Grant Regulation 2000[as amended by all amendments that
commenced on or before 12 February 2010]1Short
titleThis regulation may be cited as theFirst Home Owner GrantRegulation
2000.2CommencementThis regulation
commences on 1 July 2000.3Declaration of
relevant interests—Act, s 8(1)Eachofthefollowinginterestsisdeclaredtobearelevantinterest for section 8(1)(i) of the
Act—(a)aperson’sright,givenbyarelativeoftheperson,tooccupy a home that is a detached
dwelling built or to bebuiltonlandthatisapartoflandownedbytherelative—(i)under
a contract entered into by the person; or(ii)by an
owner builder;(b)aperson’srighttooccupyamobilehomeunderarelevant agreement;(c)amanufacturedhomeowner’sinterestinasiteagreement for a site on which a manufactured
home ispositioned;(d)a
sublessee’s interest under a lease mentioned in section8(1)(d) of the Act that is for a term of at
least 10 years;(e)an interest in a lease granted
under—(i)theAboriginal Land
Act 1991, section 40D(1)(a);or(ii)theTorresStraitIslanderLandAct1991, section37D(1)(a).

7.(2)The interest is a relevant
interest—(a)foraninterestmentionedinsubsection(1)(a)—intheland on which the home is built;
and(b)foraninterestmentionedinsubsection(1)(b)—intheland on which the mobile home is
situated; and(c)foraninterestmentionedinsubsection(1)(c)—intheland on which the manufactured home is
positioned.(3)In this section—manufacturedhomeseetheManufacturedHomes(Residential Parks) Act 2003,
schedule 2.manufactured home ownermeans a home
owner under theManufactured Homes (Residential Parks) Act
2003, section 8.mobilehomeseetherepealedMobileHomesAct1989,section 3.relative, of a person,
means—(a)a parent, grandparent, child,
stepchild, brother or sisterof the person or
the person’s spouse; or(b)the spouse of
anyone mentioned in paragraph (a).relevant
agreementsee the repealedMobile Homes Act
1989,section 3.siteseetheManufacturedHomes(ResidentialParks)Act2003, section
13.siteagreementseetheManufacturedHomes(ResidentialParks) Act
2003, section 14.sublesseeincludes a sub-sublessee.4Persons who are not interested
persons—Act, s 17(2)(1)If a person is the holder of arelevant interest mentioned insection 3(1) (thefirst
interest), the holder of another relevantinterest in the land in which the person has
the first interest isnot an interested person for section
17(2) of the Act.

Home Owner Grant Regulation 2000(2)Thehousingchiefexecutiveisnotaninterestedpersonforsection 17(2) of the Act if, under the
scheme operated by thedepartmentknownasthe‘PathwaysSharedEquityLoanscheme’—(a)the
housing chief executive holds, or will hold, not morethan
40% of the estate in fee simple in the land on whichthe
relevant home is built; and(b)the eligible
transaction to which the application relatesis financed by
the department; and(c)the applicant is a tenant of the
relevant home.(3)Subsection (2) applies only to an
application made on or after1 February
2008.(4)In this section—departmentmeansthedepartmentthatadministerstheHousing Act 2003.housingchiefexecutivemeansthechiefexecutiveofthedepartment that
administers theHousing Act 2003.5Methods of paymentAn amount payable
to the commissioner under the Act mustbe paid by bank
draft, cash or cheque.6Interest payable
on instalment payments(1)Thissectionappliestoanarrangementforpaymentbyinstalments of a liability outstanding under
section 48 of theAct.(2)Ifthearrangementincludesprovisionforthepaymentofinterest, the interest is payable at an
annual rate equal to thesum of the bank bill yield rate,
rounded to the nearest seconddecimal place,
and 8%.(3)In this section—

rate, for a particular day, means the
monthlyaverage yield for 90-day bank accepted bills
published by theReserveBankofAustraliaforthemonthofMayinthefinancialyearimmediatelyprecedingthefinancialyearinwhich the day occurs.17Relevant interest
for s 3(1)(e)An interest mentioned in section 3(1)(e) is
taken to have beena relevant interest on and from 18 July
