commences on 23 August 2002.3Standard terms—Act, s 12Aresidentialserviceagreementmustincludeterms,consistent with the Act, about1—(a)the
resident’s responsibilities under section 9 of the Act;and(b)the service
provider’s responsibilities under section 10of the Act;
and(c)the following matters relating to the
house rules for therental premises—(i)theserviceprovider’sobligationsundertheActaboutgivinganddisplayingcopiesofthehouserules;(ii)how
rule changes may be made; and(d)the
following matters relating to the rent payable underthe
agreement—(i)how the rent may be increased;1See section 16(4) of the Act for other
matters that must be included in the writtenagreement.

Regulation2002(ii)whattheserviceprovidermaydoiftheresidentdoes not pay the
rent when it is due;(iii)provision that
the service provider must not requiretheresidenttopaymorethan2weeksrentinadvance; and(e)the
following matters relating to any rental bond payableunder
the agreement—(i)the maximum rental bond that may be
required;(ii)theobligationsundertheActaboutpayingtherental bond to the authority; and(f)the service provider’s and resident’s
obligations relatingto the preparation and signing of a
condition report forthe resident’s room; and(g)whentheserviceprovideroranagentoftheserviceprovider may
enter the resident’s room; and(h)how
the agreement may be ended; and(i)how
the service provider may deal with property left atthe
rental premises by the resident after the agreementhas
ended; and(j)the requirement to use approved forms
under the Act.4Prescribed house rules—Act, s
56Theschedulestatesthehouserulesthatareprescribedforrental premises.5Prescribed amounts relating to lost
property—Act, s 91(1)The amount prescribed for section
91(2) of the Act is $100.(2)The amount
prescribed for section 91(5) of the Act is $500.

rulessection 41Residents’ and guests’ behaviour(1)Residentsmustnotinterferewiththereasonablepeace,comfort or privacy of other
residents.(2)Residents must ensure their guests do
not interfere with thereasonable peace, comfort or privacy
of other residents.2Maintenance of rooms(1)Residents must maintain their
rooms—(a)inawaythatdoesnotinterferewiththereasonablecomfort of other
residents; and(b)in a condition that does not give rise
to a fire or healthhazard.(2)Residentsmustnotintentionallyorrecklesslydamageordestroy any part of their rooms or a
facility in their rooms.3Common
areas(1)The service provider must take
reasonable steps to ensure thecommon areas, and
facilities provided in the common areas,are kept safe,
clean and in good repair.(2)Residents must
leave common areas neat, clean and tidy afterusing
them.(3)Residents must ensure their guests
leave common areas neat,clean and tidy after using
them.(4)Common areas in these premises
include(insert description ofcommonareas,eg.loungeortelevisionroom,diningroom,toilets and bathrooms, kitchen, hallway,
patio, yard).

premises.5Access to residents’ rooms(1)Theserviceprovidermusttakereasonablestepstoensureresidents have
quiet enjoyment of their rooms.(2)Theserviceprovidermustnotenterresidents’roomsotherthanasprovidedundertheResidentialServices(Accommodation) Act 2002.6Door locks and keys(1)Residents must not tamper with, or
change, a door lock in thepremises.(2)Residents must not make copies of keys
without the serviceprovider’s permission.7AnimalsResidents must
not keep an animal on the premises withoutthe service
provider’s permission.
