s1 3 s4 Water Resources (Watercourse Protection) Regulation 1993 WATER RESOURCES (WATERCOURSE PROTECTION) REGULATION 1993 [as amended by all amendments that commenced on or before 19 April 2002] 1 Short title This regulation may be cited as the Water Resources (Watercourse Protection) Regulation 1993 . 2 Destruction of vegetation in a watercourse (1) The destruction of vegetation in a watercourse is permitted if the destruction is performed by a person under— (b) a licence, permit, lease or authority to prospect under the Petroleum Act 1923 ; or (c) a tree clearing permit under the Land Act 1962 , section 250; or (d) a licence under the Mining (Fossicking) Act 1985 . (2) The destruction of a noxious plant under the Rural Lands Protection Act 1985 is permitted in a watercourse. 3 Excavation in a watercourse Excavation in a watercourse is permitted if the excavation is performed by a person under— (b) a licence, permit, lease or authority to prospect under the Petroleum Act 1923 ; or (c) a licence under the Mining (Fossicking) Act 1985 . 4 Placing of fill in a watercourse The placing of fill in a watercourse is permitted if— (a) the placing of the fill is performed by a person under a licence, permit, lease or authority to prospect under the Petroleum Act 1923 ; or

s5 4 s5 Water Resources (Watercourse Protection) Regulation 1993 (b) the fill is placed in an excavation made by a person fossicking under a licence under the Mining (Fossicking) Act 1985 . 5 Matters permitted for environmental authorities for mining activities The following activities are permitted in a watercourse, lake or spring if the person carrying out the activity is acting under an environmental authority (mining activities) under the Environmental Protection Act 1994— (a) the destruction of vegetation; (b) excavation; (c) the placing of fill.
