date, time and place of the incident;(b)details of how the incident happened;(c)ifappropriate,adiagramshowing,tothebestoftheclaimant’s
knowledge, the scene of the incident;(d)the
names, addresses and, if known, telephone numbersof
any witnesses to the incident;(e)thenamesandaddressesand,ifknown,telephonenumbers of any other persons able to provide
relevantparticulars about the incident;(f)ifanemergencyresponseentityoraninvestigativeentity attended
the incident—(i)the name of the entity that attended
the incident;and(ii)if known, the
name of the person who attended theincident on
behalf of the entity; and(iii)theentity’sand,ifknown,theperson’scontactdetails; and(iv)ifknown,anyreferencenumberassignedtotheincident by the entity;(g)the name, address and, if known,
telephone number ofthepersonorpersonswhowere,intheclaimant’sopinion,
responsible for causing the incident;(h)the

for use, the nature ofthe device and whether the injured
person was using thedevice when the incident
happened.(4)Thefollowingparticularsaboutthenatureandtreatmentofthe
injured person’s personal injury are required—(a)a
description of the personal injury suffered, includinghow
the personal injury affects the injured person at thedate
of the notice of claim;(b)if the injured
person was or is hospitalised for treatmentof the personal
injury, details of the hospitalisation;(c)iftheinjuredpersonreceivedorisreceivingmedicaltreatment for
the personal injury, details of the treatmentand the name and
address of the treatment provider;(d)iftheinjuredpersonreceivedorisreceivingrehabilitationforthepersonalinjury,detailsoftherehabilitationandthenameandaddressoftherehabilitation provider;(e)details of any disability suffered by
the injured personfrom the personal injury if—(i)thedisabilityisrelevanttotheassessmentoftheextent of the personal injury;
or(ii)the disability
or its symptoms lasted for 4 weeks ormore;(f)if the personal injury caused by the
incident exacerbatedapre-existinginjuryormedicalcondition,detailsofhowthepersonalinjuryexacerbatedthepre-existinginjury or
condition.(5)Thefollowingparticularsrelevanttoeconomiclossarerequired—(a)the
injured person’s usual occupation and, if the injuredperson is currently employed, the name and
address ofthe person’s employer;(b)details of the injured person’s employment
during the 3yearperiodimmediatelybeforetheincident,andCurrent as at 1 July 2013Page

the injured person’sincome,thenamesofemployers,thedurationofemployment and positions held;(c)theinjuredperson’sgrossincomeperweekwhentheincident happened;(d)fulldetailsofthenatureandextentoftheinjuredperson’s
economic loss, as far as it can be assessed at thedate
of the notice of a claim;(e)detailsofallclaimsmadebytheinjuredpersonfordamages, compensation or social
security benefits for adisability mentioned in subsection
(4)(e);(f)details of all amounts received by the
injured person bywayofdamages,compensationorsocialsecuritybenefits for a disability mentioned in
subsection (4)(e);(g)detailsofallclaimsmadebytheinjuredpersonfordamages,compensationorsocialsecuritybenefitsforanypersonalinjury,illnessordisabilitymentionedinsubsection (6)(d);(h)details of all amounts received by the
injured person fordamages,compensationorsocialsecuritybenefitsforanypersonalinjury,illnessordisabilitymentionedinsubsection (6)(d);(i)whether the injured person planned, before
the incident,tochangeoccupation,workduties,hoursorearningsand if so,
details of the change and the steps the injuredperson took to
implement the change;(j)detailsofanyaccountantusedtopreparetheinjuredperson’s tax or
business records during the 3 year periodimmediately
before the incident, and between the dateof the incident
and the date of the notice of claim.(6)The

claim relates,the date of the first examination;(b)the date the claimant first consulted
a lawyer about thepossibility of making a claim;(c)the name, address and, if known,
telephone number ofanypersontowhomtheclaimanthasdelivered,orintendstodeliver,anoticeofclaiminrelationtothepersonal injury to which the claim
relates;(d)detailsofanypersonalinjury,illnessordisability,inexistenceorsustainedbeforetheincident,thatmayaffecttheextentofthedisabilitiesresultingfromthepersonal injury to which the claim
relates;(e)when the injured person returned to
work or expects toreturn to work.(7)If
the claim is a dependency claim, the following particularsabout the claimant and any dependants are
required—(a)for the claimant—(i)the
claimant’s full name and address; and(ii)theclaimant’srelationshiptotheinjuredperson;and(iii)iftheclaimantwasthespouseoftheinjuredperson—(A)if the claimant and the injured person
weremarried—the date and place of the
marriage;or(B)if the claimant
and the injured person were ina registered
relationship—the date on which,andtheplacewhere,theregisteredrelationship was
registered; or(C)if the claimant and the injured person
weredefactopartners—thedateonwhichtheystartedlivingtogetherinadefactorelationship; andCurrent as at 1

conditionor disability; and(v)the
date the claimant first consulted a lawyer aboutthe
possibility of making a claim;(b)foreachdependant,includingtheclaimantifadependant—(i)the
dependant’s full name and residential address;and(ii)the dependant’s
marital status; and(iii)the dependant’s
date of birth; and(iv)the dependant’s
gender; and(v)the dependant’s relationship to the
injured person;and(vi)whether the
dependant is a full time student; and(vii) ifthedependanthasanindependentincome,theamount and source of the income;
and(viii) ifthedependantreceivedanyfinancialpaymentsor
other benefits from the injured person before theincident, the average amount of the payments
andhow often they were received; and(ix)ifthedependanthasappliedfororreceivedanyfinancial payments or other benefits in
relation tothe incident, the source and amount of the
paymentand how often they were received; and(x)if the dependant suffers from any
serious medicalcondition or disability, the nature of the
conditionor disability.(8)If
the claim is a health care claim, the following particulars
arealso required—(a)adescriptionofthemedicalconditionforwhichtheinjured person sought treatment;Page

have given rise tothe personal injury or to have exacerbated a
pre-existinginjury or condition;(c)thenature,typeandseverityofsymptomsallegedtohave arisen from the treatment;(d)ifapplicable,thenames,addressesand,ifknown,telephonenumbersofallhealthcareproviderswhotreatedtheinjuredpersoninrelationtothemedicalconditionforwhichtreatmentwassoughtduringthethreeyearsbeforereceivingthetreatmentallegedtohave given rise to the personal
injury;(e)iftheinjuredpersonmadeacomplainttotheHealthRightsCommissionundertheHealthRightsCommissionAct1991ortheHealthQualityandComplaints Commission under theHealth Quality andComplaintsCommissionAct2006,aboutapersonalleged to have
caused the personal injury—(i)the
date the complaint was made; and(ii)ifthecomplaintwasfinalisedundertheHealthRights
Commission Act 1991or theHealth
QualityandComplaintsCommissionAct2006,briefdetails of how
the complaint was dealt with undertherelevantActandthedatethecomplaintwasfinalised;(f)if
the claim relates to or includes an alleged failure ofthe
health care provider to inform or adequately informthe
injured person of the risks involved in the treatmentsought—(i)the
date, time and place of each consultation withthehealthcareprovideratwhichinformationofthe
risks should have been given; and(ii)ifwrittenororalinformationorawarningwasgiventotheinjuredpersonbythehealthcareprovider about
the treatment—(A)thedateandplacetheinformationorwarning was given; andCurrent as at 1

2002Part 2 Claims[s 4](B)detailsoftheinformationorwarningincludingwhattheinjuredpersonwasinformed or warned about; and(iii)therisksaboutwhichtheinjuredpersonshouldhave been
informed or adequately informed by thehealth care
provider;(g)ifwrittenororalconsentwasgivenbytheinjuredpersontothehealthcareprovideraboutthetreatmentalleged to have
given rise to the personal injury, the dateand place the
consent was given;(h)the names, addresses and, if known,
telephone numbersofallhealthcareproviderswhoprovidedtheinjuredpersonwithinformationorexplanationsaboutthepersonalinjuryoranexacerbationofapre-existinginjury alleged
to have arisen from the treatment.4Notice of claim—authority for Act, s
9(2)(b)Forsection9(2)(b)oftheAct,therecordsandsourcesofinformation relevant to the claim to which
the person or theperson’s insurer is authorised to have
access are—(a)if the personal injury exacerbated a
pre-existing injuryor condition—(i)anyrecordsinthepossessionofanyinsurerinvolved in the
claim for the pre-existing injury orconditionrelevanttothepre-existinginjuryorcondition; and(ii)any
reports or clinical notes in the possession of ahealthcareproviderwhotreatedorassessedtheinjuredpersonforthepre-existinginjuryorcondition; and(b)recordsinthepossessionofadepartment,agencyorinstrumentalityoftheCommonwealth,theStateoranother State administering police,
transport, taxation orsocialwelfarelawrelevanttoaninvestigationoftheincident alleged to have given rise to

which the claim relates or to assessing economic loss;and(c)reports and
clinical notes in the possession of a hospital,including a
private hospital, at which the injured personreceivedtreatmentrelevanttothepersonalinjurytowhich the claim relates; and(d)recordsinthepossessionofanambulanceorotheremergencyservicethattreatedorassistedtheinjuredperson relevant
to the personal injury to which the claimrelates;
and(e)reportsorclinicalnotesinthepossessionofahealthcare provider
who treated or assessed the injured personrelevanttothepersonalinjurytowhichtheclaimrelates;
and(f)wage, leave and work history records
in the possessionofanemployer(orpreviousemployer)oftheinjuredperson, and if the claim is a dependency
claim, of eachdependant if applicable; and(g)academic records in the possession of
any educationalinstitutionattendedbytheinjuredpersonand,iftheclaim is a
dependency claim, of each dependant.5Notice of claim—documents for Act, s
9(2)(c)(1)For section 9(2)(c) of the Act, part 1
of the notice of a claimmust be accompanied by the following
documents—(a)for a claim, other than a health care
claim, a copy of anycertificatesignedbyadoctorrelevanttothepersonalinjury to which
the claim relates that is in the claimant’spossession;(b)for
a dependency claim, a copy of the injured person’sdeath certificate;(c)for
a health care claim, a copy of any advice or warningsprovided to the injured person by a health
care provideraboutthetreatmentallegedtohavegivenrisetothepersonal injury that is in the

consent providedto the health care provider by the injured
person aboutthe treatment alleged to have given rise to
the personalinjury that is in the claimant’s
possession.(2)For section 9(2)(c) of the Act, part 2
of the notice of a claimmustbeaccompaniedbyacopyofanyotherdocumentrelevanttothepersonalinjury,economicloss,treatmentorrehabilitation that is in the claimant’s
possession.Part 3Miscellaneous6Notice of claim—Act, s 9For section 9(7)
of the Act, the period prescribed is the periodending on the
later of the following days—(a)the
day 1 month after the person receives part 1 of thenotice of claim;(b)the
day 7 days after the person identifies another personagainstwhomaproceedingmightbestartedbytheclaimant based on the claim.7Claimant may add other
respondents—Act, s 14(1)For section
14(1) of the Act, the time prescribed within whichaclaimantmayaddotherrespondentsisthelaterofthefollowing days—(a)the
day by which part 1 of a notice of a claim must begiven by the claimant under section 9(3) of
the Act;(b)the day 1 month after the claimant
receives informationunder section 10(1)(c)(ii) of the
Act;(c)the day 1 month after the claimant
receives a copy of acontribution notice given to the

claim under section 9 of the Act;(b)7
days after the respondent identifies someone else as acontributor.(2)For
section 16(3) of the Act, the time prescribed is 7 days.9Contributor’s response—Act, s
17(1)(a)Forsection17(1)(a)oftheAct,thecontributor’sresponsemust
state the following—(a)the
contributor’s full name;(b)the
contributor’s business address;(c)the
contributor’s postal address;(d)thenameandcontactdetails of the
contributor’s legalrepresentatives, if appointed;(e)the contributor’s ABN, if any;(f)if the contributor is a

advice.’.11Costs when mandatory final offer is
accepted—Act, s 40(1)For section 40 of the Act, if a
mandatory final offer for morethan the lower
offer limit but not more than the upper offerlimit is
accepted, the claimant is entitled to payment of costson
the following bases—(a)100% of item 1
costs;(b)50% of item 5 costs on the basis that
preparations fortrial and a directions conference have been
undertaken;(c)theclaimant’scostoflegalrepresentationatthecompulsoryconference(ifapplicable)attherateof$175
for the first hour and $150 for each hour after thefirst, and, for a period of less than 1
hour, the relevantproportion of the appropriate hourly
rate;(d)the claimant’s costs of an application
