2002]1Short titleThisregulationmaybecitedastheWaterResources(WatercourseProtection)
Regulation 1993.2Destruction of
vegetation in a watercourse(1)Thedestructionofvegetationinawatercourseispermittedifthedestruction is performed by a person
under—(b)alicence,permit,leaseorauthoritytoprospectunderthePetroleum Act 1923; or(c)a tree clearing permit under
theLand Act 1962, section 250;
or(d)a licence under theMining (Fossicking) Act 1985.(2)The destruction
of a noxious plant under theRural Lands
ProtectionAct 1985is permitted in
a watercourse.3Excavation in a watercourseExcavation in a watercourse is permitted if
the excavation is performedby a person
under—(b)alicence,permit,leaseorauthoritytoprospectunderthePetroleum Act 1923; or(c)a licence under theMining (Fossicking) Act 1985.4Placing of fill in
a watercourseThe placing of fill in a watercourse is
permitted if—(a)the placing of the fill is performed by
a person under a licence,permit,leaseorauthoritytoprospectunderthePetroleumAct1923;

made by a person fossickingunder a licence
under theMining (Fossicking) Act 1985.5Matters permitted
for environmental authorities for miningactivitiesThe
following activities are permitted in a watercourse, lake or spring
ifthepersoncarryingouttheactivityisactingunderanenvironmentalauthority(miningactivities)undertheEnvironmentalProtectionAct1994—(a)the
destruction of vegetation;(b)excavation;(c)the
placing of fill.
