s1 3 s3 State Buildings Protective Security Regulation 1998 State Buildings Protective Security Regulation 1998 [as amended by all amendments that commenced on or before 27 June 2008] 1 Short title This regulation may be cited as the State Buildings Protective Security Regulation 1998 . 2 Commencement This regulation commences on 1 July 1998. 3 Definitions In this regulation— licensed premises see Liquor Act 1992 , section 4. 1 liquor see Liquor Act 1992 , section 4B. 2 manager means— (a) the administrator; or (b) a public service officer who— 1 Liquor Act 1992 , section 4— licensed premises means premises to which a licence relates, and includes premises approved under section 125 for sale of liquor. 2 Liquor Act 1992 , section 4B— 4B Meaning of liquor (1) Liquor is a spiritous or fermented fluid of an intoxicating nature intended for human consumption. (2) Liquor also includes any other substance intended for human consumption in which the level of ethyl alcohol (ethanol) is more than 5mL/L (0.5%) at 20ºC. (3) However, liquor does not include a fluid, that would otherwise be liquor, if it is used merely as a preservative or medium in which fruit is offered for sale to the public in sealed containers and with the contents visible.
s4 4 s8 State Buildings Protective Security Regulation 1998 (i) carries out functions for the protective security service that are mainly of a managerial nature; and (ii) is designated in writing by the administrator to give directions or authorisations for this regulation. uniform includes associated accoutrements. 4 Standards of physique and physical fitness for security officers—Act, s 9 (1) The standard of physique and state of physical fitness for protective security officers is a physique suitable, and level of physical fitness appropriate, for carrying out the functions of a protective security officer. (2) The standard of physique and state of physical fitness for senior protective security officers is a physique suitable, and level of physical fitness appropriate, for carrying out the functions of a senior protective security officer. 5 Uniforms The uniform for a security officer is the uniform decided, from time to time, for the officer by the administrator. 6 Surrender of uniforms—Act, s 30 For section 30 of the Act, a security officer’s uniform is a prescribed thing. 7 Security officers to serve in state buildings as directed A security officer must serve in any state building in which the manager directs the officer to serve. 8 Handover of duties (1) A security officer (the duty officer ) carrying out functions in a state building must remain on duty in the building until— (a) relieved of duty by another officer; or (b) authorised by the manager to leave the building.
s 9 5 s 12 State Buildings Protective Security Regulation 1998 (2) However, the duty officer may leave the building if it is necessary to do so for carrying out the officer’s functions. 9 Emergency duties A security officer must take up duty promptly in an emergency, if directed to do so by the manager. 10 Security officers on duty not to be under the influence of liquor or a drug (1) This section applies to a security officer who is on duty or is at a place for taking up duty at the place. (2) The security officer must not be under the influence of liquor or a drug to the extent the officer is not fit to carry out the functions of a security officer. 11 Security officers in uniform not to purchase liquor (1) A security officer who is in uniform must not obtain liquor from licensed premises. (2) Subsection (1) does not apply to a security officer if— (a) the officer is in a motor vehicle; and (b) the liquor is in sealed containers; and (c) immediately after obtaining the liquor, the officer leaves the licensed premises. 11A Declaration of state building—Act, s 4(4) (1) For section 4(4) of the Act, the buildings and their precincts located on the land described in the schedule are state buildings. (2) This section expires on 30 June 2011. 12 Repeal The Law Courts and State Buildings Protective Security Regulation 1984 is repealed.
