plan may be cited as theNatureConservation(DuckandQuail)ConservationPlan1995.2Interpretation(1)In
this plan—“duck”means—(a)a plumed whistling-duck (Dendrocygnaeytoni);
or(b)a wandering whistling-duck (Dendrocygnaarcuata);
or(c)a maned wood duck (Chenonettajubata);
or(d)a grey teal (Anasgibberifrons); or(e)a Pacific black duck (Anassuperciliosa); or(f)a hardhead (Aythyaaustralis).“licensee”see section
6.1“quail”means—(a)a stubble quail (Coturnixpectoralis); or(b)a brown quail (Coturnixypsilophora).“regulation”means theNatureConservationRegulation1994.“use”a duck or quail
does not include sell for trade or commerce.(2)An
expression that is not defined in this plan, but is defined in
theregulation, has the meaning given by the

management program(1)This plan is to be administered in
conjunction with the ManagementProgram for Duck
and Quail in Queensland 1995–2000.4(2)Totheextentthatthereisanyinconsistencybetweenthemanagement program and this plan, the
plan prevails over the managementprogram.5Declaration of harvest periods(1)Subject to section 735of the Act, the chief executive may,
by writtennotice, declare a harvest period for a duck
or quail.(2)The notice may impose conditions on
the taking of a duck or quail,including, for
example—(a)the maximum number of ducks and quails
a person may, at anytime, have in possession at a place other
than the person’s usualplace of residence; and(b)the bag limit for a duck or quail;
and(c)the prohibition of lead shot for
taking a duck or quail.(3)A person who
takes a duck or quail under a notice declaring a harvestperiod
must comply with any conditions stated in the notice.Maximum penalty—120 penalty units.2Section 121 (Plan replaces interim or
declared management intent) of the Act3The
declared management intent in theNatureConservation(Wildlife)Regulation1994for
ducks and quails to which this plan applies is not affected by this
plan.4This document is published by the
department and is available for inspection orpurchase at the

ducks and quailsIf a harvest period is declared for a duck
or quail, a person who holds arecreational
wildlife harvesting licence for the duck or quail (a“licensee”)may,
under this plan—(a)take, keep or use the duck or quail in
the harvest period; or(b)keep or use the
duck or quail for 1 month after the harvest periodends.7Way
duck or quail must be harvested(1)Alicenseemaytakeaduckorquailonlybyshootingitwithashotgun that is no
more than 12 gauge in size.(2)A licensee must
not use a tethered live duck as a decoy for takingduck.(3)A licensee may
use a dog for retrieving a duck that has been shot orpointing, flushing or retrieving a
quail.(4)Ifaduckorquailisinjuredwhiletakingit,thelicenseemusthumanely kill it immediately on
retrieval.(5)A licensee must not take a duck or
quail before 6.00 a.m. or after6.00 p.m. on any
day.Maximum penalty—120 penalty units.8Moving duck or quail(1)A licensee may only move a duck or
quail taken under this plan tothe licensee’s
temporary accommodation or usual place of residence.(2)Untiltheduckorquailismovedtothelicensee’susualplaceofresidence or is prepared for cooking, the
licensee must ensure—(a)for a duck—a
fully feathered wing or the fully feathered head ofthe
duck is attached to the duck’s carcass; or(b)for a
quail—the feet or the fully feathered head of the quail isattached to the quail’s carcass.Maximum penalty—120 penalty
units.

executive a return of operations foreach harvest
period.(2)The return must be given to the chief
executive within 28 days afterthe end of the
harvest period to which it relates.10Conservation valueNo conservation
value is payable for a duck or quail harvested under thisplan.
