regulation—approved formmeans a form
approved by the chief executive.averagemaximumairtemperatures,forapublicwatersupply,meanstheannualaverageofmaximumdailyairtemperaturesbasedontemperaturedataobtainedforaminimumtermof5yearsrecordedattheClimatologicalStationoftheBureauofMeteorologynearesttothereticulated area
of the public water supply.treatedwatermeanswaterfromapublicwatersupplytowhich
fluorine has been added under the Act.3FormsThechiefexecutivemayapproveformsforuseunderthisregulation.4Exempt person—Act, s 3(1)Forsection3(1)oftheAct,BHPAustraliaCoalPtyLtdACN 010 595
721isanexemptpersonforthepublicwatersupply for the township of Moranbah in the
Shire of Belyandoand the township of Dysart in the Shire of
Broadsound.11Under section
3(2) of the Act, the Act applies to a person exempted under
thissection as if the person were a local
government.
s54s8FluoridationofPublicWaterSuppliesRegulation19985Notification of
addition of fluorine(1)A local government that decides to add
fluorine to a publicwater supply under its control must, within
7 days of makingthe decision, give the chief executive a
notice, in the approvedform, stating the decision that has
been made.(2)Also,thelocalgovernmentmustgivethechiefexecutiveanotice,intheapprovedform,statingthedatethelocalgovernment intends to begin adding fluorine
to the water.(3)The date mentioned in subsection (2)
must not be less than 30days from the day the local government
gives the notice to thechief executive.6Forms
of fluorine—Act, s 4(2)For section 4(2) of the Act, the forms
of fluorine that may beaddedtoapublicwatersupplyaresodiumfluoride(NaF),hexafluorosilicicacid(H2SiF6)anddisodiumhexafluorosilicate (Na2SiF6).7Fluorine concentration—Act, s
4(3)(1)Forsection4(3)oftheAct,theminimumandmaximumconcentrations
for fluorine in public water supplies are statedintheschedule,columns2and3respectivelyoppositetheaveragemaximumairtemperaturesrelativetothepublicwater
supply stated in the schedule, column 1.(2)The
minimum and maximum concentrations of fluorine statedin
the schedule include fluorine naturally present in the
publicwater supply.8Automatic feeding equipment(1)A local government may add fluorine to
a public water supplyonly by means of automatic feeding
equipment—(a)inwhichtherateoffeedofthefluorinecompoundisrelated to the rate of flow of the
water; and(b)that has an accuracy range of plus or
minus 5%.

has not been in operation for any continuousperiodof1week,thelocalgovernmentmustimmediatelygive the chief
executive a notice, in the approved form, of itsnon-operation in the period.9Analysis of treated water(1)This section applies to a local
government that adds fluorineto a public water
supply.(2)Once a day, the local government must
collect samples of thetreated water taken as it leaves the
fluoridation equipment andmake the prescribed analyses of the
water.(3)Once a week, the local government must
collect samples ofthetreatedwatertakenfromatleast2pointsonthereticulation system and make the
prescribed analyses of thewater.(4)Ifthechiefexecutivesuspectsanimminentrisktopublichealthfromtheconsumptionofthetreatedwater,thelocalgovernment must,
as required by the chief executive—(a)forward samples of the water collected under
subsection(2) or (3) to the chief executive; or(b)collectadditionalsamplesofthewaterandforwardthem to the chief
executive; or(c)collectadditionalsamplesofthewaterandmaketheprescribed
analyses of the water.(5)In this
section—prescribed analyses, of treated
water, means analyses of thefluorinecontentofthewaterusing1ofthefollowingmethods—(a)the SPADNS colorimetric method;(b)the ion-selective electrode
method.10Records and reports(1)This section applies to a local
government that adds fluorineto a public water
supply.

government must, for each day, record—(a)the
volume of water to which it has added fluorine; and(b)the amount of fluorine it has added to
the water; and(c)the amount of fluorine it received
into stock; and(d)the amount of fluorine held in stock
by it at the end ofthe day.(3)Also,
the local government must record the results of analysesof
samples of the treated water performed by it under section9.(4)A record
mentioned in subsection (2) or (3) must be made—(a)in the approved form; and(b)before the end of the day to which the
record relates.(5)Thelocalgovernmentmust,immediatelyaftertheendofamonth, give the chief executive copies
of the records made byit, under this section, for the
month.(6)Also,ifthechiefexecutiveconsidersconsumptionofthetreated water is an imminent risk to
public health, the chiefexecutive may, during a month, ask the
local government forcopies of any of the records made by it,
under this section, forthe month.(7)Thelocalgovernmentmustimmediatelycomplywiththerequest.(8)For subsection (2), an amount includes
zero.11Employees of local governmentsA
local government that adds fluorine to a public water supplymustensureeachpersonemployedbyitinrelationtotheaddition of fluorine to the water has
the necessary training orknowledge and experience.12Additional requirements for addition
of fluorineA local government that adds fluorine to a
public water supplymust also ensure—

not contain an impurity in a quantitythatislikelytoadverselyaffectthehealthofpersonsconsuming the
treated water; and(b)itsfluoridationequipmentiskeptseparatedfromitsother water
treatment equipment in a separate buildingor room;
and(c)its stocks of fluorine are
kept—(i)separatedfromothersubstancesusedbyitforwater treatment in a separate building
or room; and(ii)under weatherproof conditions.13RepealTheFluoridationofPublicWaterSuppliesRegulation1964isrepealed.
