Chiropractors Registration Regulation 2002 Part 1 Preliminary [s 1] Chiropractors Registration Regulation 2002 [as amended by all amendments that commenced on or before 23 April 2010] Part 1 Preliminary 1 Short title This regulation may be cited as the Chiropractors Registration Regulation 2002 . 2 Commencement This regulation commences on 1 May 2002. Part 2 Registration 3 Qualifications for general registration—Act, s 44 (1) For section 44(1)(a) of the Act, a qualification stated in schedule 1, column 1, and conferred or awarded by the educational institution stated in column 2 for the qualification, is a qualification for general registration. (2) However, each of the following qualifications conferred or awarded by the Royal Melbourne Institute of Technology (the institute ) is a qualification for general registration only if the course for which the qualification is conferred or awarded is undertaken as an internal student at the institute’s Bundoora campus— Bachelor of Applied Science (Clinical Science) Bachelor of Chiropractic Science Reprint 3B effective 23 April 2010 Page 3
Chiropractors Registration Regulation 2002 Part 2 Registration [s 4] Bachelor of Applied Science (Complementary Medicine) Master of Clinical Chiropractic. 4 Period of registration—Act, s 56 (1) For section 56(1) of the Act, the general registration period is a financial year. (2) However, the general registration period for the financial year beginning on 1 July 2009 ends at the end of 1 July 2010. (3) After 1 July 2010, the general registration period is the period beginning on 2 July 2010 and ending on 30 November 2010. 5 Notification of change in circumstances—Act, s 119 For section 119 of the Act, each of the following is a change in a registrant’s circumstances of which the board must be advised— (a) a change in the registrant’s name; (b) a change in the registrant’s address; (c) for a special purpose registrant—a change in the way the registrant undertakes the special activity for which the registrant is registered; Examples of a change for paragraph (c) 1 a registrant undertakes the activity at a different place 2 a registrant changes the amount of time spent doing the activity 3 a registrant ceases to do the activity (d) the registrant ceases to be qualified for registration. Part 3 Fees Chiropractors Registration Regulation 2002 Part 3 Fees [s 6] 6 Fees The fees payable under the Act are stated in schedule 2. 7 Waiver of fee—financial hardship The board may waive, wholly or partly, the payment of a fee by a person if the board is satisfied payment of the fee would cause the person financial hardship. 8 Refund of registration fee (1) The board must refund the registration fee accompanying a person’s application for registration, or renewal of registration, if— (a) the board refuses to grant the application; or (b) the person withdraws the application before it is decided. (2) Subsection (3) applies if, within 3 months after the board decides to register a person or renew a person’s registration, the person surrenders the registration. (3) The board must refund the registration fee paid by the person less the amount of the registration fee stated in schedule 2 for a period of registration of not more than 3 months. Part 4 Transitional provision 10 Qualifications for existing registrations—Act, s 227 For section 227(2)(b) of the Act, each of the following qualifications is prescribed— Reprint 3B effective 23 April 2010 Page 5
Chiropractors Registration Regulation 2002 Part 4 Transitional provision [s 10] (a) a qualification stated in schedule 3, column 1, and conferred or awarded by the educational institution stated in column 2 for the qualification; (b) Doctor of Philosophy in Natural Science conferred or awarded in 1976 by the Anglo–American Institute of Drugless Therapy (England) if the holder of the qualification was— (i) immediately before the commencement day, registered under the repealed Act; and (ii) registered on the basis that the person was registered under the Chiropractors and Osteopaths Act 1979 , section 18(1)(c) as in force immediately before the commencement of the Chiropractic Manipulative Therapists Act Amendment Act 1988 , section 9.
