major sports facility—Act, s 4Each of the
following is a major sports facility for the Act—(a)Brisbane Cricket Ground;(b)Brisbane Entertainment Centre;(c)Queen Elizabeth II Complex;(d)Sleeman Sports Centre;(e)thefacilitycalled‘SuncorpStadium’(formerlycalled‘SuncorpMetwayStadium’)situatedonthelanddescribed in
schedule 1;(f)Willows Sports Complex, incorporating
Dairy FarmersStadium;(g)Skilled Park;(h)Queensland Tennis Centre situated on the
land describedas lot 7 on survey plan 214201, in the
county of Stanley,parish of Yeerongpilly;(i)Metricon Stadium situated on the land
described as lot 1on survey plan 236810, in the county of
Ward, parish ofGilston.2AMinimum crowd size prescribed for major

described in schedule 1.(2)A special event
is a special event prescribed for section 30Aof the Act if
the special event—(a)is only—(i)for
a major concert—up to the fourth, and no more,major concert in
a calendar year; and(ii)for a religious
event—the only religious event in acalendar year;
and(b)is not a sporting event; and(c)is a special event approved by the
Minister.(3)Forcountingaspecialeventforeithersubparagraphofsubsection (2)(a), a special event is not to
be counted if it hasbeen counted as a special event under
the other subparagraph.(4)It is a
condition on the use of the facility for a special eventprescribed for section 30A of the Act
that—(a)the conditions stated in schedule 2
apply to the use ofthe facility for the event; and(b)theoperatorandtheAuthoritymustensuretherespective conditions for the operator
and the Authorityare complied with.(5)For
this section—operatormeans the person

3(4)(a)1Transport management plan(1)Before the event commences, the
Authority must ensure thatthe operator has prepared, and given
to the chief executive, atransportmanagementplanthatstatestheoperationaltransport
management actions required for the event.(2)Thetransportmanagementplanshouldincludethefollowing—(a)acarparkingschemetopreventintrusionbyeventgenerated car
parking in the area around the facility;(b)a
communications strategy;(c)details of road
and street closures;(d)details of
train, bus, and coach services;(e)coach, taxi, limousine and private vehicle
parking andset-down areas;(f)pedestrian and traffic controls;(g)emergency services;(h)access,parking,loadingandunloadingoftrucksandsemi-trailers;(i)parking arrangements for the set-up of the
event;(j)promotion,including,ifapplicable,acombinedticketing system
for public transport and event entry;(k)access for disabled persons.(3)Theoperatormustgiveacopyoftheproposedtransportmanagement plan for comment to—(a)the transport coordination group for

operator must arrange for the regulation of the traffic areaaroundthefacilitytobecarriedoutbytheBrisbaneCityCouncil under
its relevant local law.2Operational
management plan(1)Before the event commences, the
Authority must ensure thatthe operator has prepared, and given
to the chief executive, anoperational management plan.(2)The operational management plan
should—(a)identifypotentialadverseimpactsoftheuseofthefacilityfortheeventanddetailthemeasurestobeadopted to mitigate and manage the
identified potentialadverse impacts; and(b)state how the operator intends to
address the followingmatters—(i)noisecontrols,andmanagementmeasurestobeimplementedtoreducenoiseimpacts,including,crowdnoise,noisefrompublicaddresssystems,noise from speakers and amplifiers, building
worksnoiseandthestartingoflongdistancecoachmotors;(ii)monitoringandreportingbackgroundandeventnoise levels at
the locations stated in section 7(1);(iii)locationofpolicepresenceonandaroundthefacility;(iv)emergency and evacuation procedures;(v)publiccomplaintresponseandresolutionsystemand
procedures; and(c)state the strategies and actions to
appropriately minimisepotential adverse impacts from—(i)rehearsals, sound and light testing,
and any otherancillary activities; andCurrent as at 1 January 2012Page

associated with the event; and(iii)entertainment activities associated with the
event,including,forexample,fireworks,helicopters,blimps and
public address systems; and(d)state the strategies and actions to
appropriately manageand control—(i)crowd behaviour before, during and after the
eventincluding,forexample,acodeofbehaviour,evictionsandarrestspolicy,closedcircuittelevisionsurveillanceand astrategyforthesaleand use of
alcohol; and(ii)crowd behaviour
after the event to ensure it doesnotadverselyaffecttheamenityofsurroundingresidential
areas or cause a public nuisance; and(iii)pedestrianandvehicularmovementsbeforeandafter the event; and(iv)pedestrian use of pedestrian walkways,
rather thansurrounding residential areas, and public
transport;and(e)state the
strategies and actions to appropriately minimisepotentialadverseimpactsontheoperationofChristChurch and
Rectory and Castlemaine Drain.(3)A
copy of the proposed operational management plan must begiventothestadiummanagementadvisorycommitteeforcomment.3LightingTheoperatormustensurethatthetechnicalparameters,design,
installation, operation and maintenance of field, eventandoutdoorlighting,forexample,strobelighting,complywithAS4282-1997ControloftheObtrusiveEffectsofOutdoor Lighting.Page 8Current as at 1 January 2012

must ensure that—(a)allbuildingworkfortheeventcomplieswiththeStandard Building Regulation 1993;
and(b)there is a stage and seating plan
providing for access inthe case of emergency—(i)that is given to the chief executive;
and(ii)that is complied
with at all times.5Operating hours(1)The
operator must ensure that the part of the event that is arehearsal or a sound test—(a)only occurs between 10:00a.m. and
8:00p.m.; and(b)ifaudiblebeyondthefacility—iskepttoanabsoluteminimum, and does not exceed 3 hours from
the time itcommences on any day.(2)The
operator must ensure that—(a)the part of the
event other than a rehearsal or a soundtest only occurs
between 10:00a.m. and 10:30p.m; and(b)the
stadium is closed to the public by 11:30p.m.6Notification(1)The
Authority must take all reasonable and practical measurestoensurethatoccupiersoflandwhoarelikelytobesignificantlyimpactedbytheevent,includingoccupiersoflandintheLangParkTrafficArea,aregivenatleast20business days written notice of the event,
including times forsound tests and rehearsals.(2)The notice must be given by letterbox
drop and must state—(a)the nature of
the event; and(b)the hours of operation for the event;

complaints; and(d)the transport and parking arrangements
for the event.7Noise(1)Duringtheevent,includingrehearsalsandsoundtests,theoperatormustensurethatnoiselevelsfromtheeventarecontinuouslymonitoredbyasuitablyqualifiedacousticalconsultantat,orasnearaspracticableto,thefollowinglocations—(a)8.5

Street, Paddington;(c)105 Hale Street, City;(d)26 Princess Street, City;(e)31 Isaac Street, Milton.(2)Theoperatormustensurethenoiselevelfromtheevent,including
rehearsals and sound tests, is equal to or less than atleast 1 of the following—(a)100dB(A)Leq,measuredat15minuteintervals,measuredatapoint50mdirectlyinfrontofthefrontedge of the
performance stage;(b)70dB(A)Leq,measuredat15minuteintervals,measured at the
locations mentioned in subsection (1).(3)To
remove any doubt, it is declared that the operator complieswith
subsection (2) even if the level measured is greater than 1of
the levels stated in the subsection.(4)TheoperatormustensurethetakingofthenoisemeasurementscomplieswiththeEnvironmentalProtectionAgency’s Noise
Measurement Manual.(5)Duringtheevent,includingrehearsalsandsoundtests,theAuthority must ensure that 1 of its
employees or its agent—(a)is present at
the sound mixing desk for the event and isable to exercise
ultimate control on the noise levels fromthe sound

of the acousticalconsultantsconductingthemonitoringofthenoiselevels from the
event.(6)In this section—Leq,foraparticulartimeinterval,meansthetimeaverageA-weighted sound pressure level, within the
meaning given byAS 1055, for the interval.8Report(1)Theoperatormust,within20businessdaysaftertheevent,give the chief
executive a report giving—(a)detailsabouttheeventthechiefexecutivereasonablyrequires;
and(b)asummaryofthenumber,locationandtypeofanycomplaints received; and(c)detailsofanyactiontakenbytheAuthorityregardingany complaints;
and(d)detailsofanyremedialactiontobetakenatfutureevents.(2)Theoperatormustalso,within20businessdaysaftertheevent,givethechiefexecutiveareportbyanaccreditedacoustical
consultant containing the following—(a)the
starting and completion time of any part of the event,including rehearsals and sound tests;(b)details of noise measurements taken
for the event;(c)the times and locations, shown on a
plan, at which thenoise measurements were taken;(d)details of the equipment and methods
used to take themeasurements;(e)anyotherinformationrelevanttotheconsiderationofthe
