the meaning of theBondUniversityAct1987.(2)Further,thefollowingentitiesmaymakeanapplicationforregistration as a provider if the entity is
a person and intendstoprovide,arrangeorpromoteacourseconductedbytheperson to an

667;(g)self-accrediting higher education
institution.(3)If an entity mentioned in subsection
(2) is not a person, theperson who intends to provide, arrange
or promote a courseconducted at, or by means of, the entity to
an overseas studentmaymaketheapplicationforregistrationasaproviderinrelation to the entity.(4)In
this section—State education officermeans the
officer of the departmentadministeringtheEducation(GeneralProvisions)Act2006whosefunctionitistoprovidecoursesconductedat,orbymeans of, State instructional institutions
to overseas students.StateinstructionalinstitutionseetheEducation(GeneralProvisions)Act2006, schedule
4.5Registration criteria for deciding
applications(1)Under section 7(4) of the Act, the
chief executive must applythe registration criteria for
deciding—(a)whether to approve an application;
and(b)if the application is approved—the
conditions to applyto the registration.(2)Division 2 states the registration criteria
the chief executivemustapplyfordecidinganapplicationforregistrationasaprovider.Current as at 1

criteria for providers6Policy about
entry requirements for registered courses(1)An
applicant for registration as a provider must have a writtenpolicy about entry requirements, that is
expressed as applyingto the applicant as a registered
provider.(2)The policy about entry requirements
must state—(a)the way in which the registered
provider must inform anoverseas student or intending overseas
student about theentry requirements for each registered
course offered bythe registered provider; and(b)theprocessesforapplyingtherequirementstoeachoverseas student
or intending overseas student.(3)In
this section—entryrequirements,foraregisteredcourse,meanswrittenrequirementsforentrytothecourse,includingapplicableacademicandEnglishlanguageskillsreasonablynecessaryfor
the course.7Policy about refunding fees(1)An applicant for registration as a
provider must have a writtenpolicy about
refunding fees, that is expressed as applying tothe
applicant as a registered provider.(2)Thepolicyaboutrefundingfeesmustprotectthefinancialinterests of
overseas students and intending overseas students,including—(a)by
stating all the circumstances under which a refund ofallorpartofthefeesmustbepaidbytheregisteredPage 6Current as at 1 July 2014

way in which the amount of the refundis to be
calculated; and(b)by providing for a refund to be paid
by the registeredproviderdirectlytothepersonwhoentersintothecontract with the registered provider
about the student,unlessthepersongivesawrittendirectiontotheregistered
provider to pay the refund to someone else;and(c)byprovidingforarefundtobefullypaidbytheregisteredproviderinthesamecurrencyinwhichthefeeswerepaid,unlesspaymentinthatcurrencyisimpracticable; and(d)by
providing for the total amount of each refund to bepaid
no later than 2 months after it is due.(3)Also,thepolicymustprovidethattheregisteredprovidermustgiveacopyofthepolicytoeachintendingoverseasstudentatareasonabletimebeforeacontractaboutthestudent is entered into or an amount
is paid for a registeredcourse, whichever happens
first.(4)Apolicyprovidingforsomeoneotherthantheregisteredprovidertopayarefund,including,forexample,theregisteredprovider’sagentinanothercountry,doesnotcomply with subsection (2)(b).8Policy about dispute resolution
process(1)An applicant for registration as a
provider must have a writtenpolicy,thatisexpressedasapplyingtotheapplicantasaregisteredprovider,aboutresolvingdisputesbetweentheregisteredproviderandoverseasstudentsenrolledinregistered courses conducted by the
registered provider.(2)Thepolicyaboutresolvingdisputesmustallowoverseasstudentstoparticipateinatimelyandappropriatedisputeresolution process, that has regard to their
status as personsoutside of Australia or only temporarily in
Australia.(3)The policy must state, in a prominent

overseas student may contact the chief executive ifthestudentisconcernedabouttheconductoftheregistered provider; and(b)the chief executive may, under part 2,
division 2 of theAct, suspend or cancel the registration of a
provider orcourse; and(c)thedisputeresolutionprocessdescribedinthepolicydoes not prevent
an overseas student from exercising thestudent’s rights
to other legal remedies.(4)Also,thepolicymustprovidethattheregisteredprovidermust
give a copy of the policy to each overseas student—(a)before a contract about the student is
entered into or anamountispaidforaregisteredcourse,whicheverhappens first;
and(b)within7daysafterthestudentstartsattendingaregisteredcourseconductedbytheregisteredproviderin
which the student is enrolled.(5)Totheextentapolicyrelatestothefinancialinterestsofoverseas students, a reference in this
section to an overseasstudent includes an intending overseas
student.9Policy about arrangements for
unaccompanied children(1)If an applicant
for registration as a provider intends to offercoursestounaccompaniedchildren,andtomakearrangementsforunaccompaniedchildrentobeaccommodated
with an approved family, the applicant musthave a written
policy about making the arrangements that isexpressedasapplyingtotheapplicantasaregisteredprovider.(2)The policy about making arrangements
must provide for theapprovalofafamilythatistoprovideaccommodationservices to an
unaccompanied child, including, for example—(a)guidelinesforselectingthefamily,inparticular,guidelines for
ensuring the family is able to provide thechild with a

which the child is enrolled; and(b)criteriaabouttheaccommodationservicestobeprovided;
and(c)an orientation program for the members
of an approvedfamily if the family has not previously
accommodatedan overseas student of the registered
provider.(3)Also, the policy must include a copy
of the form of contractfor arrangements about providing
accommodation services, iftheregisteredproviderintendstousetheformforarrangements made by the registered
provider.(4)In this section—accommodation
servicesincludes accommodation, meals andother services.approved
familymeans a family approved by the
registeredproviderforprovidingaccommodationservicestoanunaccompanied
child.supervisedarrangement,foranoverseasstudentunder18years, means an arrangement under
which an adult normallyresidentintheState(otherthananoverseasstudent)isappointed in writing by a parent of
the student to act on thestudent’s behalf in matters about the
student while the studentis in the State.unaccompaniedchildmeansanoverseasstudentunder18years, other than—(a)a
student who lives with at least 1 parent while enrolledinaregisteredcourseconductedbytheregisteredprovider;
or(b)a student who is covered by a
supervised arrangementwhile enrolled in a registered course
conducted by theregistered provider; or(c)astudentwho,whileenrolledinaregisteredcourseconducted by the registered provider—Current as at 1 July 2014Page

criteria[s 10](i)livesataboardingschool,residentialcollegeorstudent hostel, operated by or in
association withthe registered provider; or(ii)isaccommodatedataplaceoperatedbyorinassociationwiththeregisteredproviderunderanarrangementforprovidingaccommodationservices and,
under the arrangement, the student’sresidence at the
place and attendance at the courseis
supervised.10Policy about students previously
enrolled in relevantcourses(1)An
applicant for registration as a provider must have a writtenpolicy,thatisexpressedasapplyingtotheapplicantasaregistered provider, about the
following students—(a)overseasstudentswhoapplytobeenrolledinaregisteredcourseconductedbytheregisteredproviderand
have previously completed a relevant course;(b)overseasstudentswhoapplytobeenrolledinaregisteredcourseconductedbytheregisteredproviderand
who have been enrolled in a relevant course (otherthanwiththeregisteredprovider)buthavenotcompleted the course.(2)Thepolicymustprovidethat,inrelationtoanoverseasstudentwhohasbeenenrolledinarelevantcourse,theregistered provider must not admit the
student to a registeredcourse conducted by the registered
provider unless—(a)ifthestudentpreviouslycompletedtherelevantcourse—the
registered provider is satisfied the studentdemonstratedacommitmenttothestudent’sstudiesduring the course, had a good attendance
record for thecourse and paid all fees for the course;
or(b)if the student has been enrolled in,
but did not completethe relevant course—the registered
provider is given aletter of release about the student for the

overseas student hasnotcompletedaregisteredcoursebutasksforaletterofrelease, the registered provider must give
the student a letterof release.(4)In
this section—letter of releasemeans a letter
from the provider of a relevantcourseaboutastudentthatprovidesinformationaboutwhether or not the student—(a)demonstratedacommitmenttothestudent’sstudiesduring the course; and(b)had
a good attendance record for the course; and(c)paid
all fees for the course.relevant coursemeans—(a)a registered course; or(b)a course registered under a law of the
Commonwealth,oranotherState,fortheregistrationofpersonswhoprovide courses to overseas students.11Policy about code of ethics(1)An applicant for registration as a
provider must have a writtenpolicy,
expressed as applying to the applicant as a registeredprovider, that provides the registered
provider is bound by thecode of ethics.(2)In
this section—code of ethicsmeans the code,
developed by Ministers of theCommonwealthandtheStatesresponsibleforeducationmatters,thatisdirectedatensuringoverseasstudentsarefinancially protected from default by

course must—(a)be conducted by the registered
provider for the course;and(b)havewrittenrequirementsforentrytothecourse,includingapplicableacademicandEnglishlanguageskills reasonably necessary for the course;
and(c)have stated and demonstrable
educational outcomes forall students who enrol in the course
and complete it; and(d)be suitable for
overseas students, having regard to thequalifications,
abilities and aspirations of the students.(2)Also, if the registered provider of the
course, or the course,mustbeaccredited,approved,registeredorotherwiserecognisedunderalaw(otherthantheAct),theregisteredproviderorthecoursemustbeaccredited,approved,registered or otherwise recognised under the
law.Part 3Register of
registeredproviders and registeredcourses14Information to be kept in

kept in the register ofregisteredprovidersandregisteredcourses,thatthechiefexecutive must

providerFor each registered provider, the register
must include—(a)theinformationtobeincludedinaregistrationcertificate
under section 9(4)(a) of the Act; and(b)othernamesusedbytheregisteredproviderinpromotingregisteredcoursesconductedbytheregistered provider; and(c)if the registered provider is not an
individual—(i)information about its legal status;
and(ii)anyAustraliancompanynumberorAustralianregistered body
number for the registered providerunder the
Corporations Law; and(iii)the name and
title of its chief executive officer; and(d)theaddress,atelephone number and a fax number (ifany)forthecentralorheadofficeorcampusoftheregistered provider; and(e)detailsofanysuspensionsorcancellationsabouttheregistered provider.16Information about each registered
courseFor each registered course, the register
must include—(a)theinformationtobeincludedinaregistrationcertificate
under section 9(4)(b) of the Act; and(b)the
