s1 5 s2 Primary Producers’ (Levy on Cane Growers) Regulation 1997 PRIMARY PRODUCERS’ (LEVY ON CANE GROWERS) REGULATION 1997 [as amended by all amendments that commenced on or before 28 May 1999] † PART 1—PRELIMINARY ˙ Short title 1. This regulation may be cited as the Primary Producers’ (Levy on Cane Growers) Regulation 1997 . ˙ Definitions 2. In this regulation— “assigned” to a mill, in relation to land, means the land is assigned to the mill under the Sugar Industry Act 1991 . “body” means the council, a district executive or a mill suppliers’ committee. “cane testing” means the weighing, examining or testing of sugar cane for its quantity, quality or condition. “council” means the Queensland Cane Growers’ Council. “district executive” means a district cane growers’ executive. “insurance cover” means cover by way of an insurance policy or compensation scheme to protect a grower against financial loss caused by water or fire damage to sugar cane. “mill” , for a mill suppliers’ committee, means the mill for which it is established.

s3 6 s6 Primary Producers’ (Levy on Cane Growers) Regulation 1997 † PART 2—GENERAL LEVIES ˙ Council 3.(1) The council may make a general levy on all growers for administrative purposes. (2) The levy is 11.5c for each tonne of sugar cane supplied to a mill by a grower. ˙ District executives 4.(1) A district executive mentioned in schedule 1, column 1 may make a general levy on growers in its district for administrative purposes. (2) The levy is at the rate stated in schedule 1, column 3 for sugar cane supplied to the mills mentioned in schedule 1, column 2. 1 ˙ Mill suppliers’ committees 6.(1) A mill suppliers’ committee mentioned in schedule 2, column 1 may make a general levy on growers in its district for administrative purposes. (2) The levy is at the rate stated in schedule 2, column 2 for sugar cane supplied to its mill. 1 Under section 30(8A)(a) of the Act (Cane to be a commodity), a district executive or a mill suppliers’ committee is not empowered to make a general levy unless or until the council’s consent has been obtained. The section also provides that a general levy on a section of growers for administrative purposes may only be spent in the interests of the growers.

s7 7 s9 Primary Producers’ (Levy on Cane Growers) Regulation 1997 † PART 3—PARTICULAR LEVIES † Division 1—District executives ˙ Insurance cover 7.(1) A district executive mentioned in schedule 3, column 1 may make a particular levy on growers in its district. (2) The levy is at the rate stated in schedule 3, column 3 for sugar cane supplied to the mills mentioned in schedule 3, column 2. 2 (3) The amount raised by a levy made by a district executive under this section may only be spent on insurance cover for growers in its district. ˙ Crop insurance levy by Maryborough District Cane Growers’ Executive 8.(1) The Maryborough District Cane Growers’ Executive may make a particular levy on the growers in its district mentioned in schedule 4, column 1 who hold land mentioned in schedule 4, column 2 that is assigned to the Maryborough Sugar Mill. (2) The levy is 5c for each tonne of sugar cane grown on the land by the grower and supplied to the Maryborough Sugar Mill. (3) The amount raised by the levy may only be spent on crop insurance for the growers. ˙ Cane testing 9.(1) A district executive mentioned in schedule 5, column 1 may make a particular levy on growers in its district. (2) The levy is at the rate stated in schedule 5, column 3 for sugar cane supplied to the mills mentioned in schedule 5, column 2. 2 Under section 30(8A)(bg) of the Act (Cane to be a commodity), a district executive or a mill suppliers’ committee is not empowered to make a particular levy unless or until the council’s consent has been obtained.

s 10 8 s 12 Primary Producers’ (Levy on Cane Growers) Regulation 1997 (3) The amount raised by a levy made by a district executive under this section may only be spent on cane testing and research and development relating to cane testing for growers in its district. ˙ Levy for Burdekin River Irrigation Area Irrigators’ Committee 10.(1) The Burdekin District Cane Growers’ Executive may make a particular levy on the growers in its district mentioned in schedule 6, column 1 who hold land mentioned in schedule 6, column 2 that is assigned to a mill in its district. (2) The levy is 1c for each tonne of sugar cane grown on the land by the grower and supplied to a mill in the district. (3) The amount raised by the levy may only be spent on administrative costs for the Burdekin River Irrigation Area Irrigators’ Committee. † Division 2—Mill suppliers’ committees ˙ Insurance cover 11.(1) A mill suppliers’ committee mentioned in schedule 7, column 1 may make a particular levy on growers in its district. (2) The levy is at the rate stated in schedule 7, column 2 for sugar cane supplied to its mills. (3) The amount raised by a levy made by a mill suppliers’ committee under this section may only be spent on insurance cover for the growers who supply sugar cane to its mill. ˙ Cane testing 12.(1) A mill suppliers’ committee mentioned in schedule 8, column 1 may make a particular levy on growers in its district. (2) The levy is at the rate stated in schedule 8, column 2 for sugar cane supplied to its mills.

s 12A 9 Primary Producers’ (Levy on Cane Growers) Regulation 1997 s 12A (3) The amount raised by a levy made by a mill suppliers’ committee under this section may only be spent on cane testing and research and development relating to cane testing for the growers who supply sugar cane to its mills. ˙ Loan repayment levy by Victoria Mill Suppliers’ Committee 12A.(1) The Victoria Mill Suppliers’ Committee may make a particular levy on growers in its district mentioned in schedule 9, column 1 who hold land mentioned in schedule 9, column 2. (2) The levy for the 1998 crushing season is at the rate stated in schedule 9, column 3 for sugar cane grown on the land by the grower and supplied to the mill. (3) The levy for each of the 1999 to 2002 crushing seasons is at the rate stated in schedule 9, column 4 for sugar cane grown on the land by the grower and supplied to the mill. (4) The amount raised by the levy may only be spent on loan repayments in relation to— (a) a payment to the Department of Main Roads for the construction of— (i) a 4.5 km railway across the Bruce Highway at Grasso’s Road, along Grasso’s Road and Cassius Road to Pappins Road; and (ii) an associated highway overpass; or (b) a payment to a grower mentioned in subsection (1) for an easement granted to the mill owner under the Sugar Industry Act 1991 , section 196, 3 for the construction of the railway. 3 Section 196 (Grant of easement) of the Sugar Industry Act 1991 .

s 13 10 s 14 Primary Producers’ (Levy on Cane Growers) Regulation 1997 † Division 3—Unused funds raised by a particular levy ˙ How unused funds are to be applied 13.(1) This section applies if— (a) a particular levy is made by a body under this part; and (b) after applying the amount raised to the purpose for which the particular levy was made, a balance remains. (2) Despite sections 7 to 12A— (a) for a levy made other than under section 12A—the balance may be spent on administrative purposes in the interest of the growers on whom the levy was made; or (b) for a levy made under section 12A—the balance must be rebated to the growers on whom the levy was made. (3) For subsection (2)(b), the balance must be rebated to the growers in proportion to the amount of levy paid by each grower. † PART 4—POLLS FOR PARTICULAR LEVIES ˙ When levy may be made 14. A body authorised to make a particular levy under part 3 may make the levy from— (a) for a levy made other than under section 12A—6 June 1998; or (b) for a levy made under section 12A—14 May 1999. 4 4 However, under section 30(8A)(bf) (Cane to be a commodity) of the Act, a body must not make a levy if a poll is held and the majority of votes is against the making of the levy.

s 15 11 s 16 Primary Producers’ (Levy on Cane Growers) Regulation 1997 ˙ Request to hold a poll 15. A request to hold a poll under section 30(8A)(bf) of the Act must be made to the chief executive by— (a) for a levy made other than under section 12A—5 June 1998; or (b) for a levy made under section 12A—13 May 1999. 5 ˙ Conduct of poll 16.(1) This section prescribes the procedure for holding a poll before a particular levy is made. (2) The chief executive must declare the following things by gazette notice— (a) a poll is to be held; (b) the name of the returning officer appointed by the chief executive for the poll; (c) the last day (the “polling day” ) and time for the return of ballot papers to the returning officer; (d) the form of the official roll of persons eligible to vote in the poll; (e) the day, at least 30 days before the polling day, on which the official roll is to close; (f) the form of the ballot paper; (g) the requirements for making a valid vote. (3) After the poll is held, the chief executive must declare the result of the poll by gazette notice. 5 The address is— The Chief Executive Department of Primary Industries GPO Box 46 Brisbane Q 4000.

s 17 12 s 19 Primary Producers’ (Levy on Cane Growers) Regulation 1997 † PART 5—MILL OWNERS’ DUTIES ˙ Mill owner to deduct levy 17.(1) A mill owner must deduct from an amount payable to a grower after the commencement for sugar cane supplied to the mill— (a) the amount of a levy payable by the grower under this regulation; or (b) a lesser amount notified to the mill owner by the body that made the levy. (2) For this section, it is irrelevant whether or not the sugar cane was grown on land assigned to the mill. Maximum penalty—the lesser of— (a) the amount that was not deducted; or (b) 20 penalty units. ˙ Mill owner to keep records 18. A mill owner must record the following information about the deductions made under section 17— (a) the name of the mill; (b) the name of the mill to which the land on which the sugar cane was grown is assigned; (c) the period over which the sugar cane was supplied to the mill; (d) the tonnage of the sugar cane supplied; (e) the amount deducted. ˙ Mill owner to deliver deducted levy and records 19. A mill owner must, within 7 days after deducting the amount of a levy under section 17, send to the body that made the levy— (a) the amount deducted; and

Maximum penalty—the lesser of— (a) the amount of the deduction; or (b) 20 penalty units. s 21 † PART 6—PAYING AND RECOVERING LEVIES ˙ Growers must pay levies 20. A grower must pay a levy made under this regulation. Maximum penalty—the lesser of— (a) the amount of the levy; or (b) 20 penalty units. ˙ Recovery of levies 21.(1) This section applies if— (a) a body has levied an amount on a grower under this regulation for sugar cane supplied to a mill; and (b) the mill owner has not, under section 19, sent to the body an amount deducted for the levy under section 17. 6 (2) The body may recover the amount from the grower or the mill owner as a debt in a court having jurisdiction in relation to the amount. 6 Section 17 (Mill owner to deduct levy) Section 19 (Mill owner to deliver deducted levy and records)
