achievement(1)The objective of this management plan
is to provide for theuse, conservation and enhancement of
the community’s coralreef fin fish resources by managing
commercial fishing for thereef line fishery in a way that seeks

Introduction[s 4](a)applyandbalancetheprinciplesofecologicallysustainable
development; and(b)promote ecologically sustainable
development.(2)The objective is to be achieved mainly
by—(a)restricting access to the reefline
fishery for trade andcommercetoholdersoflicencesonwhichthefisherysymbol ‘RQ’ is
written; and(b)using line units to limit the annual
commercial harvestof coral reef fin fish by all holders of
licences on whichthe fishery symbol ‘RQ’ is written.(3)In this section—principlesofecologicallysustainabledevelopmentseesection 3(5) of the Act.Notes—1This plan does
not make any fisheries declarations. For relevantfisheries declarations for coral reef fin
fish, see chapters 2, 3 and 4and schedule 2 of
the regulation.2This plan does not regulate the taking
of coral reef fin fish byrecreational fishers. For relevant

holder(1)The holder of, or a person acting
under, a CT line unit maytake, in a line year, the weight of
regulated coral trout workedout by dividing
the annual quota for regulated coral trout forthe line year by
the total number of CT line units that havebeen
issued.(2)The holder of, or a person acting
under, a RTE line unit maytake, in a line year, the weight of
redthroat emperor workedout by dividing the annual quota for
redthroat emperor for theline year by the total number of RTE
line units that have beenissued.(3)The
holder of, or a person acting under, an OS line unit maytake,inalineyear,theweightofothercoralreeffinfishworked out by
dividing the annual quota for other coral reeffin fish for the
line year by the total number of OS line unitsthat have been

chiefexecutive for the reef line fishery under
the Act, section 44.70When line unit entitlement isusedfor a line year(1)The
entitlement of a line unit held by a person isusedfor
aline year—(a)when
the holder, or a person acting under the line unit,has
taken, in that line year under any RQ licence held bythe
line unit holder, an amount (in whole weight) of theprescribed coral reef fish for the line unit
equalling theholder’s entitlement under the line unit;
or(b)if section 71(2) applies.(2)Theunused
entitlementof a holder’s line unit for a line
yearis the amount (in whole weight) of the
prescribed coral reeffin fish for the line unit that has
not been taken, for the lineyear, under any
RQ licence held by the line unit holder.71No
carrying forward of unused entitlement(1)This
section applies if, in a line year, a line unit holder takesanamountoftheprescribedcoralreeffinfishforthelineunits that is
less than the total entitlements under the holder’sline
units.(2)The holder is taken, at the end of the
line year, to have used allthe entitlements
under the line units held by the holder for theline
year.72Line unit certificates(1)Thechiefexecutivemustissueasinglecertificatetoeachperson who holds

an amount stated for whole coral reef fin fish—theamount stated; or(b)foranamountstatedforcoralreeffinfishthatisnotwhole—theamountcalculatedinthewaystatedinschedule 7.74AParticular notice is evidence of unused
entitlement(1)ThissectionappliesifaholderofCTlineunits,RTElineunits or OS line
units has obtained a written notice from thechiefexecutivestatingtheamountofunusedentitlementunder the CT
line units, RTE line units or OS line units for astated line year on a stated date.(2)The notice is evidence of the amount

section 65B of the Act, an application to transfer aline
unit is registered, the chief executive must give effect tothetransferbychanging,cancellingorreplacingthetransferor’s and transferee’s current line

holder of line units may, by written notice, ask the chiefexecutive to change the unit PIN for the
line units.(2)On receiving the notice, the chief

licence(1)This section, and sections 104 and
105, apply to the taking ofcoral reef fin
fish under an RQ(L8) licence.(2)Coral reef fin fish may be taken only by
using drop lines orbottom set lines as required under section
104 or 105.(3)Apersonmustbewithin100mofalineorgroupoflineswhile they are
in use.(4)A drop line and a bottom set line must
not be used at the sametime.104Using
drop lines—RQ(L8) licence(1)A drop line must
not have more than 50 hooks attached to it.(2)Not
more than 6 drop lines may be used at a time.(3)Each
drop line must have attached to it a light coloured floatthat
is—(a)markedwiththeboatmarkoftheprimaryboatidentified on
the holder’s RQ licence; and(b)at

identification orcounting of coral reef fin fish(1)This section applies if—(a)coralreeffinfishareonboardacommercialfishingboat; and(b)anyfishonboardtheboatarestoredinasealedcontainer.(2)The
person in control of the boat must ensure the containerhas
attached to it a label stating, clearly and legibly—(a)ifthecontainercontains
coraltrout—thewords‘coraltrout’ and the
number of coral trout inside the container;or(b)if the container contains redthroat
emperor—the words‘redthroatemperor’andthenumberofredthroatemperor inside
the container; or(c)ifthecontainercontainsothercoralreeffinfish—thewords ‘other
coral reef fin fish’ and the number of othercoral reef fin
fish inside the container; or(d)ifthecontainercontainsfishotherthancoralreeffinfish—the words ‘other species of fish’
and the numberof fish inside the container.Division 3Use of

are located—(i)in L2 or L3 fishery area; and(ii)on the same
reef; or(b)both of the following apply—(i)the tender boat is used only to
carry—(A)fish taken by its primary boat;
or(B)fishing apparatus used from its
primary boat;(ii)the tender boat
and its primary boat are both within2km of the
mainland shore.109Permitted distance for assistant
fisher to be underdirection(1)If a
commercial fisher and an assistant fisher are on separatecommercialfishingboats,thepermitteddistancefortheassistant fisher
to be under direction is—(a)in the L8
fishery area—800m; or(b)in other

ends.authorised boat, for a line
unit holder, means—(a)the primary boat under any of the RQ
licences held bythe line unit holder; or(b)any
of the primary boat’s tender boats.authorised
unloading time, for unloading coral reef fin fishfor
which a prior notice or transhipment notice has not beengiven, means—(a)ifthepersonunloadingthefishhasbeengivenpermission,byaninspector,tounloadthefishonorafter a stated time—the stated time;
or(b)otherwise—(i)if
the authorised boat or transport vessel on whichthe
fish are on board landed at or north of latitude15º50.30' south and an unnotifiable landing
noticefor the landing was given before 9a.m. on
the daytheboatorvessellanded—3p.m.onthedaytheboat

the area.(2)The holder must give notice (prior notice) of the prior

prescribed person must not take coral reef fin fish from anauthorisedboatfortheholderaftertheprescribedtimeunless—(a)allthecoralreeffinfishonboardalltheauthorisedboats for the
holder have been unloaded; and(b)anunloadedfishnoticehasbeengiven,asrequiredunder section
122, for the fish.(3)However,subsection(2)(a)doesnotapplyiftheprescribedperson complies
with the retained fish conditions.(4)Also, if asked by an inspector after an
authorised boat for theholder lands at the landing place, a
prescribed person must tellthe
inspector—(a)the place (theunloading
place) where the fish on boardthe
authorised boats for the holder are to be unloaded;and(b)theestimatedtime(theunloadingtime)atwhichthefish
are to be unloaded.(5)If subsection (4) applies, a
prescribed person must not unload,or allow to be
