Diversion) Regulation 2000.2CommencementThis regulation
commences on the day the Act, section 43,1commences.3Who
is aneligiblepersonFortheAct,section6(1)(d),thepersonmustbechargedbefore a pilot
program court specified in schedule 1, column 1and reside in a
location with a postcode specified in schedule1, column 2 for
the pilot program court.4Relevant
offencesFortheAct,section8(1)(d),anoffenceagainstanyoftheprovisionsoftheCriminalCodespecifiedinschedule2punishable by a term of not more than 7
years imprisonment isa relevant offence.5Prescribed drug offencesFortheAct,schedule,definitionprescribeddrugoffence,paragraph (b), an offence against any of the
provisions of theDrugs Misuse Act 1986specified in
schedule 3 is a prescribeddrug offence.1The

offender needsdetoxificationIn deciding
whether to delay commencement of a suspendedsentence under
the Act, section 21, a pilot program magistratewho considers
that the offender requires detoxification, at atimewhenadetoxificationfacilityisnotimmediatelyavailable—(a)must take into account—(i)whetheraprisonfacilitycanprovidealternativeaccommodationtothewatch-housewheretheoffender is being detained; and(ii)ifaprisonfacilityisnotavailable,whetherthewatch-housecanprovidesuitabledetoxificationtreatment;
and(b)must also apply the criteria, for the
minimum standardfor facilities and rehabilitation programs,
decided by theChief Magistrate under section 9(2).7Who is aprescribedpersonFor the Act,
section 39(5), definitionprescribedperson,
thepersons specified in schedule 4 are
prescribed.8Pilot program courtsFortheAct,section9(1),MagistratesCourtsatBeenleigh,Cairns, Ipswich,
Southport and Townsville are declared to bepilot program
courts.

rehabilitationordersFortheAct,sections15(2)(c)and19(g),2themaximumnumberofactiveintensivedrugrehabilitationordersisasfollows—(a)for the Magistrates Court at
Cairns—40;(b)for the Magistrates Court at
Townsville—40;(c)fortheMagistratesCourtsatBeenleigh,IpswichandSouthport—a total of 141.8BGuidelines for Magistrates Courts at
Cairns andTownsville—Act, s 43(3)GuidelinesfortheMagistratesCourtsatCairnsandTownsville are in schedule 5.9Guidelines for facilities for the
supervision and control ofoffenders(1)FortheAct,section19(h),thefollowingguidelinesareprescribed—(a)the
entity providing the facilities is willing to accept theoffender;(b)it is
reasonably likely that the facilities will be availableto
the offender when they are needed;(c)the
facilities are of a suitable standard;(d)thecorrectiveservices’chiefexecutivehasreceivedadvice about the
treatment proposed to be provided totheoffenderatthefacilityandissatisfiedthatthetreatment is appropriate.(2)TheChiefMagistrate,inconsultationwithapilotprogrammagistrate,maydevelopapolicyfordecidingwhetherafacility is of a suitable

pilot programmagistrateFor the Act,
section 39, information given to a pilot programmagistrate by a prescribed person—(a)may be given to the magistrate by
giving it to the clerkof the court of the relevant pilot
program court or to thepersonappointedasthecourtcoordinatorforpilotprogram courts by
the chief executive—(i)personally; or(ii)byuseofafacsimileorotherelectronictransmission; and(b)if
provided otherwise than in writing, must be confirmedinwritingwithin24hours,unlessthemagistrateconsiders it
unnecessary.11Transitional provision for Drug
Rehabilitation (CourtDiversion) Amendment Regulation (No.
2) 2002Schedule1,3asinforceimmediatelybeforethecommencement of this section,
continues to apply in relationto a person for
an offence if—(a)the person was referred for assessment
for the offenceunder the Act, section 164before the commencement ofthis
section; or(b)an intensive drug rehabilitation order
was made for theperson for the offence under the Act,
section 195beforethe commencement

MagistratesCourts at Cairns andTownsvillesection 8B1Frequency of court reviews(1)Themaximumfrequencyofattendancesrequiredbeforeapilot
program magistrate of an offender subject to an intensivedrug
rehabilitation order, whether the attendances are orderedbyapilotprogrammagistrateordirectedbyanauthorisedcorrective
services officer, is once in any 30 day period.(2)However, a pilot program magistrate may
order more frequentorlessfrequentattendancesifthemagistrateconsidersthatthere are special
circumstances.Example—If
the offender returns a positive drug test, a pilot program
magistratemay order the offender to attend weekly for
a month to assess whetherthe offender is satisfactorily
complying with the offender’s intensivedrug
rehabilitation order.(3)Also,anauthorisedcorrectiveservicesofficermaydirectmore frequent
attendances if—(a)the officer alleges that the offender
is not satisfactorilycomplyingwiththeoffender’sintensivedrugrehabilitation order; or(b)there has been a change in the
offender’s circumstancesthat requires the offender’s
rehabilitation program to bereviewed.Example of an allegation for paragraph
(a)—anallegationbasedonapositivedrugtestreturnedbytheoffenderExample of
change in circumstances for paragraph (b)—the
offender’s eviction from accommodation

material the magistratewishes to have produced at the
review.(2)The pilot program magistrate may give
notice to an interestedentity asking that a person acting for
the entity attend before apilot program magistrate for the court
review, including anypreliminary hearing.(3)The magistrate may allow a person,
other than a member ofthedrugcourtteam,toparticipateinthecourtreview,including any preliminary hearing.(4)In this section—courtreviewmeansanattendancerequiredbeforeapilotprogram
magistrate of an offender subject to an intensive drugrehabilitation order.drug court
teammeans the persons attending a court
review,including any preliminary hearing, who act
for an interestedentitygivennoticebyapilotprogrammagistrateundersubsection (2) in relation to the court
review.interested entitymeans any of the
following—•Legal Aid (Queensland)•the Queensland Police Service•thedepartmentinwhichtheCorrectiveServicesAct2000is
administered•thedepartmentinwhichtheHealthAct1937isadministered.3Treatment team(1)The
persons mentioned in schedule 4, item 1(1)(aa) or (e) (thetreatment team) are responsible
for—(a)assessing an offender’s compliance
with the offender’sintensivedrugrehabilitationorder,includingthe

and(b)providing support, treatment and
assistance relevant tothe order, as required by the
offender.(2)Thetreatmentteammust,unlesstherearespecialcircumstances,
give any document to be used at a court reviewin relation to
the offender to a member of the proposed drugcourt team at
least 2 days before the review.4Frequency of drug testingThemaximumfrequencyofdrugtestingofanoffendersubject to an intensive drug rehabilitation
order is 5 times inany 2 week period.
