s1 3 s3 Hospitals Foundation (Townsville General Hospital Foundation) Rule 1996 HOSPITALS FOUNDATION (TOWNSVILLE GENERAL HOSPITAL FOUNDATION) RULE 1996 [reprinted as in force on 19 September 1996] † PART 1—PRELIMINARY ˙ Short title 1. This rule may be cited as the Hospitals Foundation (Townsville General Hospital Foundation) Rule 1996 . ˙ Definitions 2. In this rule— “Foundation” means the Townsville General Hospital Foundation. “research committee” means the Townsville General Hospital Research Committee established under section 4. “trust fund” means the trust fund established under section 12. ˙ Research objects of the Foundation 3. The research objects of the Foundation are— (a) to seek to discover the nature, origins and causes of disease and bodily afflictions and to make the best use of knowledge gained for improvement of the means of prevention or treatment of disease and bodily affliction; and (b) to research, or arrange or promote research (including surveys relevant to health service or hospital functions) into and development of, any branch of medical science, technological research, medical investigation or other matter concerning the

s4 4 s6 Hospitals Foundation (Townsville General Hospital Foundation) Rule 1996 health or wellbeing of people, with a view to general improvement in health services. † PART 2—RESEARCH COMMITTEE ˙ Research committee is established 4. The Townsville General Hospital Foundation Research Committee is established. ˙ Functions of research committee 5. The functions of the committee are— (a) the conduct of all matters relevant to the research objects of the Foundation; and (b) the administration of the trust fund. ˙ Membership of committee 6.(1) The research committee consists of the following members— (a) the member of the Foundation who has responsibility for the conduct of activities relevant to the research objects of the Foundation and the administration of the trust fund; (b) 4 members who are suitably qualified to assess activities relevant to the research objects of the Foundation; (c) 1 other member. (2) A member mentioned in subsection (1)(b) and (c) must be approved by— (a) the Minister; and (b) the chief executive of the Commonwealth department which administers the National Health Act 1953 (Cwlth).

s 7 5 s 10 Hospitals Foundation (Townsville General Hospital Foundation) Rule 1996 ˙ Chairperson of the research committee 7.(1) The chairperson of the research committee is the member mentioned in section 6(1)(a). (2) The chairperson presides at all meetings at which the chairperson is present. (3) If the chairperson is absent from a meeting, the members present must appoint a member to chair the meeting. † PART 3—MEETINGS OF RESEARCH COMMITTEE ˙ Meetings 8.(1) Meetings of the research committee are to be held at the times and places it decides. (2) However, it must meet at least once in each period of 3 months. ˙ Quorum at meetings 9. A quorum of the research committee is 4 members. ˙ Procedure at meeting 10.(1) Business may be conducted at a meeting of the research committee only if a quorum is present. (2) At a meeting— (a) a question is decided by a majority of the votes of members present; and (b) each member present has a vote on each question to be decided and, if the votes are equal, the member presiding has a casting vote; and (c) if a member fails to vote, the member is taken to have voted in the negative.

As soon as practicable after each meeting of the research committee, the chairperson must provide a report to the Foundation about the matters decided by the committee. † PART 4—TRUST FUND ˙ Trust fund 12.(1) The Foundation must establish a separate trust fund to be used for funds received for the research objects of the Foundation. (2) Any funds received by the Foundation for its research objectives, and any income received by the Foundation from investment of the funds, must be paid into the trust fund. (3) Any funds received in the trust fund must be used for activities relevant to the research objects of the Foundation and in accordance with the recommendations of the research committee. (4) The chairperson must administer the trust fund, in accordance with the recommendations of the research committee. ˙ Closing trust fund 13.(1) This section applies if, in a year, the Foundation does not carry out any activities relevant to the research objects of the Foundation. (2) The Foundation may, with the Minister’s consent or if directed by the Minister, close the trust fund. ˙ Application of Trusts Act 1973 14. To remove any doubt, the Trusts Act 1973 applies to an amount held by the Foundation on trust even if the amount is paid into the trust fund.

s 15 7 s 16 Hospitals Foundation (Townsville General Hospital Foundation) Rule 1996 † PART 5—RESEARCH ˙ Research to be conducted in accordance with recommendations of committee 15. The chairperson must ensure that all activities relevant to the research objects of the Foundation are carried out in accordance with the recommendations of the research committee. ˙ Publication of research 16. The chairperson must make publicly available the results of all research financed by funds in the trust fund and, if possible, must publish the results in a scientific or medical publication.
