s1 3 s4 Workplace Health and Safety (Confined Spaces) Compliance Standard 1995 WORKPLACE HEALTH AND SAFETY (CONFINED SPACES) COMPLIANCE STANDARD 1995 [reprinted as in force on 26 March 1996] ˙ Short title 1. This standard may be cited as the Workplace Health and Safety (Confined Spaces) Compliance Standard 1995 . ˙ Commencement 2. This standard commences on 1 February 1996. ˙ Purpose of standard 3. This standard gives legislative effect, so far as is possible under the Act, to the Joint National Standard for Safe Working in a Confined Space jointly prepared by the National Occupational Health and Safety Commission and the Standards Australia Committee on Work in Confined Spaces. ˙ Who standard applies to 4.(1) This standard applies to— (a) a designer, manufacturer or supplier of a confined space for use at a workplace; and (b) an employer or self-employed person at a workplace at which a confined space is used. (2) However, this standard does not apply to— (a) the construction of a tunnel; and (b) workplace health and safety risks not directly related to

s5 4 s5 Workplace Health and Safety (Confined Spaces) Compliance Standard 1995 characteristics of a confined space. Example of subsection (2)(b)— 1. Risk of slips, trips and falls. 2. Risks involved in carrying out particular tasks such as welding work. ˙ Compliance with standard 5.(1) If any of the following provisions of Australian Standard AS 2865—1995 ‘Safe working in a confined space’ applies to a person to whom this standard applies, the person must comply with the provision— (a) section 7 (Design, manufacture, supply and modification); (b) section 9.1 (Hazard identification); (c) section 10.1 and 10.2 (Risk assessment); (d) section 11.1, 11.8 and 11.18 (Control measures); (e) section 12.1 to 12.4, 12.10, 12.11 and 12.13 (Safety of the atmosphere); (f) section 13.1 to 13.3, 13.9 and 13.14 to 13.16 (Risk control); (g) section 14.1, 14.2, 14.7 and 14.10 (Education and training); (h) section 15.1 and 15.4 (Rescue and first aid); (i) section 16 (Record keeping). (2) If a provision mentioned in subsection (1) is amended, the amendment does not take effect for this section unless this standard expressly provides otherwise.
