1—PRELIMINARY˙Short title1.ThisconservationplanmaybecitedastheNatureConservation(Protected Plants
in Trade) Conservation Plan 1995.˙Commencement2.This
plan commences on 1 January 1996.˙Definitions3.In
this plan—“managementprogram”meanstheManagementProgramfortheManagement of
Protected Plants in Trade in Queensland 1995–1998.1“official tag”for a protected
plant means—(a)a tag supplied by the chief executive
for attaching to the plant; or(b)a
tag complying with the requirements of a conservation
authorityof another State for attaching to the
plant.“propagator’stag”foraprotectedplantmeansatagsuppliedbythepropagator and
approved by the chief executive for attaching to theplant.1Thisdocumentispublishedbythedepartmentandacopyisavailableforinspection at the department’s central
office and regional offices.

Conservation Plan 1995“protected plant”means an
endangered, vulnerable, rare or common plantin the
wild.“regulation”means theNature Conservation Regulation 1994.˙Expressions to
have meaning given in regulation4.An
expression that is not defined in this plan, but is defined in
theregulation, has the meaning given in the
regulation.˙Purpose of plan5.The
purpose of this plan is—(a)topromotethecontinuedexistenceinthewildofbiologicallyviable
populations of all taxa of protected plants; and(b)to allow ecologically sustainable
harvesting of protected plantsfrom the
wild.˙Application of plan6.For
the plants mentioned in the schedule, this plan applies only to
theplant parts cut for trade.†PART 2—ADMINISTRATION OF PLAN˙Administration of plan7.(1)This plan is to
be administered in conjunction with the managementprogram.(2)Ifthereisanyconflictbetweenthisplanandthemanagementprogram, the plan
prevails over the program.

replace management intent for protected plants8.Section 121(2) of the Act does not apply to
this plan.˙Declaration of harvest periods9.(1)Subjecttosection732oftheAct,thechiefexecutivemay,bywritten notice, declare a harvest period for
a protected plant.(2)The notice may impose conditions on
the taking of a protected plant,including, for
example, the maximum number of a species of plant or aparticular part of a plant a person may
take.(3)A person who takes a protected plant
during a harvest period mustcomply with the
conditions stated in the notice.Maximum
penalty—120 penalty units.†PART 3—TAKING,
USING AND KEEPINGPROTECTED PLANTS˙Restriction on taking under Aboriginal
tradition or Island custom10.(1)Taking a whole
endangered plant under Aboriginal tradition orIsland custom is
prohibited.(2)TakingpartofanendangeredplantunderAboriginaltraditionorIslandcustomisprohibitedotherthanunderanAboriginaltraditionorIsland custom authority granted under
the regulation.˙Restrictions on holder of commercial
wildlife harvesting licence11.A person who
takes a protected plant under a commercial wildlifeharvestinglicencemustnotselltheplantotherthantotheholderofa2Section 73
(Management principles of protected wildlife) of the
Act.

Conservation Plan 1995commercial wildlife licence.Maximum penalty—120 penalty units.˙Restrictions on holder of recreational
wildlife harvesting licence12.(1)The holder of a
recreational wildlife harvesting licence must nottake
more than—(a)if the holder is a recreational plant
society—20 protected plants ina month;
or(b)if the holder is an individual—50
protected plants in a year.Maximum
penalty—80 penalty units.(2)Despite
subsection (1), the holder of a recreational wildlife
harvestinglicencemustnottakemorethan10plantsofeachspeciesofthegenusAponogeton.Maximum penalty—80 penalty units.(3)Subsection (1)(a) does not apply to
the taking of a protected plant thatwould otherwise
have been lawfully destroyed.˙Harvested restricted plants to be
tagged13.Apersonwhotakesawholerestrictedplantunderawildlifeharvesting
licence must attach an official tag to the plant.Maximum penalty—120 penalty units.˙Restricted plants offered for sale to
be tagged14.(1)This section
applies to a whole restricted plant that is large enoughto
tag.(2)A person must not sell the plant
unless it is tagged—(a)if the plant was
taken from the wild or raised from seed or otherpropagating material taken from the
wild—with an official tag; or(b)if
the plant was raised from cultivated stock—with a
propagator’stag.

units.(3)Subsection (2)(b) does not apply
to—(a)acycad(familyCycadaceae)ifitscaudexdiameterissmallerthan 10 cm;
or(b)a grasstree (familyXanthorrhoeaceae) if its caudex
diameter issmaller than 10 cm; or(c)abird’snestfern(AspleniumnidusandAspleniumaustralasicum) if its longest
leaf is less than 40 cm long; or(d)a
staghorn (Platycerium grande) if its
diameter is smaller than10 cm; or(e)a
tassel fern (familyLycopodiaceae, other than a
blue tassel fern(Huperzia daehousieana))
if its longest stem is less than 15 cmlong.˙Prohibition on sale if not in pot
etc.15.(1)A person must
not sell a whole protected plant taken from thewild unless the
plant is in a pot or mounted on a slab or board.Maximum penalty—80 penalty units.(2)Subsection (1) does not apply
to—(a)Epiphytic orchids (familyOrchidaceae) if the sale is
by post, air,rail or road; or(b)plantsthatwouldotherwisehavebeenlawfullydestroyedbuthave been salvaged by a recreational
plant society.†PART 4—RECORDS AND RETURNS˙Records to be kept16.(1)Apersonwhoholdsacommercialwildlifeharvestinglicencemust
keep a record book.

under the regulation, must be made in the record bookmust
be made before the end of the day to which the entry
relates.3˙Returns17.(1)Apersonwhoholdsacommercialorrecreationalwildlifeharvesting licence must give the chief
executive a return of operations underthe
licence.(1A)The licensee
must give the chief executive the return—(a)for
each month during the harvest period—within 14 days afterthe
end of the month; and(b)for the harvest
period—within 14 days after the end of the harvestperiod.(2)A
person who attaches an official tag to a restricted plant must
givethe chief executive a monthly return stating
the number of each tag attachedduringthemonthandthenameofthespeciesofplanttowhichitwasattached.(3)The
return mentioned in subsection (2) must be given within 14
daysafter the end of the month to which it
relates.Maximum penalty for subsection (3)—120
penalty units.†PART 5—MISCELLANEOUS˙Conservation value18.No
conservation value is payable for a protected plant taken
underthis plan.3See

plan—Act, s 12419.(1)Anamendmentofthescheduleisanamendmenttowhichsection 124(2)(c)
of the Act applies.(2)However, an amendment of the schedule
to insert a species of plantmay be made only
if the amendment is to allow the export of the speciesunder
theWildlife Protection (Regulation of Exports
and Imports) Act 1982(Cwlth).˙Expiry20.This
plan expires on 31 December 1998.
