section applies to an employee’s membership in the basicaccumulation,comprehensiveaccumulationorQASaccumulation category.(2)Amounts held for the employee in the
scheme must be appliedtowardsprescribedinsurancefortheemployeeunderthedeed, unless the employee elects,
under the deed, not to havethe insurance.(3)In
this section—prescribed insurancemeans—(a)for a non-casual employee whose
membership is in theQASaccumulationcategory—long-termsalaryprotection insurance and insurance in case
of death; or(b)foranothernon-casualemployee—incomeprotectioninsuranceandinsuranceincaseofdeathortotalandpermanent disablement; or(c)for a casual employee whose membership
is in the QASaccumulation category—insurance in case of
death; or(d)for another casual employee—insurance

2General eligibility provisions7Eligibility generally(1)ThissectionappliestoaunitoftheStatepublicsectormentioned in the
schedule.(2)The schedule states the
following—(a)theemployeesoftheunitwhoareeligibleformembership of the scheme;(b)for each of the employees—(i)whethermembershipiscompulsoryordiscretionary; and

eligible; and(iii)any conditions
applying to membership.(3)This section
applies subject to sections 8 to 9A and 14.8Minimum employment requirements for
eligibilityAnemployeementionedinthescheduleisineligibleformembership of the scheme for particular
employment unlessthe employee—(a)receivesayearlysalaryfortheemploymentthatisatleast
50% of the tax-free threshold for taxation purposesunder
theIncome Tax Assessment Act 1936(Cwlth); or(b)receivesasalaryofatleast$450amonthfortheemployment.8ADiscretionary membership(1)This
section applies to a person who is an employee of a unitof
the State public sector and for whom membership of thescheme is, under the schedule,
discretionary.(2)The person may, at any time while the
person is an employeeoftheunitoftheStatepublicsector,decidetobecomeamember of the scheme.(3)If
the person decides to become a member of the scheme, theperson must, while the person continues to
be an employee ofthe unit of the State public sector,
continue to be a member ofthe scheme.9ARestriction for eligibility in QAS
accumulation categoryIfamemberintheQASaccumulationcategorybecomesamemberinanothercategory,thememberisineligibleformembership in the QAS accumulation
category.10Spouse, entitled former spouse and
other persons(1)This section applies to a person in
the person’s capacity as—

of the scheme.(4)Membership by the person is
discretionary.(5)Thepersoniseligibleformembershipinthebasicaccumulation
category.(6)In this section—entitledformerspousemeansapersonwhoisentitledorconditionally entitled, under an agreement
under theFamilyLawAct1975(Cwlth)oracourtorderunderthatAct,topayment of an amount from the fund.Part

agreed to contribute as the person’semployer;(b)a person who—(i)isemployedunderacontractwithaunitoftheState public sector that is entirely
or mainly for theperson’s labour; and(ii)is a
member of a superannuation scheme approvedby the Minister
under subsection (2);(c)a person
who—(i)is employed by a unit of the State
public sector in,ortoperformthedutiesof,anofficeorotherposition under a
law of the State; and(ii)is a member of a
superannuation scheme approvedby the Minister
under subsection (2);(d)an employee of a
prescribed university who—(i)becameamemberoftheschemebetween1January 1991 and 30 June 1991;
and(ii)between1July1991and31December1991,elected to become a member of the
SuperannuationScheme for Australian Universities;(e)an employee of a prescribed university
who—(i)startedtheemploymentonorafter1July1991;and(ii)isnot,onthecommencementofthissection,amember of the scheme for the
employment;(f)a person who—(i)between 1 January 1991 and 31 December
1991,became a member of the scheme; and(ii)on1January1992,wasanemployeeofGriffithUniversity;

members(1)A person who, on 30 April 2000, was a
member in the formeraccumulation category for particular
employment, is eligibleformembershipinthebasicaccumulationcategoryfortheemployment.(2)The
eligibility under subsection (1) stops if the person stopsbeingamemberinthebasicaccumulationcategoryfortheemployment.(3)Thissectiondoesnotlimitthemembershipcategoriesforwhich the member is eligible under the
schedule.(4)In this section—former
accumulation categorymeans the category, under thename
‘accumulation member’, established by the deed as inforce
on 30 April 2000.Division 3Retrospective
eligibility17AMatters relating to retrospective
eligibility(1)This section applies to a person
mentioned in column 6 of theschedule who was
employed before the declaration day by theunitoftheStatepublicsectormentionedoppositeintheschedule.(2)The person is taken to have been
eligible for membership ofthe scheme for the period of the
person’s employment, beforethedeclarationday,statedincolumn6(theretrospectiveeligibility
period).(3)The person’s
eligibility for the retrospective eligibility periodistakentobetheeligibilitystatedintheschedule,onthedeclaration day,
for the equivalent employment.(4)However—(a)despitetheschedule,theperson’smembershipfortheretrospective
eligibility period is discretionary; and
