s1 3 s2 Competition Policy Reform (Queensland—Natural Resources Exemptions) Regulation 1996 COMPETITION POLICY REFORM (QUEENSLAND—NATURAL RESOURCES EXEMPTIONS) REGULATION 1996 [as amended by all amendments that commenced on or before 16 April 1997] ˙ Short title 1. This regulation may be cited as the Competition Policy Reform (Queensland—Natural Resources Exemptions) Regulation 1996 . ˙ Forestry Act 1959, s 46—specific authorisation 2.(1) The terms, conditions and reservations, including prices and rates, imposed by the Primary Industries Corporation on its sale of forest products are specifically authorised for the Trade Practices Act, section 51(1)(b) 1 or the Competition Code of this jurisdiction, section 51. 2 (2) In this section— “sale of forest products” means a sale of forest product on a 1 Trade Practices Act, section 51 (Exceptions) 2 Competition Code of this jurisdiction, section 51 states that in deciding whether a person has contravened the Competition Code, Part IV, certain things must be disregarded. Section 51 of the Code provides that the following must be disregarded— (a) ........................ (b) anything done in a State, if the thing is specified in, and specifically authorised by: (i) an Act passed by the Parliament of that State; or (ii) regulations made under such an Act.

s3 4 s4 Competition Policy Reform (Queensland—Natural Resources Exemptions) Regulation 1996 noncompetitive basis on behalf of the Crown under the native forest sawlog allocation system under the Forestry Act 1959 , section 46. 3 ˙ Water Resources Act 1989, s 231—specific authorisation 3. The following things are specifically authorised for the Trade Practices Act, section 51(1)(b) or the Competition Code of this jurisdiction, section 51 4 — (a) the terms determined by the chief executive under the Water Resources Act 1989 , section 231(4) 5 and specified in an approval for a proposal about a water allocation, limiting, on a noncompetitive basis, the right of an owner of land to use water under a water allocation; (b) the decision of the chief executive under the Water Resources Act 1989 , section 231(4) to refuse an application for an approval about a water allocation. ˙ Expiry 4. This regulation expires 2 years after it commences. 3 Section 46 (Corporation may sell forest products or quarry material the property of the Crown) 4 Competition Code of this jurisdiction, section 51 states that in deciding whether a person has contravened the Competition Code, Part IV, certain things must be disregarded. Section 51 of the Code provides that the following must be disregarded— (a) ........................ (b) anything done in a State, if the thing is specified in, and specifically authorised by: (i) an Act passed by the Parliament of that State; or (ii) regulations made under such an Act. 5 Section 231 (Agreements as to transfer of water under allocation)
