and Resources TribunalRules 2000.2DefinitionIn these
rules—approved formmeans a form
approved under rule 10.3Starting
proceeding before tribunal(1)Aproceedingbeforethetribunalisstartedbyapplication,unless an Act
specifies a different procedure for starting theproceeding.(2)The
application must—(a)be in the approved form; and(b)includeastatementoftherelevantfactsandcircumstances supporting the
application; and(c)be filed in the tribunal.(3)The applicant must serve the
application on each respondentwithin 14 days
after it is filed.(4)Despitesubrule(2),thepresidentmay,ifthepresidentconsidersitappropriate,allowanapplicationstartingaproceeding to be made orally, but only
if—(a)the application seeks urgent relief;
and(b)theapplicantundertakestofileawrittenapplicationwithin the time
directed by the president.

proceeding(1)Arespondenttoanapplicationstartingaproceedingwhowishestoappearintheproceedingmustfileawrittenresponse to the
application within 14 days after service of theapplication on
the respondent.(2)The response must be in the approved
form.(3)Therespondentmustserveacopyoftheresponseoneachother party to
the proceeding within 14 days after filing theresponse, unless
the tribunal otherwise directs.5Directions hearing(1)Theregistrar,onthefilingofanapplicationstartingaproceeding—(a)may
fix a time, day and place for a directions hearing;and(b)unlessapracticedirectionotherwiseprovides,mayrequiretheparties,withinthetimefixedbytheregistrar—(i)to
deliver to each other party a copy of the ordersand
directions the party would like the tribunal tomake or give;
and(ii)toconferwithaviewtoagreeing,asfaraspracticable,ontheordersanddirectionsthetribunal should be asked to make or
give.(2)At a directions hearing, the tribunal
may make any orders andgive any directions about the conduct
of the proceedings thatthe tribunal considers
appropriate.(3)Withoutlimitingsubrule(2),thetribunalmaymakeanyordersandgiveanydirectionsaboutanyofthefollowingmatters—(a)the need for, and extent of—(i)disclosure and interrogatories;
or(ii)inspection of
property;(b)including other persons as
parties;(c)the way and adequacy of
service;

and where a proceeding is to be heard and how thehearing will be conducted, including whether
a view isrequired;(e)evidence, including expert evidence.(4)Thisruledoesnotpreventthepresident,ifthepresidentconsiders it
appropriate, from fixing a time, day and place forhearinganapplicationwithoutadirectionshearingbeingheld.6Application in a proceeding(1)Unlessthetribunalotherwisedirects,anapplicationinaproceeding—(a)must
be in the approved form; and(b)may
be supported by affidavit; and(c)must
be filed in the tribunal.(2)The applicant
must serve the application and any supportingaffidavit on
each other party to the proceeding at least 3 daysbeforethedayfixedforhearingtheapplication,unlessthetribunal otherwise directs.(3)Despitesubrule(1),thepresidentmay,ifthepresidentconsiders it appropriate, allow an
application in a proceedingto be made
orally, but only if—(a)the application
seeks urgent relief; and(b)theapplicantundertakestofileawrittenapplicationwithin the time
directed by the president.7Steps before
hearing application in a proceedingBeforeanapplicationinaproceeding,otherthananurgentapplication, is
heard, the parties to the proceeding must conferwith
a view to agreeing, as far as practicable, on the ordersand
directions the tribunal should be asked to make or give onthe
application.

president may make practice directions, not inconsistentwith
the Act, for the tribunal.(2)A practice
direction made under subrule (1) applies subject toa
direction given under section 49(4)1of
the Act.9Procedure for attendance of
witnesses(1)A person may be notified to attend as
a witness at a tribunalhearing by a subpoena.(2)TheUniform Civil
Procedure Rules 1999, chapter 11, part 42applies, with necessary changes, in
relation to the subpoena.310Approval of formsThe president
