s1 3 s4 Tobacco Products (Licensing) Regulation 1993 TOBACCO PRODUCTS (LICENSING) REGULATION 1993 [reprinted as in force on 17 December 1993] 1 Short title This regulation may be cited as the Tobacco Products (Licensing) Regulation 1993 . 2 Forms (1) If a provision of the Act or this regulation requires or permits a person to use a prescribed or approved form— (a) the Commissioner must approve a form for the purpose of the provision; and (b) the form approved by the Commissioner is the prescribed or approved form for the purpose of the provision. (2) A person may ask the Commissioner for a document setting out the form approved by the Commissioner for a purpose. (3) The Commissioner must promptly comply with the request. 3 Application for renewal of a licence An application for renewal of a licence under section 23(2) of the Act must be in the approved form. 4 Records—tobacco wholesaler (1) For the purpose of section 40(1)(a) of the Act, the records mentioned in subsection (2) are prescribed for a person who carries on tobacco wholesaling. (2) Each time the person sells tobacco, in the course of tobacco wholesaling, the person must record— (a) the date of sale; and

s5 4 s5 Tobacco Products (Licensing) Regulation 1993 (b) the type of product sold; and (c) the quantity sold; and (d) the sale price; and (e) the purchaser’s name and address; and (f) if the purchaser is the holder of a tobacco wholesaler’s licence or a group tobacco wholesaler’s licence—the licence number. (3) It is a sufficient compliance with subsection (2) to keep an invoice, or a copy of an invoice, that contains the particulars mentioned in subsection (2). 5 Records—tobacco retailer (1) For the purpose of section 40(1)(a) of the Act, the records mentioned in subsection (2) are prescribed for a person who carries on tobacco retailing. (2) Each time the person purchases tobacco, in the course of tobacco retailing, the person must record— (a) the date of purchase; and (b) the type of product purchased; and (c) the quantity purchased; and (d) the purchase price; and (e) the seller’s name and address; and (f) if the seller is the holder of a licence under the Act—the licence number. (3) It is a sufficient compliance with subsection (2) to keep an invoice, or a copy of an invoice, that contains the particulars mentioned in subsection (2).
