2013]1Short titleThis regulation
may be cited as theTravel Agents Regulation1998.2DefinitionIn
this regulation—Australiaincludes an
external territory.3Categories of licenceSchedule 1 sets out—(a)the
categories of licence that may be granted; and(b)the
type of business for which a category of licence maybe
granted.4Exempted persons or
transactionsThe exemptions under section 10 of the Act
are in schedule 2.5How application for licence must be
advertised(1)For section 14(3) of the Act, an
application for a licence mustbeadvertisedbypublishinganoticeoftheapplicationinanewspaper published at least 5 days a
week and circulating inthelocalityinwhichtheapplicantproposestocarryonbusiness as a travel agent.(2)The notice must be in the approved
form and be published atleast 10 days before the application

19(2) of the Act, the prescribed day is the last dayof
the month in which the licence was granted in each year thelicence fee is payable.Example 1—X is granted a licence on 23 November
2004 after paying an annuallicence fee. The next prescribed day
is 30 November 2005.Example 2—Y is
granted a licence on 14 August 2004 after paying a triennial
licencefee. The next prescribed day is 31 August

identified by a signA person who carries on business as a
travel agent at a placemust ensure a conspicuous sign is
displayed at the place, thatindicates that
the business of a travel agent is being carried onat
the place.Example—a
conspicuous sign stating ‘Travel agent’, ‘Travel agency’ or
‘Smith’sTravel Agency’ displayed—•in or on the shopfront of a shop in
which the business is carried on;or•in the area in which the business is
carried onMaximum penalty—20 penalty units.10Notice that must be displayed at each
place of business(1)Themattersprescribedforsection31(b)oftheActareasfollows—(a)the address of the place of business
at which the noticeis displayed;(b)the
licence number of the person required to display thenotice;(c)if
the person carries on business at the place under anauthorised name (other than the name of the
person as itappearsinthelicence)—theauthorisednameunderwhich the person
carries on business at the place;(d)thecategoryoflicenceforthetypeofbusinessasatravel agent carried on by the person
at the place;(e)theconditions(ifany)imposedbythecommissionerunder section 20
of the Act.(2)Ifaperson’slicenceissuspendedorcancelledthepersonmust—(a)immediatelyremoveeachnoticedisplayedforthelicence by the person under section 31

and otherchanges(1)This
section applies if a licensee’s circumstances change in afollowing way—(a)the
postal address or the location of a place at which thelicensee carries on business as a travel
agent changes;(b)the licensee starts carrying on
business as a travel agentat an additional location;(c)thepersonmanagingandsupervisingthebusinessconducted at a
place from which the licensee carries onbusiness as a
travel agent changes.(2)Within 1 month
after a change mentioned in subsection (1)happens,thelicenseemustgivethecommissionerwrittennotice of the following—(a)for
a change mentioned in subsection (1)(a)—the postaladdress, or the address of the location,
after the change;(b)forachangementionedinsubsection(1)(b)—theaddress of the
additional location;(c)for a change
mentioned in subsection (1)(c)—(i)the
name, age and address of the person managingand supervising
the business after the change; and(ii)anyqualifications,statedinschedule3forthecategoryoflicenceforthebusiness,heldbytheperson.Maximum penalty for subsection (2)—20

AmendmentRegulation (No. 1) 2009(1)ThissectionappliestoapersonwhostartedaunitofcompetencytitledTHTSOP20A(Constructnormalinternationalairfares)beforethecommencementofthissection.(2)Thepersonmaysatisfytherequirementmentionedinschedule 3, section 1(1)(a)(i) by
either—(a)thesuccessfulcompletionoftheunitofcompetencymentioned in
subsection (1), whether the completion isbefore or after
the commencement of this section; or(b)thesuccessfulcompletionoftheunitofcompetencymentioned in

day return travel(1)A transaction mentioned in subsection
(2) is exempt from theapplication of the Act.(2)Thetransactionissellingorarrangingforthesaleof,oradvertisingawillingnesstosellorarrangeforthesaleof,rightsofapersontotravelinAustraliafromaplace,andreturn to the place, on the same day.1APrepaid rights to travel on public
transport(1)A transaction is exempt from the
application of the Act if—(a)the transaction
is selling, or advertising a willingness tosell, prepaid
rights to travel on public transport; and(b)it
is conducted by the chief executive (transport) or anagent of the chief executive
(transport).(2)In this section—chief executive
(transport)means the chief executive of thedepartmentinwhichtheTransportOperations(PassengerTransport) Act
1994is administered.2Brisbane City Council public transport
tickets(1)A transaction mentioned in subsection
(2) is exempt from theapplication of the Act.(2)The transaction is selling, or
advertising a willingness to sell,tickets for
prepaid travel on public transport operated by, oron
behalf of, the Brisbane City Council.Current as at 1

section applies if—(a)an applicant for a licence intends to
carry on business asa travel agent in partnership;
and(b)another of the intended partners
(thefee payer) has
paida fee for a licence under which the fee
payer’s businessasatravelagentintheintendedpartnershipmaybecarried on.(2)The
applicant for the licence is exempt from the application ofsection 18(4) of the Act, in so far as it
requires payment of afee.5Annual licence fee exemption for partner if
anotherpartner has paid annual licence fee(1)This section applies if—(a)apersoncarriesonbusinessasatravelagentinpartnership; and(b)anyofthepartners(afeepayer)haspaidanannuallicence fee for
a year for a licence under which the feepayer’s business
as a travel agent in the partnership maybe carried
on.(2)Thepersonisexemptfortheyearfromtheapplicationofsection 19(2)(a) of the Act.Page

which the onlytype of business as a travel agent they
carry on is for acategory 2 licence(1)A
person is exempt from the application of the Act on eachday
on which—(a)the only business as a travel agent
the person carries onis the type of business for a category
2 licence; and(b)the person’s gross turnover from
carrying on the type ofbusiness for a category 2 licence
during the previous 12months is not over $50000.(2)For subsection (1)(b), gross turnover
does not include grossturnover from a transaction exempt
from the application of theAct.(3)If,apartfromthissubsection,acontinuousperiodofexemptionundersubsection(1)wouldend,theexemptioncontinues for a
further 1 month.(4)However, if—(a)the
person does not hold a licence under the Act; and(b)the person makes an application for a
licence within that1 month and fulfils all requirements under
the Act forthe application; and(c)theapplicationhasnotbeendecidedwithinthat1month;the exemption
continues until the application is decided.(5)For
subsection (3), a period is continuous even if it is only
fora single day.7Exemption for Queensland Tourist and
TravelCorporationTheQueenslandTouristandTravelCorporationisexemptfrom the

ofQueensland Incorporated(1)The
Royal Geographical Society of Queensland Incorporated(thesociety) is
exempt from the application of the Act to theextent the
society sells or arranges for the sale of—(a)rightstotravelbetweenplacesinAustraliatothesociety’s members; or(b)rights to travel and accommodation in
Australia to thesociety’s members.(2)Subsection(1)appliesonlyfortravel,ortravelandaccommodation, that is part of a group tour
for 10 or moremembersorganisedbythesocietyinaccordancewithitsobjectives.9Exemption for travel agents in another
State(1)A person who is authorised to carry on
business as a travelagent under a law of a reciprocating
State is exempt from theapplication of the Act to the extent
that the person—(a)advertisesinQueensland,ifthepersonstatesintheadvertisement—(i)the
person’s name; and(ii)thelicencenumberofanylicenceissuedtotheperson under the law; and(iii)the name, or a
generally accepted abbreviation ofthe name, of the
reciprocating State in which thelicence was
issued; or(b)providesinformationtoprospectivecustomersinQueensland in connection with the
person’s business asa travel agent.(2)TheexemptionfromtheapplicationoftheActunderthissection does not
apply—(a)if the person is physically present in
Queensland; or(b)ifthepersonoperatesthroughanotherpersonwhoisphysically present in
