force on 12 March 1999]˙Short title1.This regulation may be cited as
theIntegratedPlanning(ZoningofClosed Roads) Transitional Regulation
1999.˙Zoning of closed
roads under transitional planning schemes2.(1)This
section applies if—(a)a transitional planning scheme under
chapter 6, part 1 of the Act isinforceinalocalgovernment’sarea,orpartofalocalgovernment’s
area; and(b)aroad,orpartofaroad,intheareaforwhichtheplanningscheme is in
force is closed or proposed to be closed; and(c)the
Governor in Council is satisfied—(i)the
land comprising the road or part of the road should beincluded in a zone consistent with the
zoning of adjoininglands under the planning scheme; and(ii)the proposed
zoning would not substantially affect the publicin
an adverse way; and(iii)the local
government has agreed in writing to the Governorin
Council acting under this section.(2)The
Governor in Council may, by gazette notice, zone the land in
theway stated in the notice.(3)The
notice takes effect—(a)if the road has
been closed—on gazettal of the notice; or

closure of the road.(4)When the notice takes effect, the
planning scheme is taken to havebeen amended in
the way stated in the notice as if the process stated inschedule 1 of the Act for amending a planning
scheme had been followed.˙Expiry of
regulation3.This regulation expires on 31 December
1999.
