regulation—codeofconductmeansthecodeofconductapplyinginrelationtoschoolchildrentravellingonpublicpassengervehicles approved by the chief executive
under section 62A.commercial scheduled service, for
schedule 1, means a publicpassenger service (other than a
community transport service, acourtesytransportservice,aschoolserviceandatouristservice)conductedonanestablishedrouteonaroadinaccordance with a regular timetable
for which the operator isremunerated—(a)from
revenue generated by passengers’ fares; or(b)bypaymentsfromanyoneelsefor,ortoprovide,theservice.excluded
routemeans any of the following routes—(a)Brisbane direct to, or from,
Cloncurry;(b)Brisbane direct to, or from, Mt
Isa;(c)Brisbane direct to, or from,
Toowoomba;

Provisions) Act 1989, section 2(1); or(b)a
school that is provisionally accredited, or accredited,undertheEducation(AccreditationofNon-StateSchools) Act
2001.

instrument that—(a)is able to record fares for individual
and multiple hiringof a taxi; and(b)is
designed to show the fare for each hiring.3ANotesA note in the
text of this regulation is part of the regulation.Part
2Approach4ApproachThisregulationreflectsanapproachconsistentwiththeobjectives of the
Act and based on—(a)allowingoperatorsscopetomeetemergingidentifiedneeds; and(b)holdingoperatorsaccountablefortheirperformance;and(c)placing the onus for compliance on
industry rather thanspecifying in detail how industry is
intended to act in allsituations; and(d)a
desire to ensure high levels of safety and the efficientmeeting of user needs.Part 3Operator accreditation anddriver authorisation5DefinitionIn this

or renewal of operator accreditation or driverauthorisation—Act, ss 17 and 29(1)The chief executive may grant operator
accreditation or driverauthorisationorrenewoperatoraccreditationordriverauthorisation,
other than restricted driver authorisation, if theapplicantforthegrantorrenewalcomplieswiththerequirements
under the Act, this regulation and any standardabout granting or
renewing the accreditation or authorisation.Note—Under section 28A of the Act, a person
convicted of a category A driverdisqualifyingoffenceisineligibletoapplyfororholddriverauthorisation.(2)Whengrantingorrenewingdriverauthorisation,thechiefexecutive may
impose a condition on the authorisation that thechief
executive considers necessary.(3)If
the chief executive imposes a condition on a person’s driverauthorisation, the chief executive must give
the person writtennotice of the chief executive’s
decision.(4)The notice must state—(a)the reasons for the decision;
and(b)that the person may apply within 28
days for review ofthe decision; and(c)how
the person may apply for review of the decision.(5)Subsection (2) is in addition to, and
does not limit, anotherprovision of this regulation under
which the chief executivemay impose a condition on a person’s
driver authorisation.7Term of operator
accreditation or driverauthorisation—Act, ss 17, 29 and
29A(1)An authority is for a term, stated in
the authority, of not longerthan 5
years.

for successive termsof not longer than 5 years.(3)Despitesubsection(1),restricteddriverauthorisationisforthe term in the authorisation, of not
longer than 1 year.(4)Despitesubsection(2),restricteddriverauthorisationisnotrenewable.17BRequirement to prove fitness(1)This section applies if—(a)astandardrequiresaperson(whenapplyingfor,orrenewing, a driver authorisation) to
provide evidence oftheirmedicalfitnesstooperateapublicpassengervehicle to an approved standard; and(b)thechiefexecutivereasonablyconsidersthemedicalfitness of the
holder of a driver authorisation no longermeets the
approved standard.(2)The chief executive may, by written
notice, require the holderto provide evidence of their medical
fitness to operate a publicpassenger vehicle to the approved
standard.7CRestricted driver authorisation—Act, s
29A(1)A prescribed operator may, on behalf
of the chief executive,grant a restricted driver
authorisation to a person authorisingthepersontooperateapublicpassengervehiclewhile,andonlywhile,itisbeingusedbytheoperatortoprovidetheservice.(2)A
restricted driver authorisation may only be granted on theprescribed operator’s initiative, and must
be in the approvedform.(3)Aprescribedoperatormustnotgrantarestricteddriverauthorisation to a person unless—1A fresh restricted driver
authorisation may be granted after the expiry of restricteddriver authorisation.

1994(a)theoperatorissatisfiedthepersoncomplieswiththerequirementsofanystandardapplyingtorestricteddriver
authorisation; and(b)the person gives the operator the
following informationabouttheperson,andtheoperatorhasnoreasontosuspect the information is false—(i)thepersonhasnotbeenconvictedofadriverdisqualifying
offence;2(ii)there is no
charge for a driver disqualifying offenceagainsttheperson,thathasnotbeenfinallydisposed
of;(iii)nodriverauthorisationgrantedtothepersonhasbeen cancelled or suspended.Maximum penalty for subsection (3)—20
penalty units.8Provisional operator accreditation or
driverauthorisation—Act, ss 18 and 30(1)The chief executive may grant an
authority to a person on aprovisional basis—(a)for
any authority—if the person meets some but not allthe
standards applying to the authority; or(b)for
operator accreditation—while the person’s criminalhistory is being checked.(2)A grant under subsection (1)(a) may be
subject to a conditionaboutthepersonmeetingallthestandardsapplyingtotheauthority within a specified
time.(3)Despite subsection (1), the chief
executive may grant driverauthorisationtoapersononaprovisionalbasiswithoutaformal application being made to ensure a
public passengerservice can continue to be provided in an
emergency.(4)A grant under subsection (3) is
subject to the condition thatthepersonwillmakeaformalapplicationfordriverauthorisation as
soon as practicable after the grant.2See

provisional basis may berefused, amended, suspended or
cancelled on the same basisas operator accreditation.(6)Driverauthorisationgrantedonaprovisionalbasismayberefused, amended,
suspended or cancelled on the same basisas driver
authorisation.9Refusal of operator accreditation—Act,
s 17(1)The chief executive may refuse to
grant operator accreditationto a person, or
to renew a person’s operator accreditation, if—(a)foranindividual—thepersonhasbeenconvictedofadisqualifyingoffenceorhasbeenchargedwithadisqualifying offence and the charge
has not been finallydisposed of; or(b)for a
member of a partnership—the person, or anothermemberofthepartnership,hasbeenconvictedofadisqualifyingoffenceorhasbeenchargedwithadisqualifying offence and the charge
has not been finallydisposed of; or(c)for a
corporation—the person, or an executive officer oftheperson,hasbeenconvictedofadisqualifyingoffence or has
been charged with a disqualifying offenceand the charge
has not been finally disposed of.(2)Thechiefexecutivemayalsorefusetograntoperatoraccreditationtoaperson,ortorenewaperson’soperatoraccreditation, if—(a)the
person does not comply with a standard applying tothe
operator accreditation; or(b)an operator
accreditation granted to the person has beencancelled or
suspended; or(c)the person has repeatedly engaged in
conduct that, in thechief executive’s opinion, is damaging to
the reputationof public passenger transport; or(d)the chief executive otherwise
considers it necessary inthe public interest.

chief executive may amend, suspend or cancel operatoraccreditation granted to a person if—(a)foranindividual—thepersonhasbeenconvictedofadisqualifying
offence; or(b)foramemberofapartnership—thepersonoranothermemberofthepartnershiphasbeenconvictedofadisqualifying offence; or(c)for a corporation—the person, or an
executive officer oftheperson,hasbeenconvictedofadisqualifyingoffence.(3)The chief executive may amend, suspend
or cancel operatoraccreditation granted to a person if—(a)foranindividual—thepersondoesnotcomplywithastandardapplyingtotheaccreditationorthechiefexecutive
otherwise considers it necessary in the publicinterest;
or(b)for a partnership—the person or
another member of thepartnership does not comply with a
standard applying totheaccreditationorthechiefexecutiveotherwiseconsiders it
necessary in the public interest; or(c)for a
corporation—the person, or an executive officer ofthe

cancelled, suspended forlongerthan3monthsorimmediatelysuspendedforanyperiod, the
person must, as soon as practicable but within 14days,
return the document evidencing the driver authorisationtothechiefexecutive,unlessthepersonhasareasonableexcuse.Maximum penalty—10 penalty units.(2)Ifaperson’sdriverauthorisationisamended,thechiefexecutive may, by
written notice, require the person to returnthe document
evidencing the driver authorisation, in a statedwayandwithinastatedtimeofatleast14days,foramendment.(3)Thepersonmustcomplywiththenotice,unlessthepersonhas a reasonable

the Act applies to the delegation of powersunder the Act,
sections 17 and 1814to—(a)the
Taxi Council of Queensland Inc.; or(b)the
Bus and Coach Association of Queensland Inc.; or(c)the Bus Operators Association
(Queensland) Inc.; or(d)the Limousine
Association Queensland Inc.(2)Section
28(2)15of the Act applies to the delegation
of powersunder sections 29 and 3016of
the Act to—(a)the Taxi Council of Queensland Inc.;
