this by-law is to give directions under section50oftheActbyprescribingbehaviourandconductforpersons entering or upon the parliamentary

by-law—authorised officermeans—(a)the Clerk; or(b)aparliamentaryserviceofficeroremployeeholdingappointment in the service as—(i)Sergeant-at-Arms; or(ii)Operations
Manager (Security and Attendants); or(iii)Security Supervisor; or(iv)Parliamentary Security Officer; orCurrent as at 2 August 2002Page

person who, under section 22(1) of the Act,has authority to
exercise or perform a function, power or dutyof the
Clerk.generalsearch,ofaperson,meansasearch,otherthanascanningsearch,ofthepersonandtheperson’sbaggage,conducted—(a)tohelpanauthorisedofficertodecidewhethertheperson or the person’s baggage is
concealing a restricteditem; and(b)in a
way that may include touching the person’s clothesand
examining the contents of the person’s baggage, butthat
is not otherwise personally intrusive.restricted
itemmeans—(a)a
weapon of any type from which an arrow, bullet, shotor
other missile can be discharged; or(b)an
explosive device; or(c)anything else
that could cause, or be used to cause—(i)death or grievous bodily harm to a person;
or(ii)a fire or
explosion; or(iii)damage to
property.scanning search, of a person,
means a search of the personand the person’s
baggage by electronic means, conducted—(a)tohelpanauthorisedofficertodecidewhethertheperson or the person’s baggage is
concealing a restricteditem; and(b)in a

pass(1)An authorised officer may require a
person entering or on theparliamentaryprecincttowearanentrypass,ofatypeapproved by the Clerk, while the person is
on the precinct.(2)A person given a requirement under
subsection (1) must—(a)give the
authorised officer the information, including theperson’s name, address and telephone contact
number,the authorised officer reasonably needs for
issuing theentry pass; and(b)when
the entry pass is given to the person, display theentry pass in the way the authorised officer
reasonablyrequires.(3)Apersonwhoisgivenanentrypassmustreturnittoanauthorised officer when leaving the
parliamentary precinct.5Restricted items
prohibitedA person must not, without the permission of
the Speaker oranauthorisedofficer,bringarestricteditemontotheparliamentary precinct, or have a restricted
item in his or herpossession on the parliamentary

entering the parliamentary precinct must, if requiredbyanauthorisedofficer,allowhimselforherselftobethesubject
of—(a)a scanning search; or(b)a general search; or(c)a scanning search and a general
search.7Leaving item in custody of authorised
officer(1)An authorised officer may require a
person entering or on theparliamentary precinct, or a
particular part of the precinct, toplace in the
temporary custody of an authorised officer, whilethe
person is on the parliamentary precinct or the particularpart
of the precinct—(a)any baggage or bulky object the person
is carrying; or(b)anything else the authorised officer
reasonably considersshould be left in temporary
custody.(2)Withoutlimitingsubsection(1),anauthorisedofficermayrequire a person entering or on the
parliamentary precinct andintending to enter the Legislative
Assembly chamber, or thegalleries of the House, while the
Legislative Assembly is insessiontoplaceinthetemporarycustodyofanauthorisedofficer, while
the person is in the chamber or the galleries—(a)any
baggage or bulky object the person is carrying; or(b)anything else the authorised officer
reasonably considersshould be left in temporary
custody.8Entry to particular areas

the Speaker oranauthorisedofficer,enteranareaoftheparliamentaryprecincttowhichentryisrestrictedtomembersoftheLegislativeAssemblyorofficersoremployeesoftheparliamentary service.Page

permission of the Speaker oranauthorisedofficer,driveorparkavehicleontheparliamentary precinct.(2)A person must not drive or park a
vehicle on an area of theparliamentary precinct in a way
contrary to a notice if—(a)the notice is
located with reasonable prominence at ornear the area;
and(b)theSpeakerortheClerkauthorised,orpurportedlyauthorised, the
placing of the notice.(3)Apersondrivingorparkingavehicleontheparliamentaryprecinct must
comply with any reasonable direction given tothepersonbyanauthorisedofficeraboutthemovementorparking of the vehicle.10Damage to propertyA person must
not vandalise or otherwise damage—(a)a
building forming part of the parliamentary precinct; or(b)otherpropertywithintheparliamentaryprecinctforwhichtheparliamentaryservicehasadministrativeresponsibility.Part 3Supporting administrativeprovisions11Identity card(1)TheClerkmayissueanauthorisedofficerwithanidentitycard, in a form
approved by the Clerk, identifying the personas an authorised
officer under this by-law.(2)An authorised
officer may act under this by-law in relation toa

Supporting administrative provisions[s 11](3)Inactingunderthisby-lawinrelationtoaperson,anauthorised officer must—(a)producetheauthorisedofficer’sidentitycardfortheperson’s
inspection before acting; or(b)have
the authorised officer’s identity card displayed so itis
clearly visible to the person when acting.(4)However, if it is not practicable to comply
with subsection (3),the authorised officer must produce
the identity card for theperson’s inspection at the first
reasonable opportunity.(5)For subsections
(2) to (4)—identity cardmeans—(a)for an authorised officer who is a
parliamentary serviceofficeroremployee—anidentitycardissuedtotheofficer or
employee under subsection (1); or(b)for
an authorised officer who is a police officer—(i)an
identity card issued to the police officer undersubsection (1); or(ii)if
an identity card has not been issued to the policeofficerundersubsection(1)—anidentitycardissuedtothepoliceofficerby,orundertheauthorityof,thecommissionerofthepoliceservice;
or(c)for an authorised officer who is a
security officer—(i)an identity card issued to the
security officer undersubsection (1); or(ii)ifanidentitycardhasnotbeenissuedtothesecurityofficerundersubsection(1)—anidentitycard issued to
the security officer under theStateBuildings Protective Security Act
