purposes of regulationThe main purposes of this regulation
are—(a)toreduceriskarisingfromthetransportofdangerousgoods by rail;
and(b)togiveeffecttothestandards,requirementsandprocedures of the ADG Code so far as they
apply to thetransport of dangerous goods by rail;
and(c)topromoteconsistencybetweenthestandards,requirementsandproceduresapplyingtothetransportof
dangerous goods by rail and those applying to othermodes
of transport.

200211Transport of small quantity(1)This regulation does not apply to the
transport by a person of aload of dangerous goods by rail
if—(a)the goods are packaged dangerous
goods; and(b)thegoodsarenot,anddonotinclude,designateddangerous goods;
and(c)theaggregatequantityofthedangerousgoodsintheload is less than
25% of a placard load; and(d)thegoodsarenotbeingtransportedbythepersonforhire
or reward in the course of a business of transportinggoods
by rail; and(e)the goods are not being transported by
the person on apassenger train.(2)In
this section—designated dangerous goodsmeans
dangerous goods of class1 (other than of class 1.4S and track
signals carried for safeworking purposes), class 6.2 or class
7.12Short trip after importSections 51 to 541and
part 4, divisions 5 to 7,2do not apply
tothe transport of dangerous goods by rail
if—(a)the goods have been imported into
Australia through aplace in Queensland; and(b)thegoodsarebeingtransportedinaclosedfreightcontainer; and(c)the
goods are not leaking from the container; and(d)the
goods are being transported directly to a destinationthatisnotmorethan50kmbyrailfromtheplaceofimport; and1Sections 51 (Suitability of packaging), 52

that—(a)goods are dangerous goods; or(b)goods are not dangerous goods;
or(c)goods are dangerous goods of a
particular class; or(d)goods are dangerous goods with a
particular subsidiaryrisk; or(e)goodsaredangerousgoodsassignedtoaparticularpacking group;
or(f)goodsareincompatiblewithparticulardangerousgoods; or(g)goods

rules. Some provisions of the rail rules arereserved for

and the rail rules, the numbers of someparts, divisions
and sections have not been used.

2002(2)Adeterminationundersubsection(1),otherthananadministrativedetermination,mustbemadebywrittennotice.418Administrative
determinationsAdeterminationisanadministrativedeterminationifthedetermination—(a)is
made on the application of a person; and(b)applies only to the person.519Conditions of
administrative determinationsAnadministrativedeterminationmaybeonaconditionnecessary for the
safe transport of dangerous goods by rail.20Register of determinations(1)The chief executive must keep a
register of determinations.(2)The register may
have separate divisions for different kinds ofdeterminations.(3)The
chief executive must record in the register—(a)each
determination; and(b)eachdeterminationbyacorrespondingcompetentauthority that—(i)thepaneldecidesshouldhaveeffectinallparticipatingjurisdictionsor1ormoreparticipatingjurisdictionsincludingthisjurisdiction; and(ii)thechiefexecutivedecideshaseffectinQueensland.4The
notice is declared to be subordinate legislation under theStatutory InstrumentsRegulation
2002, section 3(3) and schedule 1.5Part17containsprovisionsdealingwithapplicationfor,andamendmentandcancellation of, administrative
determinations.

register—(a)the revocation of a determination;
and(b)adecisionofthepanelreversingadecisionthatacorrespondingdeterminationshouldhaveeffectinallparticipatingjurisdictionsorparticipatingjurisdictionsincluding this
jurisdiction.21Additional matters to be recorded in
register(1)The record of a determination in the
register must include theprovisions of the
determination.(2)TherecordofacorrespondingdeterminationintheregistermustincludethetitleoftheGovernmentgazetteoftheparticipatingjurisdictionwherethecorrespondingdetermination was
notified or published and the date it wasnotifiedorpublished,butisnotrequiredtoincludetheprovisions of the determination.22Reference to panel(1)Thissectiondoesnotapplytoanadministrativedetermination.(2)Thechiefexecutivemustreferadraftofaproposeddetermination to
the panel if the chief executive decides theproposed
determination should have effect in all participatingjurisdictionsor1ormoreotherparticipatingjurisdictionsincluding this
jurisdiction.(3)The chiefexecutive
mustrefertothe
paneladeterminationhavingeffectinthisjurisdiction,and1ormoreotherparticipating
jurisdictions, if—(a)the chief executive decides the
determination should becancelled or amended; or(b)a corresponding competent authority
recommends to thechief executive in writing that the
determination shouldbe cancelled or amended.

200223Effect of panel decision about draft
determination(1)This section applies if—(a)adraftdeterminationisreferredtothepanelundersection 22(2); and(b)the
panel decides that—(i)the draft determination should be
made, what theprovisions of the determination should be,
and thatthedeterminationshouldhaveeffectinallparticipatingjurisdictionsor1ormoreotherparticipatingjurisdictionsincludingthisjurisdiction; or(ii)thedeterminationshouldnothaveeffectinthisjurisdiction.(2)The
chief executive must have regard to the panel’s decision.24Effect of panel decision about
cancelling or amendingdetermination(1)This
section applies if—(a)adeterminationisreferredtothepanelundersection22(3); and(b)the panel decides that—(i)the determination should be cancelled;
or(ii)the determination should not be
cancelled; or(iii)the determination
should be amended, whether ornotthepanel’sdecisionisthesameastheamendmentproposedbythechiefexecutive,andshould have effect as amended in all
participatingjurisdictionsorparticipatingjurisdictionsincluding this
jurisdiction; or(iv)the determination should not be
amended.(2)The chief executive must have regard
to the panel’s decision.

provision of a corresponding determination is inconsistentwith

prosecution for an offence against this regulation, it ismaterial to prove someone reasonably ought
to have known orsuspected something, the issue must be
decided having regardto—(a)theperson’sabilities,experience,qualificationsandtraining; and(b)the
circumstances of the alleged offence.29Duty

section applies if—(a)a person manufactures or imports
goods; and(b)thegoodsarenotdangerousgoodsundersection31(1)(a) to (d);

ought to suspect, thatthegoodssatisfytheUNdangerousgoodstestsandcriteriafordeterminingwhethergoodsaredangerousgoods.(2)Thepersonmustnotconsignortransportthegoodsbyrailunless the person finds out whether
the goods satisfy the testsand criteria.Maximum

goods.(2)However,goodsarenotdangerousgoodsiftheyaredetermined under
section 17(1)(b) not to be dangerous goods.32Classes of dangerous goods(1)In this regulation, a reference
to—(a)aclassof
dangerous goods is a reference to the class towhich the goods
are assigned under subsection (2); and(b)aclassby number, or
number and letter, is a reference tothe number, or
number and letter, of the class to whichthe goods are
assigned.(2)Dangerous goods are assigned to a
class if the goods—(a)are assigned to the class in the ADG
Code, appendix 2,column 3; or(b)areassignedtotheclassinaspecialprovisionoftheADG Code applying
to the goods; or(c)satisfythecriteriaintheADGCode,appendix2,column 9 for assignment to the class;
or(d)are determined under section 17(1)(c)
to be dangerousgoods of the class; or(e)satisfytheUNdangerousgoodstestsandcriteriaforassignment to the class.33Subsidiary risk(1)In
this regulation, a reference to—

tothe dangerous goods assigned the subsidiary
risk undersubsection (2); and(b)asubsidiary riskby number is a
reference to the numberof the subsidiary risk with which the
dangerous goodsare assigned.(2)Dangerous goods are assigned a subsidiary
risk if the goods—(a)areassignedthesubsidiaryriskintheADGCode,appendix 2,
column 4; or(b)are assigned the subsidiary risk in a
special provision ofthe ADG Code applying to the goods;
or(c)satisfythecriteriaintheADGCode,appendix2,column 9 for assignment of the subsidiary
risk; or(d)are determined under section 17(1)(d)
to be dangerousgoods with the subsidiary risk; or(e)satisfytheUNdangerousgoodstestsandcriteriaforassignment to the subsidiary risk.34Packing group(1)In
this regulation, a reference to—(a)apacking groupof dangerous
goods is a reference tothepackinggrouptowhichthegoodsareassignedunder subsection
(2); and(b)apacking
groupby number is a reference to the
numberof the packing group to which the goods are
assigned.(2)Dangerous goods (other than dangerous
goods of class 1, 2 or7) are assigned to a packing group if
the goods—(a)areassignedtothepackinggroupintheADGCode,appendix 2, column 5; or(b)are
assigned to the packing group in a special provisionof
the ADG Code applying to the goods; or(c)satisfythecriteriaintheADGCode,appendix2,column 9 for assignment to the packing
group; or

2002(d)are determined under section 17(1)(e)
to be assigned tothe packing group; or(e)satisfytheUNdangerousgoodstestsandcriteriaforassignment to the packing group.35Incompatible goods, container or
transfer equipment(1)Dangerousgoodsorothergoodsareincompatiblewithdangerous goods if—(a)under
the ADG Code, the goods are incompatible withthe dangerous
goods; or(b)thegoodsaredeterminedundersection17(1)(f)tobeincompatible with
the dangerous goods; or(c)whenthegoodsaremixed,orotherwisebroughtintocontact, with the dangerous goods, the
goods are likelyto interact with the dangerous goods and
increase riskbecause of the interaction.(2)However in a proceeding in which
incompatibility is an issue,goods are taken
not to be incompatible with dangerous goodsif—(a)thegoodsareincompatiblewiththedangerousgoodsonly
because of subsection (1)(a) or (b); and(b)itisestablishedthat,whenthegoodsaremixed,orotherwisebroughtintocontactwiththedangerousgoods,thegoodsarenotlikelytointeractwiththedangerousgoodsandincreaseriskbecauseoftheinteraction.(3)A
tank or container isincompatiblewith dangerous
goods ifthe tank or container is constructed of
material that, when thegoods are brought into contact with
the tank or container, islikely to interact with the goods and
increase risk because ofthe interaction.Example of
increased risk because of interaction—Significant structural weakening of the tank
or container.(4)Transferequipmentforuseinthetransportofdangerousgoodsisincompatiblewiththegoodsiftheequipmentis

are brought intocontact with the equipment, is likely to
interact with the goodsand increase risk because of the
interaction.Example of increased risk because of
interaction—Failureofthetransferequipmentresultinginleakageofdangerousgoods.Division 2Packages,
packaging and loads36Packages and packaging(1)Apackageof
dangerous goods or other goods is the completeproduct of the
packing of the goods for transport by rail, andconsists of the
goods and their packaging.(2)Thepackagingofthegoodsisthecontainerinwhichthegoods
are received or held for transport by rail, and includesanythingthatenablesthecontainertoreceiveorholdthegoods or to be
closed.37CapacityThecapacityof a container is
the total internal volume of thecontainer
expressed in litres or cubic metres at a temperatureof
15°C.38What is a load of goods(1)Goods on a rail wagon are taken to be
a single load of goods ifthey are—(a)in a
separate freight container or bulk container on therail
wagon; or(b)in a tank on the rail wagon.(2)All goods on a rail wagon that are not
part of a single loadunder subsection (1) are taken to be a
single load of goods.

200239Aggregate quantityTheaggregate quantityof dangerous
goods in a load is thetotal of—(a)the
number of kilograms of solid dangerous goods andaerosols in the load; and(b)the number of litres or kilograms,
whichever is used inthe shipping documentation for the load to
describe thegoods, of liquid dangerous goods in the
load, other thandangerous goods of class 2; and(c)the number of litres that is the total
capacity in litres ofcontainersintheloadcontainingdangerousgoodsofclass 2, other than aerosols.40Packaged dangerous goodsDangerous goods arepackaged
dangerous goodsif—(a)they are
dangerous goods of class 2 in a container with acapacity of not more than 500L; or(b)they are dangerous goods of another
class in a containerwith—(i)a
capacity of not more than 450L; and(ii)a net
mass of not more than 400kg.41Dangerous goods in bulkDangerous goods
in bulkaredangerous goods that are notpackaged dangerous goods.42Placard load(1)Aloadofdangerousgoodsisaplacardloadiftheloadcontains dangerous goods in
bulk.(2)A load of dangerous goods is also
aplacard loadif—(a)the load does not contain dangerous
goods in bulk; and(b)the load is not a consumer commodity
load; and

the load—(i)the load contains dangerous goods of
class 6.2;(ii)the load does not contain dangerous
goods of class6.2,butcontainsdangerousgoodsofclass2.1,otherthanaerosols,orclass2.3,ordangerousgoodsofpackinggroupI,andtheaggregatequantity of
dangerous goods in the load is at least250;(iii)the aggregate
quantity of dangerous goods in theload is at least
1000.43Unit loadDangerous goods
are in aunit loadif the goods are
packageddangerous goods and are—(a)wrapped in plastics, and strapped or
otherwise securedto a pallet or other base and to each other,
for transport;or(b)placedtogetherinaprotectiveoutercontainer,otherthan
a freight container, for transport; or(c)secured together in a sling for
transport.Division 3Kinds of

that—(a)has a capacity of not more
than—(i)forsolidsofpackaginggroupIpackedinacomposite,fibreboard,flexible,woodenorrigidplastics
container—1500L; and(ii)forsolidsofpackaginggroupIpackedinametalcontainer—3000L;
and(iii)forsolidsorliquidsofpackaginggroupsIIandIII—3000L;
and(b)is designed for mechanical handling;
and(c)isresistanttothestressesproducedinusualhandlingand
transport.46Bulk container(1)Abulk containeris an IBC or
another container capable oftransporting
dangerous goods in bulk.(2)However,atankthatispartofarailwagon,isnotabulkcontainer.Division 4Persons with special duties47OwnerA person is
anownerof a rail wagon
if the person—(a)is the sole owner, a joint owner or a
part owner of thewagon; or(b)has
the possession or use of the wagon under a hiringagreement,hire-purchaseagreement,leaseorotheragreement.7IBC is short for intermediate bulk
container.

200248Consignor(1)Apersonconsignsdangerousgoodsorothergoodsfortransport by rail, and is theconsignorof the goods,
if—(a)subsection (2) applies to the person;
or(b)subsection (2) does not apply to the
person or anyoneelse, but subsection (3) applies to the
person; or(c)subsections(2)and(3)donotapplytothepersonoranyone else, but subsection (4) applies to
the person.(2)Thissubsectionappliestoapersonwho,withtheperson’sauthority, is named or otherwise identified
as the consignor ofthe goods in shipping documentation for the
transport of thegoods by rail.(3)This
subsection applies to a person who—(a)engagesarailoperator,eitherdirectlyorthroughanagentorotherintermediary,totransportthegoodsbyrail;
or(b)haspossessionof,orcontrolover,thegoodsimmediately
before the goods are transported by rail; or(c)loads
a rail wagon with the goods, for transport by rail,at a
place—(i)where dangerous goods in bulk are
stored; and(ii)that is not attended during loading by
anyone otherthan the person who loads the goods.(4)This subsection applies to a person
if—(a)the goods are imported into Australia
through a place inQueensland; and(b)the
person is the importer of the goods.49PackerA personpacksdangerous goods
or other goods for transportby rail, and is
apackerof the goods, if
the person—(a)puts the goods in a packaging;
or

rail; or(c)supervises an activity mentioned in
paragraph (a) or (b);or(d)manages or controls an activity mentioned in
paragraphs(a) to (c).50LoaderA personloadsdangerous goods
or other goods for transportby rail, and is
aloaderof the goods, if
the person—(a)loads a rail wagon with the goods for
transport by rail;or(b)loads a bulk
container, freight container, or tank that ispart of a rail
wagon, with the goods for transport by rail;or(c)loadsarailwagonwitha
freightcontainercontainingthe
goods for transport by rail; or(d)supervisesanactivitymentionedinparagraphs(a)to(c); or(e)manages or controls an activity mentioned in
