not required to pay a fee mentioned in schedule 1.(4)An exempt individual for a fee is not
required to pay the fee.(5)In this
section—exemptindividual,forafee,meansanindividualwhohasobtainedanorderundertheUniformCivilProcedureRules1999, rule 971(4)1exempting the individual from payment

if account taken(1)On taking an account of an accounting
party in the SupremeCourt or the District Court, the
fees—(a)mustbepaidbythepartyhavingtheconductoftheorder under which the account is taken
and are part ofthat party’s costs of the proceeding, unless
the court or ajudge otherwise directs; and(b)ifacertificateoftheresultoftheaccountisrequired—must be paid when the certificate
is filed; and(c)ifacertificateisnotrequired—arepayableontheaccount, or part
of the account, taken.(2)The registrar of
the Supreme Court or the District Court mayrequireadepositofnotmorethanthefeespayableontheamount that, from
the account, appears to have been receivedand must make a
note of the deposit in the account.(3)OntakinganaccountbyorderoftheSupremeCourtorDistrict Court the fees are, on
payment, to be included in theaccount unless

or interpreter to whomsection 17 applies.(2)Also, if a witness attends 2 or more
proceedings on the sameday, the amount to be paid to the
witness for each proceedingmust be a reasonable share of the
total for all the proceedings.10Witness allowances(1)Eachrelevantpersonisentitledtobepaidthefollowingallowancesinaccordancewiththispartforattendanceatcourt—(a)a
travelling allowance;(b)an accommodation
allowance;(c)an attendance allowance.(2)The travelling allowance is a payment
made towards meetingthe costs incurred by the relevant person in
travelling to andfrom the court.(3)Theaccommodationallowanceisapaymentmadetowardsmeetingthecostsincurredbytherelevantpersonforaccommodationandmealswhentherelevantpersonisnecessarilyabsentfromtheperson’splaceofresidencetoattend court.(4)The
attendance allowance is a payment made towards meetinganylossofearningsoradditionalexpensesincurredbyarelevant person during the person’s
absence from the person’splace of residence to attend
court.11Travelling allowance(1)The amount of the travelling allowance
to be paid to a relevantperson is—(a)theamountactuallyandproperlypaidforfaresforpublic transport; or

kilometreforthetime beingpayable under thePublicServiceAct2008to a publicservice officer
required to use the officer’s private motorvehicle for
official purposes, taken to the nearest wholecent.(2)A relevant person is not entitled to
the payment of a travellingallowance if no expense is incurred by
the person in travellingto and from the court.(3)If a relevant person, travels to and
from the court in a privatevehicle with another relevant person,
only 1 payment is to bemade under subsection (1)(b) for the
vehicle.(4)Ifitwasreasonablefortherelevantpersontotraveltoandfrom the court by air, the amount of
the travelling allowanceto be paid is—(a)foranonprofessionalwitnessoraninterpreter—theamountpayableforeconomyclassairtravelbytheperson to and from the court;
or(b)foraprofessionalorexpertwitness—theamountpayableforfirstclassairtravelbythepersontoandfrom the court.(5)Forthecalculationoftravellingallowances,indecidingwhether public
transport was available, regard is to be had towhether a public
transport system operated by which a personcould
conveniently travel to the relevant court in reasonabletimebeforetheperson’srequiredattendanceandcouldconvenientlyreturntotheperson’splaceofresidenceoremployment after the person’s attendance at
court.12Accommodation allowance(1)Theamountoftheaccommodationallowancethatistobepaid to a relevant person is to be the
amount calculated at theratepayableunderthePublicServiceAct2008toapublicservice
officer.(2)Forsubsection(1),theperiodofabsencefromtherelevantperson’s place of
residence is to be calculated from the time ofdeparture from
that place to the time of return to that placeand if, after the
number of full days absence has been decided,

remaining is more than 12 hours, that period is tobe
treated as a day’s absence.(3)Forcalculatingaccommodationallowances,regardistobehad
to the time of the latest public transport of the class usedwhich
could conveniently convey the person to the place ofattendance at the relevant court in
reasonable time before theperson’srequiredattendanceand,afterthatattendance,thetimeofarrivalattheperson’splaceofresidenceoremploymentoftheearliestpublictransportofthatclassleaving the place
of attendance within a reasonable time afterthatattendance,unlessspecialreasonsexistforsomeotherbasis for the
calculation.13Non-professional attendance
allowanceThe amount of the attendance allowance that
is to be paid to anon-professional witness is—(a)if the witness is under 16—$31.50;
or(b)if the witness is 16 or
older—$63.00;for each day or part of a day of necessary
absence from thewitness’s place of employment or
residence.14Professional or expert attendance
allowance(1)The amount of the
attendance allowance that is to be paid to aprofessionalorexpertwitnessis$195.00foreachdayofnecessaryabsencefromtheperson’splaceofemployment,practice or
residence to attend court.(2)Iftheperiodforwhichaprofessionalorexpertwitnessisnecessarilyabsentis7hoursorless,theamountoftheattendance allowance that is to be
paid is—(a)for an absence of 3 hours or
less—$74.00; or(b)for an absence of more than 3 hours
but not more than 4hours—$100.00; or(c)for
an absence of more than 4 hours but not more than 5hours—$125.00; or(d)for
an absence of more than 5 hours but not more than 6hours—$150.00; or

an absence of more than 6 hours but not more than 7hours—$175.00.(3)However, if the witness is a doctor who is
employed under theHealthServicesAct1991as a health
service employee at ahospital, the attendance allowance
that is to be paid is $65.00for each day or
part of a day of necessary absence from thehospital at which
the person is employed.(4)Travelling time
is to be taken into account for deciding theamount of the
allowance under this section.15Interpreter attendance allowance(1)The amount of the attendance allowance
that is to be paid toan interpreter is $200.00 for each day
of necessary absencefromtheinterpreter’splaceofemploymentorresidencetoattend court.(2)If
the period for which the interpreter is necessarily absent
islessthan8hours,theamountofthatattendanceallowanceis—(a)for the first 2
hours or part of 2 hours—$50.00; and(b)for
each additional hour or part of an hour—$23.50.(3)Travelling time is to be taken into account
for deciding theamount of the allowance under this
section.16When additional amount may be
allowed(1)Iftheregistrarconsidersitisreasonableforanadditionalamounttobepaidtoawitnessundersection13,14or15because of special circumstances, the
registrar may approvethe payment of an additional
reasonable amount.(2)ItisaspecialcircumstancethatadoctorisaspecialistregistrantundertheMedicalPractitionersRegistrationAct2001.
