s1 3 s4 Government Owned Corporations Regulation 1995 Government Owned Corporations Regulation 1995 [as amended by all amendments that commenced on or before 6 August 2004] Part 1 Preliminary 1 Short title This regulation may be cited as the Government Owned Corporations Regulation 1995 . 3 References to entities In this regulation, a reference to a government entity is a reference to— (a) the entity when it is nominated to be a candidate GOC or declared to be a subsidiary of a candidate GOC; or (b) if the entity changes during the process of corporatisation of itself or another entity—the entity as it changes from time to time. 4 Responsible Ministers may decide limits of nominated entities To remove doubt during the process of corporatisation of government entities, the responsible Ministers may decide whether a specified part of a government entity is, or is not, taken to be included in— (a) an entity nominated to be a candidate GOC; or (b) an entity declared to be a subsidiary of a candidate GOC.
s5 4 s8 Government Owned Corporations Regulation 1995 Part 2 Candidate GOCs, GOCs and GOC subsidiaries 5 Candidate GOCs Each government entity mentioned in schedule 1 is nominated to be a candidate GOC. 6 Government entities declared to be GOCs under other regulations (1) Schedule 2 lists certain government entities that have been declared under other regulations to be GOCs. (2) Schedule 2 is included for information purposes. 1 7 Government entities that continue to be GOCs under this regulation Each government entity mentioned in schedule 3 continues under this regulation as a GOC. 8 GOC subsidiaries (1) Schedule 4 lists certain government entities that became subsidiaries of one or more GOCs under other regulations. (2) Schedule 4 is included for information purposes. 1 If a government entity is declared a GOC under another regulation, that regulation is repealed and the government entity continues as a GOC under section 7, the entity is not listed in schedule 2 but is listed in schedule 3.

It became a GOC under the Government Owned Corporations (Ports) Regulation 1995 . Under that regulation, it became a GOC on 1 July 1995 as soon as the assets and liabilities of the candidate GOC of which it was the associate became its assets and liabilities. 5 This entity is included in schedule 2 for information purposes only. Under the Government Owned Corporations (Ports) Regulation 1994 , Gladstone Port Authority became a GOC on 1 July 1994 as soon as the assets and liabilities of the candidate GOC of which it was the associate became its assets and liabilities. On 1 July 2004, under the Government Owned Corporations (Central Queensland Ports Authority) Regulation 2004 , section 12(1), Gladstone Port Authority’s name was changed to Central Queensland Ports Authority. 6 This entity is included in schedule 2 for information purposes only. It became a GOC under the Government Owned Corporations (Queensland Investment Corporation) Regulation 1994 . Under that regulation, it became a GOC on 1 October 1994. 7 This entity is included in schedule 2 for information purposes only. It became a GOC under the Government Owned Corporations (Queensland Rail) Regulation 1995 . Under that regulation, it became a GOC on 1 July 1995 as soon as the assets and liabilities of the candidate GOC of which it was the associate became its assets and liabilities.

On 2 July 1997, under the Government Owned Corporations (QTSC Restructure—Stage 2) Regulation 1997 , section 30(1), QTSC’s name was changed to the Queensland Transitional Power Trading Corporation. Under the Government Owned Corporations (QTSC Corporatisation) Regulation 1994 , section 9A, QTPTC is continued in existence even though the Government Owned Corporations (Queensland Transmission and Supply Corporation) Regulation 1994 is repealed. On 30 June 1999, under the Government Owned Corporations (QTSC Restructure—Stage 2) Regulation 1997 , section 30(1A), QTPTC’s name was changed to Queensland Power Trading Corporation. 9 These entities are included in schedule 2 for information purposes only. They became GOCs under the Government Owned Corporations (QGC Restructure—Stage 2) Regulation 1997 , section 21 (Declaration of each associate as GOC).

They became GOCs under the Government Owned Corporations (QTSC Restructure—Stage 2) Regulation 1997 , section 28 (Declaration of each regional corporation and QETC as GOC). 11 South East Queensland Electricity Corporation Limited changed its name to Energex Limited. 12 This entity is included in schedule 2 for information purposes only. It became a GOC under the Government Owned Corporations (Ergon Corporatisation) Regulation 1999 , section 5 (Declaration of Ergon as GOC). On 30 June 1999, by a scheme of arrangement under the Corporations Law, Capricornia Electricity Corporation Limited, Far North Queensland Electricity Corporation Limited, Mackay Electricity Corporation Limited, North Queensland Electricity Corporation, South West Queensland Electricity Corporation Limited and Wide Bay-Burnett Electricity Corporation Limited were deregistered and their respective assets, liabilities and undertakings were acquired by Ergon Energy Corporation Limited.

Energex Retail Pty Ltd is included in schedule 4 for information purposes only. It became (under the name Southern Electricity Retail Corporation) a GOC subsidiary under the Government Owned Corporations (QTSC Restructure—Stage 2) Regulation 1997 , section 21 (Declaration of GOCs and subsidiaries). 16 Central Electricity Retail Corporation Pty Ltd changed its name to Ergon Energy Pty Ltd. Ergon Energy Pty Ltd is included in schedule 4 for information purposes only. Its status as a GOC subsidiary was established under the Government Owned Corporations (CERC and NERC Restructure) Regulation 1998 , section 12 (Declaring changes about CERC and NERC). Ergon Energy Pty Ltd was formerly the subsidiary of Capricornia Electricity Corporation Limited, Far North Queensland Electricity Corporation Limited, Mackay Electricity Corporation Limited, North Queensland Electricity Corporation, South West Queensland Electricity Corporation Limited and Wide Bay-Burnett Electricity Corporation Limited. On 30 June 1999, by a scheme of arrangement under the Corporations Law, the 6 companies were deregistered and their respective assets, liabilities and undertakings, including the shares they held in Ergon Energy Pty Ltd, were acquired by Ergon Energy Corporation Limited.
