease” )— (i) a lease or an agreement for lease; (ii) a transaction mentioned in section 54AB(1)(b) of that Act; (iii) a contract or agreement for which a statement under section 64D(3) of that Act was or should have been made; 2 and 1 Under section 550(4) (Transitional regulation-making power) of the Act, this regulation expires 5 years after the commencement day for the Act (the commencement day was 1 March 2002). 2 Repealed Act, sections 54AB (Duty payable where no dutiable instrument) and 64D (Licence to occupy premises)

s4 4 s4 Duties (Transitional) Regulation 2003 (b) the rent payable in relation to the prescribed lease is increased by an instrument effected on or after the day this regulation commences. (2) The repealed Act applies to the instrument increasing the rent payable in relation to the prescribed lease as if that Act had not been repealed.
