s1 3 s2 Local Government (Internal Boundaries Review) Regulation 1996 LOCAL GOVERNMENT (INTERNAL BOUNDARIES REVIEW) REGULATION 1996 [as amended by all amendments that commenced on or before 20 May 1997] † PART 1—PRELIMINARY ˙ Short title 1. This regulation may be cited as the Local Government (Internal Boundaries Review) Regulation 1996 . ˙ Purposes 2.(1) The purposes of this regulation are— (a) to implement reviewable local government matters recommended in reports of the commissioner; 1 and (b) to facilitate the implementation of the reviewable local government matters. (2) This regulation implements reviewable local government matters involving, for each local government mentioned in this regulation, 1 or more of the following— (a) divisional arrangements; (b) composition; (c) assignment of councillors to divisions. 1 Each report identified in this regulation may be inspected at the office of the Department of Local Government and Planning at 111 George Street, Brisbane and may also be inspected at the public office of the local government to which the report relates.

s3 4 s4 Local Government (Internal Boundaries Review) Regulation 1996 ˙ When implementation takes effect 3.(1) Each reviewable local government matter mentioned in part 2 for a local government, or for the local government area of a local government, takes effect— (a) for the purposes of the 1997 triennial elections for the mayor and councillors of the local government—on the commencing day; and (b) for any other purpose—on the concluding day for the local government. (2) In this section— “commencing day” means— (a) for a reviewable local government matter mentioned in section 8A, 8B, 8C, 8D, 16A, 17A, 19A, 19B, 19C, 19D, 19E, 21A, 21B, 22A or 25A—25 October 1996; and (b) for a reviewable local government matter mentioned in part 2, other than in a section mentioned in paragraph (a)—27 September 1996. “concluding day” , for a local government, means the conclusion of the 1997 triennial elections for the mayor and councillors of the local government. ˙ References to plans 4. In this regulation, a reference to a plan is a reference to a plan held by, and available for inspection in, the department. 2 2 The office of the Department of Local Government and Planning is located at 111 George Street, Brisbane. Each plan may also be inspected at the public office of the local government to which the plan relates.

s5 5 s6 Local Government (Internal Boundaries Review) Regulation 1996 † PART 2—IMPLEMENTATION OF REVIEWABLE LOCAL GOVERNMENT MATTERS ˙ Shire of Banana 5.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of September 1996 called ‘Review of divisional boundaries - Shire of Banana’. 3 (2) The local government area of the Shire of Banana is redivided into the 5 divisions shown on plan LGB8 edition 2. (3) The councillors of the Council of the Shire of Banana are assigned to the divisions as follows— (a) division 1—2 councillors; (b) division 2—2 councillors; (c) division 3—2 councillors; (d) division 4—2 councillors; (e) division 5—4 councillors. ˙ Shire of Belyando 6.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of July 1996 called ‘Review of divisional boundaries - Shire of Belyando’. 4 (2) The local government area of the Shire of Belyando is redivided into the 2 divisions shown on plan LGB13 edition 2. (3) The councillors of the Council of the Shire of Belyando are assigned to the divisions as follows— 3 The public office of the Council of the Shire of Banana is located at Prairie Street, Biloela. 4 The public office of the Council of the Shire of Belyando is located at the corner of Karmoo and Daintree Streets, Clermont.

s7 6 Local Government (Internal Boundaries Review) Regulation 1996 (a) division 1—5 councillors; (b) division 2—7 councillors. s 8A ˙ Shire of Biggenden 7.(1) This section implements the reviewable local government matter recommended in the report of the commissioner of July 1996 called ‘Review of composition - Shire of Biggenden’. 5 (2) The composition of the Council of the Shire of Biggenden is changed to the mayor and 6 other councillors. ˙ Shire of Boulia 8.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of August 1996 called ‘Review of divisional boundaries - Shire of Boulia’. 6 (2) The local government area of the Shire of Boulia is divided into the 2 divisions shown on plan LGB19 edition 2. (3) The councillors of the Council of the Shire of Boulia are assigned to the divisions as follows— (a) division 1—1 councillor; (b) division 2—6 councillors. ˙ City of Bundaberg 8A.(1) This section implements the reviewable local government matter recommended in the report of the commissioner of October 1996 called ‘Abolition of divisional boundaries - City of Bundaberg’. 7 5 The public office of the Council of the Shire of Biggenden is located at 47 Edward Street, Biggenden. 6 The public office of the Council of the Shire of Boulia is located at the corner of Herbert and Burke Streets, Boulia. 7 The public office of the Council of the City of Bundaberg is located at 188–190 Bourbong Street, Bundaberg.

s 8B 7 s 8C Local Government (Internal Boundaries Review) Regulation 1996 (2) The divisions of the local government area of the City of Bundaberg are abolished as shown on plan LGB23 edition 2. ˙ Shire of Burnett 8B.(1) This section implements the reviewable local government matter recommended in the report of the commissioner of October 1996 called ‘Abolition of divisional boundaries - Shire of Burnett’. 8 (2) The divisions of the local government area of the Shire of Burnett are abolished as shown on plan LGB59 edition 2. ˙ Shire of Caboolture 8C.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of July 1996 called ‘Review of divisional boundaries - Shire of Caboolture’. 9 (2) The local government area of the Shire of Caboolture is redivided into the 6 divisions shown on plan LGB27 edition 3. (3) The councillors of the Council of the Shire of Caboolture are assigned to the divisions as follows— (a) division 1—1 councillor; (b) division 2—1 councillor; (c) division 3—1 councillor; (d) division 4—1 councillor; (e) division 5—1 councillor; (f) division 6—1 councillor. 8 The public office of the Council of the Shire of Burnett is located at 9 Barolin Street, Bundaberg. 9 The public office of the Council of the Shire of Caboolture is located at 2 Hasking Street, Caboolture.

s 8D 8 Local Government (Internal Boundaries Review) Regulation 1996 s9 ˙ City of Caloundra 8D.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of September 1996 called ‘Review of divisional boundaries - City of Caloundra’. 10 (2) The local government area of the City of Caloundra is redivided into the 10 divisions shown on plan LGB30 edition 3. (3) The councillors of the Council of the City of Caloundra are assigned to the divisions as follows— (a) division 1—1 councillor; (b) division 2—1 councillor; (c) division 3—1 councillor; (d) division 4—1 councillor; (e) division 5—1 councillor; (f) division 6—1 councillor; (g) division 7—1 councillor; (h) division 8—1 councillor; (i) division 9—1 councillor; (j) division 10—1 councillor. ˙ Shire of Cambooya 9.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of July 1996 called ‘Review of composition and divisional boundaries - Shire of Cambooya’. 11 (2) The local government area of the Shire of Cambooya is redivided into the 4 divisions shown on plan LGB31 edition 2. 10 The public office of the Council of the City of Caloundra is located at 1 Omrah Avenue, Caloundra. 11 The public office of the Council of the Shire of Cambooya is located at 42 Hodgson Street, Greenmount.

(4) The councillors of the Council of the Shire of Cambooya are assigned to the divisions as follows— (a) division 1—2 councillors; (b) division 2—2 councillors; (c) division 3—2 councillors; (d) division 4—2 councillors. ˙ Shire of Chinchilla 10.(1) This section implements the reviewable local government matter recommended in the report of the commissioner of July 1996 called ‘Review of composition - Shire of Chinchilla’. 12 (2) The composition of the Council of the Shire of Chinchilla is changed to the mayor and 8 other councillors. ˙ Shire of Clifton 11.(1) This section implements the reviewable local government matter recommended in the report of the commissioner of July 1996 called ‘Review of composition - Shire of Clifton’. 13 (2) The composition of the Council of the Shire of Clifton is changed to the mayor and 6 other councillors. ˙ Shire of Crow’s Nest 12.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of September 1996 called 12 The public office of the Council of the Shire of Chinchilla is located at 80–86 Heeney Street, Chinchilla. 13 The public office of the Council of the Shire of Clifton is located at King Street, Clifton.

(3) The councillors of the Council of the Shire of Crow’s Nest are assigned to the divisions as follows— (a) division 1—3 councillors; (b) division 2—2 councillors; (c) division 3—3 councillors. ˙ Shire of Dalrymple 13.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of August 1996 called ‘Review of divisional boundaries - Shire of Dalrymple’. 15 (2) The local government area of the Shire of Dalrymple is redivided into the 4 divisions shown on plan LGB43 edition 3. (3) The councillors of the Council of the Shire of Dalrymple are assigned to the divisions as follows— (a) division 1—4 councillors; (b) division 2—2 councillors; (c) division 3—1 councillor; (d) division 4—1 councillor. ˙ Shire of Esk 14.(1) This section implements the reviewable local government matter recommended in the report of the commissioner of July 1996 called 14 The public office of the Council of the Shire of Crow’s Nest is located at Emu Creek Road, Crow’s Nest. 15 The public office of the Council of the Shire of Dalrymple is located at 12–14 Mosman Street, Charters Towers.

s 15 11 s 16 Local Government (Internal Boundaries Review) Regulation 1996 ‘Review of composition - Shire of Esk’. 16 (2) The composition of the Council of the Shire of Esk is changed to the mayor and 10 other councillors. ˙ Shire of Flinders 15.(1) This section implements the reviewable local government matter recommended in the report of the commissioner of July 1996 called ‘Review of composition - Shire of Flinders’. 17 (2) The composition of the Council of the Shire of Flinders is changed to the mayor and 8 other councillors. ˙ Shire of Gatton 16.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of August 1996 called ‘Review of divisional boundaries - Shire of Gatton’. 18 (2) The local government area of the Shire of Gatton is redivided into the 4 divisions shown on plan LGB54 edition 2. (3) The councillors of the Council of the Shire of Gatton are assigned to the divisions as follows— (a) division 1—5 councillors; (b) division 2—1 councillor; (c) division 3—3 councillors; (d) division 4—3 councillors. 16 The public office of the Council of the Shire of Esk is located at 2 Redbank Street, Esk. 17 The public office of the Council of the Shire of Flinders is located at 34 Gray Street, Hughenden. 18 The public office of the Council of the Shire of Gatton is located at the corner of Railway and North Streets, Gatton.

(3) The composition of the City of Hervey Bay is changed to the mayor and 8 other councillors. (4) The councillors of the Council of the City of Hervey Bay are assigned to the divisions as follows— (a) division 1—1 councillor; (b) division 2—1 councillor; (c) division 3—1 councillor; (d) division 4—1 councillor; (e) division 5—1 councillor; (f) division 6—1 councillor; (g) division 7—1 councillor; (h) division 8—1 councillor. ˙ Shire of Jondaryan 17.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of August 1996 called ‘Review of composition and divisional boundaries - Shire of Jondaryan’. 20 (2) The local government area of the Shire of Jondaryan is redivided into the 2 divisions shown on plan LGB71 edition 2. 19 The public office of the Council of the City of Hervey Bay is located at 77 Tavistock Street, Hervey Bay. 20 The public office of the Council of the Shire of Jondaryan is located at 64 Campbell Street, Oakey.

(4) The councillors of the Council of the Shire of Jondaryan are assigned to the divisions as follows— (a) division 1—4 councillors; (b) division 2—4 councillors. ˙ Shire of Kilkivan 17A.(1) This section implements the reviewable local government matter recommended in the report of the commissioner of September 1996 called ‘Abolition of divisional boundaries – Shire of Kilkivan’. 21 (2) The divisions of the local government area of the Shire of Kilkivan are abolished as shown on plan LGB73 edition 3. ˙ Shire of Kingaroy 18.(1) This section implements the reviewable local government matter recommended in the report of the commissioner of July 1996 called ‘Review of composition - Shire of Kingaroy’. 22 (2) The composition of the Council of the Shire of Kingaroy is changed to the mayor and 10 other councillors. ˙ Shire of Laidley 19.(1) This section implements the reviewable local government matter recommended in the report of the commissioner of July 1996 called 21 The public office of the Council of the Shire of Kilkivan is located at 26 Bligh Street, Kilkivan. 22 The public office of the Council of the Shire of Kingaroy is located at Glendon Street, Kingaroy.
