titleThis regulation may be cited as theCriminal Offence VictimsRegulation
1995.1APrescribed
injury(1)For section 20 of the Act, the
totality of the adverse impacts ofa sexual offence
suffered by a person, to the extent to whichthe impacts are
not otherwise an injury under section 20, isprescribed as an
injury.(2)Anadverseimpactofasexualoffenceincludesthefollowing—(a)a
sense of violation;(b)reduced self worth or
perception;(c)post-traumatic stress disorder;(d)disease;(e)lost
or reduced physical immunity;(f)lost
or reduced physical capacity (including the capacityto
have children), whether temporary or permanent;(g)increased fear or increased feelings of
insecurity;(h)adverse effect of the reaction of
others;(i)adverse impact on lawful sexual
relations;(j)adverse impact on feelings;(k)anything the court considers is an
adverse impact of asexual offence.(3)In
this section—sexual offencemeans a personal
offence of a sexual nature.

19952Scheme maximumTheprescribedamountforsection25(2)oftheAct,thescheme maximum, is $75000.2APrescribed amount to which court is
limited in making anorder for prescribed injuryTheprescribedamountforsection25(5)oftheActforaninjurymentionedinsection1Aisanamountequaltoanamountnotlessthan1%butnotmorethan100%ofthescheme maximum.13Prescribed amount for payment to
dependant of personwho is unlawfully killedTheprescribedamountforsection35(2)(a)oftheActis$30000.4Prescribed amount for payment of funeral
expenses todependant or member of family of person who
isunlawfully killed(1)The
prescribed amount for section 35(2)(b) and (3)(a) of theAct
is $6000.(2)Also, the prescribed amount for
section 35(2)(b) and (3)(a) ofthe Act is $6000
if—(a)an application made under section
35(2)(b) or (3)(a) ofthe Act before 19 July 2006 was not
decided before thatdate; and(b)no
other application for the same death was made undersection35(2)or(3)oftheActanddecidedbefore19July 2006.(3)To
remove any doubt, it is declared that if an application inrelation to a particular death was made
under section 35(2) or(3) of the Act and decided before 19
July 2006, the prescribedamountinrelationtothedeathis$4000,evenifanother1UndertheAct,section22(4),themaximumamountofcompensationprovidedunder
the Act, part 3 is reserved for the most serious cases and the
amounts providedin other cases are intended to be scaled
according to their seriousness.

2006.5Prescribed amount for payment of

prescribed amount for section 35(2)(c) and (3)(b) of theAct

35(2)(c) or (3)(b) ofthe Act before 19 July 2006 was not
decided before thatdate; and(b)no
other application for the same death was made undersection35(2)or(3)oftheActanddecidedbefore19July 2006.(3)To
remove any doubt, it is declared that if an application inrelation to a particular death was made
under section 35(2) or(3) of the Act and decided before 19
July 2006, the prescribedamountinrelationtothedeathis$2000,evenifanotherapplication for
the same death is made under section 35(2) or(3) of the Act
before or after 19 July 2006.
