s1 5 s2 Local Government (Areas) Regulation 1995 Local Government (Areas) Regulation 1995 [as amended by all amendments that commenced on or before 1 July 2005] Part 1 Introduction 1 Short title This regulation may be cited as the Local Government (Areas) Regulation 1995 . Part 2 Local government areas 2 Declaration of local government areas etc. (1) This section and schedule 1 declare the following information about each local government mentioned in schedule 1— (a) its class; (b) its area and any divisions of the area; (c) the assignment of councillors to each division; (d) its composition. 1 (2) A local government’s area, and any divisions of the area, are shown on its area map. (3) Each area map is identified by a map number marked on the map. 1 The Local Government (Areas) Regulation 1995 took effect on 24 March 1995 for declaring the areas, name, jurisdiction and composition of the local governments mentioned in it. The regulation was made under what was then section 760(2) (Declaration of local government areas etc.) of the Act, which provided for a regulation to be made under what was then section 752 declaring every local government and its area, name, jurisdiction and composition.
s 2A 6 Local Government (Areas) Regulation 1995 s4 2A City of Brisbane (1) The electoral wards of the City of Brisbane are named in schedule 1A. (2) The external boundaries of the local government area of the City of Brisbane are shown on map LGB1 edition 6, sheets 1 to 4. (3) The electoral ward boundaries are shown on map LGB1 edition 6, sheets 5 to 30. (4) For each ward, the boundaries are shown on the sheet number of map LGB1 edition 6 stated in schedule 1A opposite the ward’s name. 3 Area maps must be available for inspection (1) The chief executive must— (a) ensure each local government mentioned in section 2A or schedule 1 has a copy of its area map; and (b) keep a copy of each area map available for inspection by anyone, during normal office hours, at the department’s head office. (2) A local government must keep a copy of its area map available for inspection by anyone, during normal office hours, at its public office. Part 3 Joint local governments Division 1 Existing joint local governments 4 Declaration of joint local government areas The information declared about joint local governments in the repealed Local Government (Joint Local Government Areas) Regulation 1995 (other than the information about the Central
s5 7 s7 Local Government (Areas) Regulation 1995 Highlands Regional Library Service) is relocated to, and reformatted in, schedule 2. 2 Division 2 Establishment of joint local governments 5 Application of division This division applies only to the extent necessary to give effect to— (a) schedule 2, part 1, item 5 and schedule 2, part 12; and (b) amendments to schedule 2 made after this division commences. 6 Declaration of joint local government areas—Act, s 42 (1) Each part of the State consisting of a grouping of local government areas mentioned in item 2 of a part of schedule 2 is declared to be a joint local government area. (2) In item 2 of a part of schedule 2, a reference to a plan is a reference to a plan held by, and available for inspection in, the department. 3 7 Establishment of joint local governments—Act, s 43 (1) A joint local government is established for each joint local government area declared under this division. 2 The Local Government (Joint Local Government Areas) Regulation 1995 took effect on 24 March 1995 for declaring the areas, name, jurisdiction and composition of the joint local governments mentioned in it. The regulation was made under what was then section 760(2) (Declaration of local government areas etc.) of the Act, which provided for a regulation to be made under what was then section 752 declaring every joint local government and its area, name, jurisdiction and composition. The Central Highlands Regional Library Service is not included in schedule 2 because it was abolished under the Local Government Legislation Amendment Regulation (No. 1) 1996 . 3 The office of the Department of Local Government, Planning, Sport and Recreation is located at 41 George Street, Brisbane.
s 8 8 s 10 Local Government (Areas) Regulation 1995 (2) A joint local government established under subsection (1) for a grouping of local government areas mentioned in item 2 of a part of schedule 2 has the name specified for the area in item 1 of the part. 8 Jurisdiction of joint local governments—Act, s 45 Each joint local government named in item 1 of a part of schedule 2 has the jurisdiction stated for the joint local government in item 4 of the part. 9 Representatives on joint local government—Act, s 48 For a joint local government mentioned in item 1 of a part of schedule 2, the number of representatives to which each component local government is entitled on the joint local government is stated in item 3 of the part. 10 Matters about establishment—Act, s 44 (1) An additional item of a part of schedule 2 has effect for the purposes of section 44 of the Act. (2) In this section— additional item means an item other than item 1, 2, 3 or 4.

25 Local Government (Areas) Regulation 1995 Schedule 2 Information about joint local governments section 4 Part 1 Caloundra–Maroochy water supply board 1 Joint local government Caloundra–Maroochy Water Supply Board. 2 Area The areas of Caloundra City Council and Maroochy Shire Council. 3 Composition Three members from each local government. 4 Jurisdiction Jurisdiction— (a) the planning, design, construction, management, maintenance and operation of— (i) water supply headworks consisting of a storage dam on Obi Obi Creek; and (ii) any other facility required for the supply of treated or untreated water in bulk to the joint local government area; (b) the treatment of water in bulk in the area; (c) the supply of treated or untreated water in bulk to— (i) Caloundra City Council and Maroochy Shire Council; and
26 Local Government (Areas) Regulation 1995 Schedule 2 (continued) (ii) other consumers inside or outside the area; (d) the sale of treated or untreated water in bulk, on conditions the joint local government considers appropriate, to— (i) Caloundra City Council and Maroochy Shire Council; and (ii) other consumers inside or outside the area; (e) the provision, maintenance, protection and operation of recreational facilities at the water supply headworks and on any other land owned by, or under the control of, the joint local government. 5 President (1) The members of the joint local government are to elect 1 of them as president of the joint local government. (2) An election for president is to take place at the first meeting of the joint local government held after the conclusion of each quadrennial election for the councillors of Caloundra City Council and Maroochy Shire Council. (3) The presidency is to alternate between a member who is a councillor of Caloundra City Council and a member who is a councillor of Maroochy Shire Council. (4) However, subsection (3) does not apply if at least 5 members of the joint local government vote against it. Part 2 Dalby–Wambo aerodrome board 1 Joint local government Dalby–Wambo Aerodrome Board.
27 Local Government (Areas) Regulation 1995 Schedule 2 (continued) 2 Area The areas of Dalby Town Council and Wambo Shire Council. 3 Composition Three members from each local government. 4 Jurisdiction The joint local government shall have and may exercise, perform, and assume within the limits of its area, all such powers, duties, and authorities, and shall be liable to such obligations as are conferred or imposed upon local governments by the provisions of the Act, with respect to the establishment, maintenance, and regulation of public aviation stations for the starting, landing, housing, and repair of aerial craft. Part 3 Dalby–Wambo library board 1 Joint local government Dalby–Wambo Library Board. 2 Area The areas of Dalby Town Council and Wambo Shire Council. 3 Composition Four members from Dalby Town Council and 2 members from Wambo Shire Council. 4 Jurisdiction Establishing, maintaining and conducting a library facility.

Part 4 Dalby–Wambo saleyards board 1 Joint local government Dalby–Wambo Saleyards Board. 2 Area The areas of Dalby Town Council and Wambo Shire Council. 3 Composition Three members from each local government. 4 Jurisdiction The acquisition, provision, construction, maintenance, management, control or regulation of stock saleyards in the joint local government’s area.
