REGULATION 1995[as amended by all amendments that commenced
on or before 6 December 1996]˙Short
title1.This regulation may be cited as
theLotteries Regulation 1995.˙Commencement2.ThisregulationcommencesonthedaytheLotteriesAct1994commences.˙Definition3.In
this regulation—“member”means a member
of the board.˙Remuneration and allowances4.A member is entitled to be paid the
fees and allowances fixed by theGovernor in
Council.˙Time and place of meetings5.(1)The board may
hold its meetings when and where it decides.(2)However, the board must meet at least once
every 3 months.(3)The chairperson—(a)may
at any time call a meeting of the board; and(b)must
call a meeting if asked by at least one quarter of the othermembers.
s64s7Lotteries Regulation 1995˙Conduct of proceedings6.(1)The
chairperson presides at all meetings of the board at which
thechairperson is present.(2)Ifthechairpersonisabsent,thememberchosenbythememberspresent presides.(3)At a
meeting of the board—(a)a quorum is at
least half the members; and(b)a
question is decided by a majority of the votes of the
memberspresent and voting; and(c)each
member present has a vote on each question to be decidedand,
if the votes are equal, the member presiding has a castingvote.(4)The
board may conduct its proceedings (including its meetings) as
itconsiders appropriate.(5)Theboardmayholdmeetings,orpermitmemberstotakepartinmeetings,bytelephone,closed-circuittelevisionoranotherformofcommunication.(6)Amemberwhotakespartinameetingoftheboardundersubsection (5) is
taken to be present at the meeting.(7)A
resolution is a valid resolution of the board, even though it is
notpassed at a meeting of the board, if—(a)at least half the members give written
agreement to the resolution;and(b)notice of the resolution is given
under procedures approved by theboard.˙Disclosure of interests7.(1)A member must
disclose to a meeting of the board the member’sdirectorindirectinterestinanissuebeingconsidered,orabouttobeconsidered, by the board if the
interest could conflict with the appropriateperformance of
the member’s duties about the consideration of the issue.(2)The disclosure must be recorded in the
board’s minutes and, unless

considers the issue, or take part in a decision of the board on
theissue.(3)Anothermemberwhoalsomustdiscloseaninterestintheissueunder subsection
(1) must not—(a)bepresentwhentheboardisconsideringitsdecisionundersubsection (2); or(b)take
part in making the decision.(4)If,
because of this section, a member is not present at a meeting of
theboard for the deliberation of the board about
an issue, but there would be aquorum if the
member were present, the remaining members present are aquorumfortheboard’sdeliberationordecisionabouttheissueatthemeeting.˙Minutes8.The
board must keep minutes of its proceedings.˙Continuation of existing agency
