s1 3 s4 Legal Practitioners Regulation 1996 LEGAL PRACTITIONERS REGULATION 1996 [as amended by all amendments that commenced on or before 4 September 1998] 1 Short title This regulation may be cited as the Legal Practitioners Regulation 1996 . 2 Definition In this regulation— “financial period” see the Trust Accounts Act 1973 , section 4(1). 3 Solicitor with trust money to obtain and give certificate to society about compliance with the Act, section 51(2) (1) This section applies to a solicitor who is required under the Trust Accounts Act 1973 , section 16(1)(b) to give to the supervising entity an auditor’s report for a financial period. 1 (2) The solicitor must obtain from the auditor who conducts the audit, and give to the society, a certificate in the approved form about the solicitor’s compliance during the financial period with section 51(2) 2 of the Act. (3) The certificate must be given to the society within 14 days after the time within which the solicitor must give to the supervising entity an auditor’s report under the Trust Accounts Act 1973 , section 16(1)(b) for the financial period. (4) The time mentioned in subsection (3) includes any extension of the time approved under the Trust Accounts Act 1973 , section 16(2). 4 Evidentiary provisions (1) This section applies to a proceeding under this regulation. 1 Section 16 (Audit of trust accounts) 2 The Act, section 51(2) requires a certain amount of the moneys in the solicitor’s trust bank account to be deposited and kept deposited with the society.

s5 4 s5 Legal Practitioners Regulation 1996 (2) A signature purporting to be the signature of the chief executive is evidence of the chief executive’s signature. (3) A certificate purporting to be signed by the chief executive and stating a financial period for a solicitor is evidence of the financial period for the solicitor. (4) A certificate purporting to be signed by the society’s secretary and stating a solicitor did not give a certificate under section 3 by a stated date is evidence the solicitor did not give the certificate by the stated date. 5 Repeal All subordinate legislation made under the repealed Legal Assistance Act 1965 and in force under the Legal Practitioners Act 1995 at the commencement is repealed.
