s1 3 Residential Services (Accommodation) Regulation 2002 Residential Services (Accommodation) Regulation 2002 [reprinted as in force on 23 August 2002] s3 1 Short title This regulation may be cited as the Residential Services (Accommodation) Regulation 2002 . 2 Commencement This regulation commences on 23 August 2002. 3 Standard terms—Act, s 12 A residential service agreement must include terms, consistent with the Act, about 1 (a) the resident’s responsibilities under section 9 of the Act; and (b) the service provider’s responsibilities under section 10 of the Act; and (c) the following matters relating to the house rules for the rental premises— (i) the service provider’s obligations under the Act about giving and displaying copies of the house rules; (ii) how rule changes may be made; and (d) the following matters relating to the rent payable under the agreement— (i) how the rent may be increased; 1 See section 16(4) of the Act for other matters that must be included in the written agreement.
s4 4 s5 Residential Services (Accommodation) Regulation 2002 (ii) what the service provider may do if the resident does not pay the rent when it is due; (iii) provision that the service provider must not require the resident to pay more than 2 weeks rent in advance; and (e) the following matters relating to any rental bond payable under the agreement— (i) the maximum rental bond that may be required; (ii) the obligations under the Act about paying the rental bond to the authority; and (f) the service provider’s and resident’s obligations relating to the preparation and signing of a condition report for the resident’s room; and (g) when the service provider or an agent of the service provider may enter the resident’s room; and (h) how the agreement may be ended; and (i) how the service provider may deal with property left at the rental premises by the resident after the agreement has ended; and (j) the requirement to use approved forms under the Act. 4 Prescribed house rules—Act, s 56 The schedule states the house rules that are prescribed for rental premises. 5 Prescribed amounts relating to lost property—Act, s 91 (1) The amount prescribed for section 91(2) of the Act is $100. (2) The amount prescribed for section 91(5) of the Act is $500.
5 Residential Services (Accommodation) Regulation 2002 Schedule Prescribed house rules section 4 1 Residents’ and guests’ behaviour (1) Residents must not interfere with the reasonable peace, comfort or privacy of other residents. (2) Residents must ensure their guests do not interfere with the reasonable peace, comfort or privacy of other residents. 2 Maintenance of rooms (1) Residents must maintain their rooms— (a) in a way that does not interfere with the reasonable comfort of other residents; and (b) in a condition that does not give rise to a fire or health hazard. (2) Residents must not intentionally or recklessly damage or destroy any part of their rooms or a facility in their rooms. 3 Common areas (1) The service provider must take reasonable steps to ensure the common areas, and facilities provided in the common areas, are kept safe, clean and in good repair. (2) Residents must leave common areas neat, clean and tidy after using them. (3) Residents must ensure their guests leave common areas neat, clean and tidy after using them. (4) Common areas in these premises include (insert description of common areas, eg. lounge or television room, dining room, toilets and bathrooms, kitchen, hallway, patio, yard) .
6 Residential Services (Accommodation) Regulation 2002 Schedule (continued) 4 Guests Residents must ensure their guests are aware of the house rules for these premises. 5 Access to residents’ rooms (1) The service provider must take reasonable steps to ensure residents have quiet enjoyment of their rooms. (2) The service provider must not enter residents’ rooms other than as provided under the Residential Services (Accommodation) Act 2002 . 6 Door locks and keys (1) Residents must not tamper with, or change, a door lock in the premises. (2) Residents must not make copies of keys without the service provider’s permission. 7 Animals Residents must not keep an animal on the premises without the service provider’s permission.
