Regulation 1997Keno Regulation 1997[as amended by
all amendments that commenced on or before 1 July 2007]1Short titleThis regulation
may be cited as theKeno Regulation 1997.2DefinitionsIn this
regulation—advancedevaluationmeansanevaluationofanyofthefollowing things relating to regulated keno
equipment—(a)communications protocols;(b)monitoring systems;(c)random number generators.basic evaluationmeans an
evaluation of any of the followingthings relating
to regulated keno equipment—(a)artwork;(b)cabinet design;(c)documentation,includingforexample,operationalmanuals.body
corporatemeans—(a)a
corporation as defined in the Corporations Act; or(b)anincorporatedassociationasdefinedintheAssociations Incorporation Act
1981; or(c)any other body
incorporated under any other Act or law.casino

return to a player.keno ball drawing devicemeans a
device—(a)containing 80 balls numbered 1 to 80;
and(b)designed and used to select, at random
and 1 at a time,20 balls.keno computer
systemmeans a computer system used for theconductofkenogamesbyakenolicenseeunderakenolicence.keno draw
controllermeans a device—(a)electronically linked to a keno computer
system; and(b)usedtoactivateakenoballdrawingdeviceorkenorandom number generator.1Casino Control Act 1982,
schedule (Dictionary)—casinolicencemeansalicencegrantedbytheGovernorinCouncilontherecommendation of the Minister
authorising the conduct and playing in a casino ofsuch
games as may in the particular case be authorised by the
Minister.casino licenseemeans the holder
for the time being of a casino licence, and includesa
person referred to in this Act as a casino licensee who, whilst not
at the materialtime the holder of a casino licence, is a
person to whom it is proposed to grant acasino licence
under and in accordance with an agreement as referred to in
section19.

display systemmeans a system—(a)connectedtoakenocomputersystemandkenoterminals; and(b)used
to display the winning numbers for a keno game.keno
terminalmeans a device that accepts information
abouta person’s wager for a keno game for
validation by a kenocomputer system.prescribed
liquor licencemeans a liquor licence mentioned intheGaming Machine Regulation 2002,
section 57.2subsidiaryoperatorseetheGamingMachineAct1991,section 2.totalisatorseeWagering Act 1998, section

used—(a)to enable persons to invest money on
events or contingencies with aview to
successfully predicting specified outcomes of the events orcontingencies; and(b)to
enable the totalisator pool to be divided and distributed among
thepersons who successfully predict the
outcomes.(2)Atotalisatoralso includes an
instrument, machine or device under whichthe system
mentioned in subsection (1) is operated.(3)In
subsection (1)(b), a reference to the totalisator pool is a
reference to theamount left from the investments
after—(a)making allowances for refunds of

Regulation 19973Persons with whom keno licensee may
enter into agencyagreements—Act, s 85For section

persons isprescribed as a person eligible to be a keno
agent—(a)a body corporate that holds a club
licence;(b)the holder of a general
licence;(c)the holder of a prescribed liquor
licence;(d)a casino licensee;(e)a

Regulation 19977Approved places of operation for
appointed agents—Act,s 142(1)This
section prescribes, for section 142(2)(a)9of
the Act, eachof the places that is an approved place for
an appointed agent.(2)If the appointed agent is the holder
of a club licence, generallicence or prescribed liquor licence,
the approved place is thepart of the premises to which the
licence relates where the saleand consumption
of liquor is authorised under the licence.(3)If
the appointed agent is a casino licensee or casino operator,the
approved place is the casino to which the relevant casinolicence relates.(4)Iftheappointedagentisawageringlicensee,theapprovedplace is each
place where a totalisator is operated by or for thelicensee.8Prohibited periods for keno games for
kenolicensees—Act, s 143(1)Forsection143(1)10oftheAct,thefollowingperiodsareprescribed—(a)Anzac
Day—between 3a.m. and 1p.m.;(b)GoodFridayandChristmasDay—between3a.m.andmidnight.9Prohibited periods for keno games for

section prescribes periods for section 143(2) of the Act.(2)If the appointed agent is the holder
of a club licence, generallicence or prescribed liquor licence,
the periods prescribed areany periods that are not periods
during which the consumptionofliquoronthepremisestowhichthelicencerelatesisauthorised under the licence.(3)If the appointed agent is a casino

during which thecasino to which the relevant casino licence
relates is requiredto be operated.(4)Iftheappointedagentisawageringlicensee,theperiodsprescribed are
any periods that are not periods during which atotalisator may
be operated by or for the licensee.10Requests to resolve claims for payment—Act,
s 152(1)Thissectionprescribes,forsection152(6)11oftheAct,thewayinwhichthechiefexecutivemustdealwitharequest,made by a person
(the claimant) under section 152(4)(a) of theAct, to resolve a
claim for payment of a prize for an approvedkeno game.(2)The chief executive must ask the
authorised keno operator toimmediately try to resolve the
claim.(3)If, within 14 days of making the
request under subsection (2),thechiefexecutiveisnotadvisedoftheresolutionoftheclaim by the
authorised keno operator or claimant, the chiefexecutive must by
written notice given to the operator invitethe operator, and
by written notice given to the claimant invitetheclaimant,tomakeawrittensubmissiontothechiefexecutive about
the claim within 1 month after receiving thenotice
(thesubmission period).(4)The chief executive may—(a)cause an investigation to be made
about any matter thechief executive considers is relevant to the
claim; and(b)request a report of the investigation
to be given to thechief executive.(5)As
soon as practicable after the end of the submission period,the
chief executive must—(a)consider all
written submissions made in the submissionperiodbytheauthorisedkenooperatorandclaimant;and11Section 152 (Claims for payment) of

chief executive undersubsection (4); and(c)make a decision about the claim;
and(d)give the authorised keno operator and
claimant a writtennoticestatingthedecisionandthereasonsforthedecision.(6)However,thechiefexecutiveisnotrequiredtotakeorcomplete action under subsection (5) if the
chief executive isadvised of the resolution of the claim by
the authorised kenooperator or claimant.(7)Nothing in this section affects or
prejudices any other right orremedy of an
authorised keno operator or participant in a kenogame.11Requests to review decisions about claims
forpayment—Act, s 152(1)Thissectionprescribes,forsection152(6)12oftheAct,thewayinwhichthechiefexecutivemustdealwitharequest,made by a person
(theclaimant) under section
152(4)(b) ofthe Act, to review a decision of an
authorised keno operator(theoperator’s
decision).(2)The chief
executive must either review, or refuse to review,the
operator’s decision.(3)Thechiefexecutivemayrefusetoreviewtheoperator’sdecision only
if—(a)therequestwasnotmadewithin10daysaftertheclaimantreceivedtheclaimresultnoticeforthedecision; or(b)the
chief executive considers the request was not madein
good faith or is frivolous.(4)Ifthechiefexecutivedecidestorefusetoreviewtheoperator’s decision, the chief executive
must—(a)give written notice of the chief
executive’s decision tothe authorised keno operator and

chief executive must—(a)givetheauthorisedkenooperatoracopyoftheclaimant’s request; and(b)bywrittennoticegiventotheoperatorinvitetheoperator,andbywrittennoticegiventotheclaimantinvite the
claimant, to make a written submission to thechiefexecutiveabouttheoperator’sdecisionwithin1monthafterreceivingthenotice(thesubmissionperiod).(6)The chief
executive may—(a)cause an investigation to be made
about any matter thechief executive considers is relevant to the
review; and(b)request a report of the investigation

1311AReport about prohibition under order
or direction—Act, s154L(1)Anappointedagentmustgivethechiefexecutiveareportabouttheprohibitionofpersonsfromtakingpartinkenogaming at, or
entering or remaining in, the agent’s approvedplace of
operation under a self-exclusion order or an exclusiondirection—(a)within 14 days after 31 December in each
year; and(b)within 14 days after—(i)30 June 2006; and(ii)30
June in each later year.(2)Subsection (3)
applies if a person takes part in keno gamingat,orentersorremainsin,anappointedagent’sapprovedplace of
operation in contravention of a self-exclusion order oran
exclusion direction.(3)Theappointedagentmust,within7daysafterthecontravention, give a report to the chief
executive about theprohibition of the person from taking part
in keno gaming at,orenteringorremainingin,theagent’sapprovedplaceofoperationundertheself-exclusionorderorexclusiondirection.12Entities to whom information may be
