title1.ThisrulemaybecitedastheHospitalsFoundation(TownsvilleGeneral Hospital
Foundation) Rule 1996.˙Definitions2.In
this rule—“Foundation”means the
Townsville General Hospital Foundation.“research
committee”means the Townsville General Hospital
ResearchCommittee established under section
4.“trust fund”means the trust
fund established under section 12.˙Research objects of the Foundation3.The research objects of the Foundation
are—(a)to seek to discover the nature,
origins and causes of disease andbodily
afflictions and to make the best use of knowledge gainedforimprovementofthemeansofpreventionortreatmentofdisease and bodily affliction; and(b)toresearch,orarrangeorpromoteresearch(includingsurveysrelevanttohealthserviceorhospitalfunctions)intoanddevelopmentof,anybranchofmedicalscience,technologicalresearch,medicalinvestigationorothermatterconcerningthe

health services.†PART 2—RESEARCH COMMITTEE˙Research committee is
established4.The Townsville General Hospital
Foundation Research Committee isestablished.˙Functions of research committee5.The functions of the committee
are—(a)the conduct of all matters relevant to
the research objects of theFoundation;
and(b)the administration of the trust
fund.˙Membership of committee6.(1)The research
committee consists of the following members—(a)thememberoftheFoundationwhohasresponsibilityfortheconductofactivitiesrelevanttotheresearchobjectsoftheFoundation and the administration of
the trust fund;(b)4 members who are suitably qualified
to assess activities relevantto the research
objects of the Foundation;(c)1 other
member.(2)A member mentioned in subsection
(1)(b) and (c) must be approvedby—(a)the Minister; and(b)thechiefexecutiveoftheCommonwealthdepartmentwhichadministers theNational Health
Act 1953(Cwlth).

research committee7.(1)Thechairpersonoftheresearchcommitteeisthemembermentioned in section 6(1)(a).(2)The chairperson presides at all
meetings at which the chairperson ispresent.(3)Ifthechairpersonisabsentfromameeting,thememberspresentmust
appoint a member to chair the meeting.†PART
3—MEETINGS OF RESEARCH COMMITTEE˙Meetings8.(1)Meetings of the research committee are to be
held at the times andplaces it decides.(2)However, it must meet at least once in each
period of 3 months.˙Quorum at meetings9.A
quorum of the research committee is 4 members.˙Procedure at meeting10.(1)Businessmaybeconductedatameetingoftheresearchcommittee only if
a quorum is present.(2)At a meeting—(a)aquestionisdecidedbyamajorityofthevotesofmemberspresent;
and(b)each member present has a vote on each
question to be decidedand, if the votes are equal, the
member presiding has a castingvote; and(c)if a member fails to vote, the member
is taken to have voted inthe negative.

provide report11.As soon as practicable after each
meeting of the research committee,the chairperson
must provide a report to the Foundation about the mattersdecided by the committee.†PART
4—TRUST FUND˙Trust fund12.(1)The
Foundation must establish a separate trust fund to be used
forfunds received for the research objects of
the Foundation.(2)Any funds received by the Foundation
for its research objectives, andany income
received by the Foundation from investment of the funds,
mustbe paid into the trust fund.(3)Anyfundsreceivedinthetrustfundmustbeusedforactivitiesrelevant to the
research objects of the Foundation and in accordance with
therecommendations of the research
committee.(4)The chairperson must administer the
trust fund, in accordance withthe
recommendations of the research committee.˙Closing trust fund13.(1)This
section applies if, in a year, the Foundation does not carry
outany activities relevant to the research
objects of the Foundation.(2)The Foundation
may, with the Minister’s consent or if directed by theMinister, close the trust fund.˙Application of Trusts Act 197314.To remove any doubt, theTrusts Act 1973applies to an
amount heldby the Foundation on trust even if the amount
is paid into the trust fund.

5—RESEARCH˙Researchtobeconductedinaccordancewithrecommendationsofcommittee15.The
chairperson must ensure that all activities relevant to the
researchobjectsoftheFoundationarecarriedoutinaccordancewiththerecommendations of the research
committee.˙Publication of research16.Thechairpersonmustmakepubliclyavailabletheresultsofallresearch financed by funds in the trust
fund and, if possible, must publishthe results in a
scientific or medicalpublication.
