s1 3 s3 Superannuation (State Public Sector) Notice 1996 SUPERANNUATION (STATE PUBLIC SECTOR) NOTICE 1996 [as amended by all amendments that commenced on or before 11 January 2000] PART 1—PRELIMINARY ˙ Short title 1. This notice may be cited as the Superannuation (State Public Sector) Notice 1996 . ˙ Commencement 2. This notice commences on 1 February 1996. ˙ Definitions 3. In this notice— “1972 Act” means the repealed State Service Superannuation Act 1972 . “1972 fund” means the State Service Superannuation Fund established under the 1972 Act. “1972 officer” means a person who would be an officer within the meaning given by the 1972 Act if that Act had not been repealed. “1974 Act” means the repealed Police Superannuation Act 1974 . “1974 member” means a person who would be a member within the meaning given by the 1974 Act if that Act had not been repealed. “existing QFS officer” means a person who was a QFS officer on 30 April 1996. “existing QR employee” means a person who was a QR employee on 31 January 1995.
s4 4 s4 Superannuation (State Public Sector) Notice 1996 “new QR employee” means a person who starts being a QR employee on or after 1 February 1995. “QFS officer” means a person appointed to, or employed in, the Queensland Fire Service, and includes the person holding office as commissioner of the Queensland Fire Service. “QFS superannuation scheme” means the fire service superannuation scheme within the meaning of the Fire Service Act 1990 . “QR employee” means a person employed or engaged by Queensland Rail. PART 2—DEFINED BENEFIT CATEGORY ˙ Compulsory membership 4.(1) The following persons are eligible for membership of the scheme in the defined benefit category— (a) a person who— (i) starts to be employed or engaged by a unit of the State public sector on or after 1 January 1991; and (ii) would have been required to contribute to the 1972 fund if the person had started to be employed or engaged by a unit of the State public sector before 1 January 1991; (b) a person or member of a class of person specified in schedule 1, column 2 who is a permanent employee of, or permanently engaged by, the unit of the State public sector specified in schedule 1, column 1 opposite the specified person or class of person. (2) Membership of the scheme by a person mentioned in subsection (1) is compulsory. (3) Membership of the scheme by a person mentioned in subsection (1)(b) is subject to the special conditions (if any) specified in
s5 5 s5 Superannuation (State Public Sector) Notice 1996 schedule 1, column 3 opposite the specified person or class of person. (4) This section does not apply to— (a) a QR employee who was not a member of the scheme on 31 January 1995; and (b) a person to whom section 6B applies. ˙ Discretionary membership—general 5.(1) The following persons are eligible for membership of the scheme in the defined benefit category— (a) a person who— (i) starts to be employed or engaged by a unit of the State public sector on or after 1 January 1991; and (ii) would have been or become eligible but not required to contribute to the 1972 fund if the person had started to be employed or engaged by a unit of the State public sector before 1 January 1991; (b) a person who— (i) on 31 December 1990— (A) was an employee of, or engaged by, a unit of the State public sector; and (B) was not a contributor to the 1972 fund; and (ii) was at any time eligible but not required to contribute to the 1972 fund; (c) a person or member of a class of person specified in schedule 2, column 2 who is a permanent employee of, or permanently engaged by, the unit of the State public sector specified in schedule 2, column 1 opposite the specified person or class of person. (2) Membership of the scheme by a person mentioned in subsection (1) is discretionary.
s 6 6 s 6A Superannuation (State Public Sector) Notice 1996 (3) Membership of the scheme by a person mentioned in subsection (1)(c) is subject to the special conditions (if any) specified in schedule 2, column 3 opposite the specified person or class of person. (4) This section has effect subject to sections 6 to 6B. ˙ Discretionary membership—QR employees 6.(1) An existing QR employee who was under 24 on 31 January 1995 is eligible to become a member of the scheme in the defined benefit category before the person turns 25. (2) A new QR employee who is— (a) 24 or more when the person becomes a QR employee is eligible to become a member of the scheme in the defined benefit category within 1 year of becoming a QR employee; or (b) under 24 when the person becomes a QR employee is eligible to become a member of the scheme in the defined benefit category before the person turns 25. (3) The employee’s membership of the scheme is discretionary. (4) The employee may elect to become a member of the scheme only while the person is eligible for membership. (5) The election must be given by written notice to the chief executive of Queensland Rail. ˙ Discretionary membership—QFS officers 6A.(2) An existing QFS officer who started to be employed or engaged in the Queensland Fire Service before 1 April 1964 and has not contributed to the defined benefit account of the QFS superannuation scheme is eligible to become a member of the scheme in the defined benefit category. (3) The officer may elect to become a member of the scheme only while the person is eligible for membership. (4) The election must be made by written notice to the executive director, Government Superannuation Office.
s 6B 7 s 6C Superannuation (State Public Sector) Notice 1996 (6) An officer mentioned in subsection (2) becomes a member of the scheme on the day of the election. ˙ Discretionary membership—employees of WorkCover Queensland 6B.(1) This section applies to a person who— (a) was not a member of the scheme on 31 January 1997; and (b) starts employment with WorkCover Queensland on or after 1 February 1997; and (c) is approved by the board of WorkCover Queensland to be a member of the scheme. (2) The person is eligible to become a member of the scheme in the defined benefit category. (3) The person’s membership of the scheme is discretionary. PART 3—ACCUMULATION CATEGORY ˙ Compulsory membership 6C.(1) A person is eligible for membership of the scheme in the accumulation category if— (a) the person is employed— (i) by the State; or (ii) under a contract with a unit of the State public sector that is entirely or mainly for the person’s labour; or (iii) by a unit of the State public sector— (A) in an office or other position under a law of the State; or (B) to perform the duties of an office or other position under a law of the State; or (iv) by an entity mentioned in schedule 4; and
s 6D 8 s 6E Superannuation (State Public Sector) Notice 1996 (b) the person’s employment under paragraph (a) is not employment in relation to which the person is a member of the scheme in the defined benefit category or fire category; and (c) the person— (i) regularly works at least 10 hours a week for the person’s employer and receives a regular salary for the employment; or (ii) receives a yearly salary from the person’s employer that is at least 50% of the tax-free threshold for taxation purposes under the Income Tax Assessment Act 1936 (Cwlth); or (iii) receives a salary of at least $450 a month; and (d) the person is not mentioned in schedule 5. (2) Membership of the scheme by the person is compulsory. ˙ Approval of alternative superannuation scheme 6D. The Minister may approve a superannuation scheme for schedule 5, section 1, if the Minister is satisfied the scheme— (a) provides appropriate superannuation to satisfy the employer’s obligations; and (b) meets standards set for the management of superannuation funds under a law of the Commonwealth. PART 4—STATE 72 CATEGORY ˙ Discretionary membership (deed, s 165(8)) 6E.(1) This section applies if a person who is a State 72 member— (a) ceases to be a 1972 officer; and (b) within 1 month after ceasing, again becomes a 1972 officer.
s 6F 9 s 6G Superannuation (State Public Sector) Notice 1996 (2) The person is eligible for membership of the scheme in the State 72 category until the time 3 months after the time the person again became a 1972 officer. (3) Membership of the scheme by the person is discretionary. ˙ Discretionary membership (deed, s 191(2)) 6F.(1) This section applies if a person who is a State 72 member— (a) ceases to be a 1972 officer; and (b) has made an election under section 35(2) of the 1972 Act or makes an election under section 191(2) of the deed; and (c) again becomes a 1972 officer. (2) The person is eligible for membership of the scheme in the State 72 category until 3 months after the time the person again became a 1972 officer. (3) Membership of the scheme by the person is discretionary. PART 5—POLICE 74 CATEGORY ˙ Discretionary membership (deed, s 299(2)) 6G.(1) This section applies if a person who is a police 74 member— (a) ceases to be a 1974 member; and (b) has made an election under section 33(2) of the 1974 Act or makes an election under section 299(2) of the deed; and (c) again becomes a 1974 member. (2) The person is eligible for membership of the scheme in the police 74 category until 3 months after the time the person again became a 1974 member. (3) Membership of the scheme by the person is discretionary.
s 6H 10 Superannuation (State Public Sector) Notice 1996 s7 PART 5A—PRESERVATION CATEGORY ˙ Discretionary membership 6H.(1) A person is eligible for membership of the scheme in the preservation category if the person is the spouse of a member of the scheme. (2) Membership of the scheme by a person declared to be eligible under subsection (1) is discretionary. PART 6—EXCEPTIONS FROM THE ACT ˙ Excepted persons 7. The following persons are excepted from the Act— (a) a person who, under the Ambulance Service Act 1991 , section 2.14(2), elects to continue to contribute to the scheme mentioned in section 2.14(1) of that Act; (b) a person who— (i) is an employee of, or engaged by a unit of the State public sector while on leave from other employment; and (ii) continues as a member of a superannuation scheme operated for the other employment and to which the State has agreed to contribute as the person’s employer; (c) a person who— (i) is employed, or engaged by, an educational institution mentioned in schedule 3; and (ii) became a member of the scheme between 1 January 1991 and 30 June 1991; and
s 7 11 s 7 Superannuation (State Public Sector) Notice 1996 (iii) elected to become a member of the Superannuation Scheme for Australian Universities between 1 July 1991 and 31 December 1991; (d) a person who, on or after 1 July 1991, starts to be employed or engaged by an educational institution mentioned in schedule 3, other than a person who elected to remain a member of the scheme on— (i) transferring employment from the Queensland College of Arts to Griffith University as a result of the transfer from the College to the University of the function of providing higher education courses in art and design and is not a person mentioned in paragraph (e); or (ii) becoming an employee of Griffith University under the Griffith University and Queensland Conservatorium of Music Amalgamation and Miscellaneous Amendments Act 1991 , section 7; or (iii) transferring employment from the Townsville College of Technical and Further Education to James Cook University of North Queensland as a result of the transfer from the College to the University of the function of providing courses in art, craft and design at the diploma level; and (e) a person who— (i) on 1 January 1992, was employed or engaged by Griffith University because of the transfer to the University of the Queensland College of Arts’ functions of providing higher education courses in art and design; and (ii) became a member of the scheme between 1 January 1991 and 31 December 1991; and (iii) between 1 January 1992 and 30 April 1992, elected to become a member of the Superannuation Scheme for Australian Universities.
