1—PRELIMINARY˙Short title1.ThisregulationmaybecitedasthePrimaryProducers’(LevyonCane Growers) Regulation 19943–4.˙Definitions2.In
this regulation—“assigned”to a mill, in
relation to land, means the land is assigned to themill
under theSugar Industry Act 1991;“cane
testing”means the weighing, examining or testing of
sugarcane forits quantity, quality or condition;“grower”means grower of
sugarcane;“insurancecover”meanscoverbywayofaninsurancepolicy,compensationschemeorboth,toprotectagroweragainstfinancialloss caused by
water or fire damage to sugarcane;“mill”ofamillsuppliers’committeemeansthemillforwhichitisconstituted.

2—GENERAL LEVIES˙Cane Growers’ Council may make a
general levy3.(1)The Queensland
Cane Growers’ Council may make a general levyon growers for
administrative purposes.(2)This section
applies to the whole sugar industry.(3)The
levy is 12.5 cents per tonne of sugarcane delivered by a grower
toa mill.˙District cane growers’ executive may make a
general levy4.(1)A district cane
growers’ executive may make a general levy, foradministrative
purposes, on growers in its district.(2)Beforemakingalevyunderthissection,adistrictcanegrowers’executivemustobtaintheconsentoftheQueenslandCaneGrowers’Council.(3)The levy is the relevant amount set
out in Schedule 1.˙Maryborough District Cane Growers’
Executive may make a furthergeneral
levy5.(1)TheMaryboroughDistrictCaneGrowers’Executive(the“executive”) may make a
further general levy, for administration purposes,on
growers who supply sugarcane grown on land in the Mungar,
Pilerwa,Pioneers Rest, Yengarie or Yerra area to the
Maryborough Mill.(2)Before making a levy under this
section, the executive must obtain theconsent of the
Queensland Cane Growers’ Council.(3)Thelevyis0.25centspertonneofsugarcanegrownonlandmentioned in
subsection (1) and assigned to the Maryborough Mill.˙Mill suppliers’ committee may make a
general levy6.(1)Amillsuppliers’committeemaymakeagenerallevy,foradministrative purposes, on growers who
supply cane to its mill.

fund fire fighting equipment10.(1)The
Isis District Cane Growers’ Executive (the“executive”) maymake
a particular levy on growers supplying sugarcane to the Isis
CentralMill.(2)Before making a
levy under this section, the executive must obtain theconsent of the Queensland Cane Growers’
Council.(3)The levy is 4 cents per tonne of
sugarcane grown on land assigned tothe Isis Central
Mill.(4)Subjecttosection14(Applicationofunusedfundsraisedbyaparticular levy), the amount raised by
a levy made under this section may bespent only on
supplying fire fighting equipment, in conjunction with the
IsisShire Council, for the Childers Volunteer
Fire Brigade.˙Maryborough District Cane Growers’
Executive may make aparticular levy to fund certain costs of the
Canegrowers’ Building inMaryborough11.(1)TheMaryboroughDistrictCaneGrowers’Executive(the“executive”) may make a
particular levy on growers in its district.(2)Before making a levy under this section, the
executive must obtain theconsent of the Queensland Cane Growers’
Council.(3)The levy is 1 cent per tonne of
sugarcane grown on land assigned tothe Maryborough
Mill.(4)Subjecttosection14(Applicationofunusedfundsraisedbyaparticular levy), the amount raised by
a levy made under this section may be

only on rates, insurance, repairs, improvements and
administrationcosts for the Canegrowers’ Building at 10
Bazaar Street, Maryborough.˙Certain mill suppliers’ committees may make a
particular levy to effectinsurance cover12.(1)A
mill suppliers’ committee mentioned in Schedule 5 may make aparticular levy on growers who supply cane to
its mill.(2)Before making a levy under this
section, a mill supplier’s committeemust obtain the
consent of the Queensland Cane Growers’ Council.(3)The levy is the relevant amount set
out in Schedule 5.(4)Subjecttosection14(Applicationofunusedfundsraisedbyaparticularlevy),theamountraisedbyalevymadebyamillsuppliers’committee under
this section may be spent only on insurance cover for thegrowers who supply cane to its mill.˙Certain mill suppliers’ committees may
make a particular levy to fundcane
testing13.(1)A mill
suppliers’ committee mentioned in Schedule 6 may make aparticular levy on growers who supply cane to
its mill.(2)Before making a levy under this
section, a mill suppliers’ committeemust obtain the
consent of the Queensland Cane Growers’ Council.(3)The levy is the relevant amount set
out in Schedule 6.(4)Subjecttosection14(Applicationofunusedfundsraisedbyaparticularlevy),theamountraisedbyalevymadebyamillsuppliers’committee under
this section may be spent only on cane testing and researchand
development relating to cane testing for the growers who supply
cane toits mill.˙Plane
Creek Central Mill Suppliers’ Committee may make aparticular levy to fund certain costs of a
proposal for a sugarcanerailway line13A.(1)The
Plane Creek Central Mill Suppliers’ Committee may make
a

sugarcane to the Plane Creek CentralMillanddeliverthesugarcanetoaplaceatornear1ofthefollowingplaces—(a)Mount Christian;(b)Ilbilbie;(c)West
Hill;(d)Orkabie;(e)Tinerta;(f)Karloo;(g)Carmila;(h)Carmila West;(i)Flaggy Rock.(2)Beforemakingalevyunderthissection,themillsuppliers’committeemustobtaintheconsentoftheQueenslandCaneGrowers’Council.(3)The levy is 36 cents per tonne of
sugarcane supplied by the grower tothe mill.(4)Subjecttosection14(Applicationofunusedfundsraisedbyaparticular levy), the amount raised by
a levy made under this section may bespent only on
investigations, feasibility studies and other costs relating to
theproposalfortheconstructionofasugarcanerailwaylinebetweenthejunction of the railway line at the
township of Koumala and the place knownas Karloo.˙Plane Creek Central Mill Suppliers’
Committee may make a furtherparticular levy to
fund construction of a sugarcane railway line13B.(1)The
Plane Creek Central Mill Suppliers’ Committee may make afurther particular levy on growers who supply
sugarcane to the Plane CreekCentral Mill
and—(a)deliver the sugarcane to a place at or
near—(i)an existing or proposed section of the
railway line mentioned

Schedule 7; or(ii)Carmila, Carmila
West, or Beach Road, Carmila; or(b)grow
the sugarcane in a place known as Flaggy Rock south ofgridreferenceAMG7571000mNonCarmilamapnumber 8754.1(2)Beforemakingalevyunderthissection,themillsuppliers’committeemustobtaintheconsentoftheQueenslandCaneGrowers’Council.(3)The levy is—(a)foragrowermentionedinsubsection(1)(a)(i)—therelevantamount specified in Schedule 7; and(b)foragrowermentionedinsubsection(1)(a)(ii)—theamountcalculated at the rate of $1.57 per tonne of
sugarcane supplied bythe grower to the mill; and(c)foragrowermentionedinsubsection(1)(b)—theamountcalculated at the rate of $1.72 per tonne of
sugarcane supplied bythe grower to the mill.(4)The levy may be made for not more than
10 consecutive sugarcanecrushing seasons of the mill, starting
with the 1995 crushing season.(5)Subjecttosection14(Applicationofunusedfundsraisedbyaparticular levy), the amount raised by
a levy made under this section may bespent only on the
following costs of the sugarcane railway line between thejunction of the railway line at the township
of Koumala and the place knownas Karloo—(a)administration and development;(b)construction;(c)repayment of loans for the costs mentioned
in paragraphs (a) and(b).1The
map may be inspected at the office of the Department of Lands at
the cornerof Wood and River Streets,
Mackay.

particular levy14.If—(a)a
particular levy is made by a district cane growers’ executive or
amill suppliers’ committee under this
regulation; and(b)afterapplyingtheamountraisedtothepurposeforwhichtheparticular levy was made, a balance
remains;the balance may be spent on administrative
purposes in the interests of thegrowers on whom
the particular levy was made.†PART
4—POLLS REGARDING PARTICULARLEVIES˙Limitation on power to make a
particular levy15.(1)A body empowered
to make a particular levy under Part 3 maymake the levy
from—(a)for a levy other than under section
13A or 13B—14 June 1994; or(b)for
a levy under section 13A or 13B—19 July 1994.(2)Despite subsection (1), the body must not
make the levy if, on a pollheld under the
Act, the majority of votes is against the making of the
levy.˙Request to hold a poll16.(1)In this
section—“affected grower”,inrelationtoaparticularlevy,meansagroweronwhom
the particular levy may be made under this regulation.(2)Before a particular levy is made, an
affected grower may request theMinister, in
writing, to hold a poll of affected growers, to decide whether
theparticular levy will be made.(3)A request must be sent to the Minister
by—

July 1994.(4)A request may be sent to the following

Box 46Brisbane Q 4000.˙Conduct of poll17.(1)Forthepurposesofsection30(8A)oftheAct,thissectionprescribes the procedure for holding a poll
before a particular levy is made.(2)The
Minister must by Gazette notice declare—(a)a
poll is to be held; and(b)the name of the
returning officer appointed by the Minister for thepurposes of the poll; and(c)the last day (the“polling
day”) and time for the return of ballotpapers to the returning officer; and(d)the form of the official roll of
persons eligible to vote in the poll;and(e)theday,atleast30daysbeforethepollingday,onwhichtheofficial roll is to close; and(f)the form of the ballot paper;
and(g)the requirements for making a valid
vote.(3)After the poll is held, the Minister
must by Gazette notice declare theresult of the
poll.

5—DUTIES OF MILL OWNERS˙Mill owner to
deduct levy18.(1)A mill owner
must deduct, from the amount payable to a growerforsugarcanesuppliedtothemill,theamountofalevypayablebythegrower under this
regulation in respect of the sugarcane.(2)For
the purposes of this section, it is irrelevant whether or not
thesugarcane was grown on land assigned to the
mill.Maximum penalty—(a)the
amount that was not deducted; or(b)20
penalty units;whichever is less.˙Mill
owner to keep records19.Amillownermustrecordthefollowinginformationabouttheamountdeducted,inrespectofsugarcanesuppliedtothemill,undersection 18 (Mill
owner to deduct levy)—(a)the name of the
mill;(b)the name of the mill to which the land
on which the sugarcanewas grown is assigned;(c)the period over which the sugarcane
was supplied to the mill;(d)the tonnage of
the sugarcane supplied;(e)the amount
deducted.˙Mill owner to deliver deducted levy and
records20.A mill owner must, within 7 days after
deducting the amount of alevy under section 18 (Mill owner to
deduct levy), send to the body thatmade the
levy—(a)the amount deducted; and

less.†PART 6—PAYMENT AND RECOVERY OF
LEVIES˙Growers must pay levies21.A grower must pay a levy made under
this regulation.Maximum penalty—(a)the
amount of the levy; or(b)20 penalty
units;whichever is less.˙Recovery of levies22.TheQueenslandCaneGrowers’Council,adistrictcanegrowers’executiveoramillsuppliers’committeemayrecoveranamountithaslevied on a person (the“person liable”) under this
regulation from—(a)the person liable; or(b)a person holding money to the credit
of the person liable;as a debt in a court of competent
jurisdiction.
