regulation is a code for IDAS.13Interaction between this regulation

matters not withinthe scope of this regulation.(3)Forthefollowing,thealternativeprovisionsoralternativeacceptablesolutionsapplyasiftheywerepartofthisregulation—(a)abuildingcertifierassessing,undersection11,5abuildingdevelopmentapplicationforcompliancewiththealternativeprovisionsoralternativeacceptablesolutions;(b)abuildingdevelopmentapplicationrequiringadvicefrom the local
government under section 20;6(c)appealingadecisiononabuildingdevelopmentapplicationtowhichthealternativeprovisionsoralternative acceptable solutions
apply.7(4)However, for part
3, subsection (3) applies only if the buildingdevelopmentapplicationisfordevelopmentthatisexemptdevelopment or

regulation—AIBSmeans the Australian Institute of
Building Surveyors.allotmentmeans a separate,
distinct parcel of land on which abuilding is to be
built, or is built.alternative acceptable solutionsee

part of QDC applies to anaspect of work for which a concurrence
agency is stated undertheIntegratedPlanningRegulation1998,subsection(1)(a)does
not apply to the extent assessment of the work againstthe
part is within the concurrence agency’s jurisdiction.(2)Iftheapplicationismadetotheassessmentmanager,theassessment manager in deciding the
application must base thedecision on the building certifier’s
assessment.21(3)Subsection (1)(b)
does not apply to the extent the applicationhas already been
assessed for compliance with the local law orlocal planning

variedby the chief executive;24or(ii)thepartsofthebuildingwork,towhichthedeemed-to-satisfyprovisionsofBCAapply,comply with the provisions; and(b)must not decide the application
against the objectives orfunctional statements of BCA;
and(c)may refer to the objectives and
functional statements ofBCAtoassistthebuildingcertifierininterpretingtheperformance requirements of BCA.13Certificate of conformity(1)Ifthereisacurrentrecognisedcertificateaboutabuildingelement, the
element is, to the extent stated in the certificate,taken
to comply with the BCA.(2)In this
section—building elementmeans the
properties and performance of amaterial, system,
method of building or other thing relating tobuilding
work.recognisedcertificatemeansacertificateofconformityissued by the
Australian Building Codes Board or under thescheme know as
the CodeMark Scheme administered by theAustralian
Building Codes Board.13ABuilding

self-assessable development;(e)if
the building work requires site works that are—(i)assessableagainstthisregulation—howthesiteworks comply with the Act; or(ii)self-assessableagainstthisregulation—thesiteworks’ location and type.(3)If an application document proposes

not be approved, unless the special structure—(a)complies with this regulation; and(b)will reasonably provide for—(i)the safety of persons using the
structure if there is afire (including means of egress);

the floating building is likely to be subjectincludingdeadloads,liveloadsandwindloadscalculatedinaccordancewiththisregulationandloads
resulting from—(A)water turbulence; or(B)flooding of the waterway; or(C)tidal action; or(D)waterfloodingassociatedwithfirefightingor accidental
cause; or(E)accidental impact; and(ii)tomaintainaminimumfreeboard,beingthemeasurement from the waterline to the top
edge ofthe flotation system at the point where it
has theleast dimension under the action of dead and
liveloads only, of not less than 400mm;
and(iii)so that the
metacentre is always above the centre ofgravity when the
floating building is tilted and sothat the
