s1 3 s3 Auctioneers and Agents (Exemptions) Regulation 1995 AUCTIONEERS AND AGENTS (EXEMPTIONS) REGULATION 1995 [as amended by all amendments that commenced on or before 7 July 2000] ˙ Short title 1. This regulation may be cited as the Auctioneers and Agents (Exemptions) Regulation 1995 . ˙ Exemption for obtaining corporation licence—Bayersville Resource Recovery Centre Inc 3.(1) Bayersville Resource Recovery Centre Inc ( “Bayersville” ) is exempted from sections 19(3)(a), (b) and (c) and 125 1 of the Act. (2) The exemption applies only for the business of Bayersville, on its own behalf, acquiring used motor vehicles from a Mackay City Council refuse facility and— (a) breaking them up for sale, piecemeal; or (b) selling them piecemeal. (3) The exemption is on the following conditions— (a) Bayersville’s only place of business will at all times be at Mackay; (b) either— (i) the person in charge of the place of business must be a member of Bayersville’s management committee; or (ii) if the person in charge of the place of business is not a member of the management committee—a member of the management committee who holds an appropriate licence 1 Sections 19 (Corporation licence) and 125 (Directors to compensate fund) of the Act

s 5D 4 s 5E Auctioneers and Agents (Exemptions) Regulation 1995 must adequately supervise the conduct of the business of Bayersville mentioned in subsection (2). (4) The exemption is suspended for any period during which Bayersville is contravening a condition. (5) In this section— “appropriate licence” means a motor dealer’s licence under which the person may act as a motor dealer for the business mentioned in subsection (2). “management committee” , of Bayersville, means Bayersville’s management committee under the Associations Incorporation Act 1981. ˙ Exemption for obtaining corporation licence—Logan City Council 5D.(1) Logan City Council is exempted from sections 19(3)(a), (b) and (c) and 125 2 of the Act. (2) The exemption applies only for the business of Logan City Council, on its own behalf, acquiring used motor vehicles from the landfill recycling centre at 349 Browns Plains Road, Browns Plains and— (a) breaking them up for sale, in pieces; or (b) selling them in pieces. ˙ Exemption for obtaining motor dealers’ licence—person who is, or will be, the person in charge of the Browns Plains recycling centre 5E.(1) This section applies to a person who is applying for, or for the renewal or restoration of, a motor dealers’ licence for the purpose of becoming, or continuing to be, the person in charge of the landfill recycling centre at 349 Browns Plains Road, Browns Plains for section 19(3)(d)(i) of the Act. 2 Sections 19 (Corporation licence) and 125 (Directors to compensate fund) of the Act

s 5E 5 s 5E Auctioneers and Agents (Exemptions) Regulation 1995 (2) The person is exempted from section 57(1)(d) and (2)(b) 3 of the Act. (3) The exemption only applies for the business mentioned in section 5D(2). 3 Section 57 (Motor dealers’ licences) of the Act
