ListFor section 13AA(4)(a) of the Act, a person
is ineligible tohavetheperson’snameenteredintheSpecialNeedsChildren’sAdoptionListunlessthepersonsatisfiesthefollowing requirements—(a)the person must be resident or
domiciled in Queensland;(b)the person must
be an Australian citizen or married to anAustralian
citizen;(c)thepersonmustnotbesufferingfromaphysicalormental condition, or have a physical or
mental disability,toanextentthatthepersoncouldnotprovideahighlevel of stable, long-term care for a
child.6Relative Children’s Adoption
ListFor section 13AA(4)(a) of the Act, a person
is ineligible tohavetheperson’snameenteredintheRelativeChildren’sAdoptionListunlessthepersonsatisfiesthefollowingrequirements—(a)the
person must be resident or domiciled in Queensland;(b)the person must be an Australian
citizen or married to anAustralian citizen;(c)the person must have been married for
at least the past 2years;(d)the
person must have custody of the child in relation towhomthepersonhasappliedtobecomeanadoptiveparent.7Expression of interest register and
assessmentregister—non-resident children(1)Subsection (2) applies to a person
whose name is entered intheexpressionofinterestregisterandwhoseexpressionofinterest relates to a non-resident

person is ineligible tohave the person’s name entered in the
expression of interestregisterunlessthepersonsatisfiesthefollowingrequirements—(a)the
person must be resident or domiciled in Queensland;(b)the person must be an Australian
citizen or married to anAustralian citizen;(c)thepersonmustnotbesufferingfromaphysicalormental condition, or have a physical or
mental disability,toanextentthatthepersoncouldnotprovideahighlevel of stable, long-term care for a
child;(d)the person must have been married for
at least the past 2years;(e)there
must not be more than 4 children in the custody ofthe

order under s 12(3)of the Act(1)Thissectionappliestoapersonseekinganadoptionordermentioned in section 12(3) of the
Act.(2)Iftheperson’snameisenteredintheRelativeChildren’sAdoption List, the requirement mentioned in
section 6(c) doesnot apply to the person.(3)Subsections (5) and (6) apply if the
person’s name is enteredintheexpressionofinterestregisterandtheperson’sexpression of interest relates to a
non-resident child.(4)Subsections (5) and (6) also apply
if—(a)the person has, in response to an
invitation, expressedinterest in being assessed as suitable

child.(8)Subsections (9) and (10) also apply
if—(a)the person has, in response to an
invitation, expressedinterest in being assessed as suitable
to be a prospectiveadopter in relation to a child, other
than—(i)a child of whom the person is a
relative; or(ii)a non-resident child; or(iii)a special needs
child; and(b)the person’s name is entered in the
assessment register.(9)Therequirementsmentionedinsection7A(2)(e)and(f)donot
apply to the person.(10)In addition to satisfying the other
requirements mentioned insection 7A(2)(a) to (d), the person
must not have more than 1child in the person’s custody.Part

person named in an adoption list or the expression ofinterest register, the chief executive must

3 Assessment[s 11](a)ifthepersonismarried—thequalityofthemarriage,including its stability;(b)theperson’scapacitytobeanadoptiveparent,including—(i)the
person’s emotional capacity and other personalqualities;
and(ii)the person’s financial stability and
other financialcapacity; and(iii)the
person’s capacity to ensure a child’s safety andwellbeing; and(iv)any
other matter relevant to the person’s capacitytoprovideforachild’semotional,physical,educational,
recreational and social needs;(c)the
person’s attitudes to, and understanding of—(i)childrenandtheirphysicalandemotionaldevelopment;
and(ii)the responsibilities and duties of
parenthood; and(iii)the issues
relevant to adoptive parenting, includingissuesaboutinformingachildofhisorheradoption; and(iv)thesignificanceofanadoptedchild’snaturalparents and their
families;(d)if the person’s application to become
an adoptive parent,or expression of interest, relates to a
child of a particularindigenous, ethnic or cultural
background—the person’sabilityandwillingnesstounderstandthechild’sbackgroundandtodevelopormaintainthechild’sindigenous,
ethnic or cultural identity;(e)theextentoftheperson’sparticipationineducationalprograms relevant
to adoption, including any programsconducted by the

Assessment[s 13]13Persons named in the Relative Children’s
Adoption ListFor a person named in the Relative
Children’s Adoption List,the chief executive must have regard
to the following mattersrelating to the child in relation to
whom the person has appliedto become an adoptive parent—(a)the nature of the person’s
relationship with the child;(b)the
circumstances in which the person obtained custodyof
the child;(c)the likely effect on the child of
separating the child froma parent, sibling or other person with
whom the child is,or has been, living;(d)if
there is a natural parent who does not have custody ofthechild—theparent’sviewsonthemakingofanadoption order in favour of the
person, so far as the chiefexecutive is reasonably able to obtain
those views.14Persons named in the expression of
interest register(1)This section applies to a person named
in the expression ofinterest register.(2)If
the person’s expression of interest relates to a
non-residentchild residing in a particular country, the
chief executive musthave regard to the following matters—(a)theperson’sunderstandingof,andinterestin,thecountry and its culture;(b)if an adoptive child from the country
were placed withthe person, the person’s ability and
willingness—(i)tocontinuetolearnaboutthecountryanditsculture; and(ii)tohelpthechildlearnaboutthecountryanditsculture.(3)If
the person’s expression of interest relates to a child,
otherthan a child of whom the person is a
relative, or a non-residentor special needs child, the chief

adjustment to, and acceptance of, the infertility ofthe
person or the person’s spouse.(4)In
having regard to the matters mentioned in subsection (3),the
chief executive must have regard to whether the infertileperson is pursuing fertility
treatment.Part 4Procedural
mattersDivision 1Dealing with
applications,expressions of interest andassessments15Application fee(1)An
application by a person to become an adoptive parent andto
have the person’s name entered in an adoption list must beaccompanied by the relevant fee specified in
schedule 1.(2)However, the fee is not payable if the
application is made by aperson whose name is or, within 1
month before the date ofthe application, was included in a
similar list kept by a personapprovedforthepurposesofthelawofanotherStateoraTerritory of the
Commonwealth.16Assessment fee(1)Apersonnamedinanadoptionlistortheexpressionofinterest register must pay, within the
reasonable time requiredby the chief executive, the relevant
fee specified in schedule 1for an assessment under section 13B of
the Act.(2)The chief executive must not carry out

information(1)A person who has applied to become an
adoptive parent mustgivethechiefexecutive,onrequest,anydocumentorinformation the chief executive reasonably
requires to—(a)considertheperson’seligibilitytohavetheperson’sname
entered in an adoption list; or(b)makeanassessment,undersection13BoftheAct,about
the person.(2)Apersonwho,inresponsetoaninvitation,hasexpressedinterestinbeingassessedassuitabletobeaprospectiveadoptermustgivethechiefexecutive,onrequest,anydocumentorinformationthechiefexecutivereasonablyrequires
to—(a)considertheperson’seligibilitytohavetheperson’sname
entered in the expression of interest register; or(b)makeanassessment,undersection13BoftheAct,about
the person; or(c)considertheperson’seligibilitytohavetheperson’sname
remain in the assessment register.(3)The
chief executive may, for example, ask the person for anyof
the following—(a)a copy of the person’s birth
certificate;(b)a deed poll or other evidence of a
change of the person’sname;(c)a
copy of the person’s marriage certificate;(d)acopyofacertificateevidencingtheperson’scitizenship;(e)adocumentevidencingadecreeofdissolutionofamarriage of the person;(f)if the person has applied to become an
adoptive parentin relation to a particular child—a document
evidencingaparentingorderundertheFamilyLawAct1975(Cwlth) or a

reference from a stated person or member of a statedclass
of persons.18Notice of change in
circumstances(1)This section applies if—(a)a person’s name is entered in an
adoption list; and(b)the person has given information to
the chief executiveabout a matter; and(c)newinformationaboutthematterarisesorthereisachange in the information given;
and(d)the new or changed information is
relevant to—(i)a decision about the person’s
eligibility to have theperson’s name entered in the relevant
adoption list;or(ii)an assessment,
under section 13B of the Act, aboutthe
person.(2)Also, this section applies if—(a)a person’s name is entered in the
expression of interestregister; and(b)the
person has given information to the chief executiveabout
a matter; and(c)newinformationaboutthematterarisesorthereisachange in the information given;
and(d)the new or changed information is
relevant to—(i)a decision about the person’s
eligibility to have theperson’s name entered in the
expression of interestregister; or(ii)an
assessment, under section 13B of the Act, aboutthe

addition, this section applies if—(a)aperson’snameisenteredintheassessmentregister;and(b)the person has
given information to the chief executiveabout a matter;

relevant to—(i)a decision about the person’s
eligibility to have theperson’s name remain in the assessment
register; or(ii)an assessment, under section 14 of the
Act, aboutthe person.(4)Thepersonmustimmediatelygivetheneworchangedinformation to

interest by written noticegiven to the chief executive.(2)On receiving the notice, the chief
executive must remove theperson’s name from the expression of
interest register.20BNotice asking for removal from
assessment register(1)A person named in the assessment
register may give the chiefexecutiveawrittennoticeaskingthechiefexecutivetoremove the person’s name from the
assessment register.(2)On receiving the notice, the chief
executive must remove theperson’s name from the assessment
register.21Removal from Special Needs Children’s
AdoptionList—Act, s 13B(9)The time
prescribed for section 13B(9) of the Act is 2 yearsfromthetimethepersonappliedtothechiefexecutivetobecome an adoptive parent.22Removal if chief executive satisfied
person no longerwishes to become an adoptive parent(1)Thechiefexecutivemayremoveaperson’snamefromanadoptionlist,ortheexpressionofinterestregisterorassessmentregister,ifthechiefexecutiveisreasonablysatisfied the
person no longer wishes to become an adoptiveparent.(2)Without limiting subsection (1), the
chief executive may bereasonably satisfied that a person no
longer wishes to becomean adoptive parent if the chief
executive—(a)sends a letter to the person, at the
last address for theperson known to the chief executive, asking
the personto give the chief executive a written notice

and(b)does not receive a reply from the
person within 30 daysafter sending the letter; and(c)makesreasonableenquiriesabouttheperson’scurrentaddress; and(d)if,
on making the enquiries, the chief executive learns ofa
different address for the person—(i)sends
the letter mentioned in paragraph (a) to theaddress;
and(ii)does not receive a reply from the
person within 30days after sending the letter; and(e)sends another letter (thefinal letter) to the person,
at thelast address for the person known to the
chief executive,statingthat,ifthepersondoesnotgivethechiefexecutiveawrittennoticeconfirmingthatthepersonstillwishestobecomean
adoptiveparent,byastatedday not less than
30 days after the date of the letter, thechief executive
will remove the person’s name from therelevantadoptionlistortheexpressionofinterestregister or
assessment register; and(f)doesnotreceiveareplyfromthepersontothefinalletter by the
stated day.22ARemoval from assessment register if
adoption ordermade(1)If an adoption
order is made in favour of a person named inthe assessment
register, the chief executive must remove theperson’s name
from the register.(2)This section does not apply if—(a)the adoption order mentioned in
subsection (1) relates toa special needs child; and(b)the person mentioned in subsection (1)
is also named inthe Special Needs Children’s Adoption

assessment register(1)This section applies if the chief

registrar general must make the entries in, alterations to,and
notations on, the adopted children register and the registerof
births, and the indexes to those registers, that the
registrargeneralconsidersappropriatetoevidencetheadoption,discharge or
rescission.(5)Onreceivingadocumentmentionedinsubsection(2)(a)or(c), the registrar general must also
prepare a schedule, in theapprovedform,fromtheinformationcontainedinthedocument.(6)IfanadoptionorderismadeundertheActinrelationtoaperson born in a jurisdiction outside
Queensland, the registrargeneralmustgiveacopyoftheordertotheappropriateofficer
responsible for recording births in the jurisdiction.(7)On receiving a document relating to an
order for the dischargeof an adoption order, the registrar
general must give a copy ofthe document—(a)if
the adoption order was made under the Act—to thechief
executive; and(b)if the order relates to a person whose
birth is registeredin a jurisdiction outside Queensland—to the
appropriateofficerresponsibleforrecordingbirthsinthejurisdiction.(8)Theregistrargeneralisnotrequiredtocomplywithsubsection(6)or(7)(b)totheextentcompliancewouldbeimpracticable in all the

particulars stated inthe schedule; or(ii)otherwise—an application for a certificate,
in theapproved form, containing the particulars

representative has been appointed for therelevant

stated in schedule 1.(2)Ifthechiefexecutivedecidestosupervisethewelfareandinterests of a child under section 38A of
the Act, the adopterof the child must, within the reasonable
time required by thechief executive, pay the supervision fee

chief executive may waive payment of a fee for a personif
