1—PRELIMINARY˙Short title1.Thisby-lawmaybecitedastheBrisbaneCricketGroundBy-law19933–4.˙Definitions2.In
this by-law—“authorised officer”forapower,meansanofficeroremployeeoftheTrust authorised in writing by the
Board to exercise the power;“grounds”means the Brisbane Cricket Ground, and
includes all structuresand other improvements on the
land;“liquor”has the meaning
given under theLiquor Act 1992;“member of the ground”means a person
approved by the Board underPart 3 as a
member of the ground;“occupier”means a person
to whom the Trust has given a lease over, or aright to occupy
or use, the grounds, or part of the grounds;“secretary”means the secretary of the Trust;“year”means a period
of 12 months beginning on 1 April.

1993†PART 2—MEETINGS˙Deputy
chairperson3.At the first meeting of the Board held
each year the trustees must electa trustee, other
than the chairperson, to be deputy chairperson.˙Presiding officer4.(1)Thechairpersonmustpresideatallmeetingsatwhichthechairperson is present.(2)If
the chairperson is absent, the deputy chairperson must
preside.(3)If both the chairperson and the deputy
chairperson are absent, thetrustee chosen by
the trustees present must preside.˙Time
and place of meetings5.(1)Meetings of the
Board are to be held at the times and places theBoard
decides.(2)However, the Board must meet at least
once every 3 months.(3)The secretary must call a special
meeting of the Board—(a)at the
chairperson’s request; or(b)onthewrittenrequestof3trusteesstatingthebusinesstobeconsidered at the meeting.˙Notice of meetings6.(1)The
secretary must give each trustee at least 3 clear days
writtennotice of the time, day and place of each
meeting of the Board.(2)The notice must
state the business to be considered at the meeting.(3)The only business that may be
discussed at a special meeting is thebusiness
mentioned in the notice.

1993˙Attendance by electronic link7.(1)The Board may
hold meetings, or permit trustees to take part inmeetings,bytelephone,closed-circuittelevisionoranotherformofcommunication.(2)A
trustee who takes part in a meeting of the Board permitted
undersubsection (1) is taken to be present at the
meeting.˙Meetings by written resolution8.If—(a)all
trustees agree, in writing, to a proposed resolution; and(b)noticeoftheproposedresolutionwasgivenunderproceduresapproved by the
Board;the resolution is a valid resolution of the
Board, even though it was notpassed at a
meeting of the Board.˙Quorum and voting
at meetings9.(1)At a meeting of
the Board—(a)3 trustees form a quorum; and(b)each question must be decided by a
majority of the votes of thetrustees present
and voting; and(c)each trustee present has a vote on
each question to be decided and,if the votes are
equal, the question must be taken to be resolved inthe
negative.(2)Despitesubsection(1)(b),foraquestiontobedecided,atleast3trustees must vote for the question.(3)The trustee presiding at the meeting
has only a deliberative vote.˙Adjournment10.(1)The
trustees present at a meeting of the Board may adjourn themeeting at any time.(2)If a
quorum is not present within 30 minutes after a meeting is due
to

1993start, it may be adjourned for not more than
14 days by—(a)the trustees present; or(b)if no trustees are present—the
secretary.˙Minutes11.The
Board must keep minutes of its proceedings.†PART
3—MEMBERSHIP OF GROUND˙Membership numbers
and terms of membership12.The Board may
decide—(a)the number of persons who may be
members of the ground; and(b)the terms of
membership, including the payment of fees; and(c)the
terms that apply to members’ guest tickets.˙Application for membership13.(1)Any person may
apply to the Trust to become a member of theground.(2)The Board may only grant—(a)senior membership to an applicant who
is 18; and(b)junior membership to an applicant who
is 12 but not 18.(3)The application must be—(a)in the form approved by the Board;
and(b)given to the secretary.˙Membership decisions14.(1)The Board may
fill a vacancy in membership of the ground at any

1993time.(2)The Board may
refuse an application for membership of the groundor a
renewal of membership.(3)If the Board
refuses an application or renewal under subsection (2), itmust
give the applicant or member written reasons for its
decision.˙Life and honorary members15.(1)The Board may,
by unanimous vote of the trustees, elect honorarylife
members of the ground.(2)TheBoardmaygranthonorarymembershipofthegroundtoaperson for a specific occasion or for
up to 1 year.˙Rights of membership16.A member of the ground is entitled
to—(a)1 non-transferable admission ticket to
the members’ reserve; and(b)the right to
acquire 1 transferable member’s guest ticket.˙Suspension and cancellation of
membership17.(1)If the Board is
satisfied a member of the ground has—(a)harmed the Trust’s character or interests;
or(b)unreasonablyinterferedwiththecomfortandwelfareofothermembers;the
Board may, by written notice, call on the member to show cause,
withinthe reasonable time specified in the notice,
why the member’s membershipshould not be
suspended or cancelled.(2)If the member
does not show cause to the satisfaction of the Board,the
Board may suspend or cancel the member’s membership.(3)If a member does not pay the
membership fee within 28 days afterreceiving written
notice from the secretary that the fee is owing, the Boardmay
cancel the member’s membership.

1993˙Records of members18.(1)The
Board must keep a register of members of the ground.(2)For each member, the secretary must
record in the register—(a)the full name
and address of the member; and(b)if
the member is a junior member—the age of the member; and(c)the day membership started.(3)A member of the ground must notify the
secretary of a change ofaddress.˙No
transfer of membership19.(1)A member of the
ground must not transfer, or attempt to transfer,a
ticket of membership or pass-out check given to the member by the
Trustwithout the Trust’s approval.(2)If a member contravenes subsection
(1), the Trust may impound orcancel the ticket
of membership or pass-out check or do both.†PART
4—ENFORCEMENT˙Offences20.(1)In
this section—“Board’s approval”includes the
approval of an authorised officer.(2)A
person must not—(a)enter the grounds—(i)without paying the admission fee; or(ii)without the
Board’s approval or the approval of the occupier,as
the case requires; or(b)without the
Board’s approval—(i)enter a members’ reserve;
or

1993(ii)bring liquor
onto the grounds; or(iii)sell or hire, or
attempt to sell or hire, a thing on the grounds;or(iv)enteronthepartofthegroundsusuallyusedbypersonsengaged in a
sport or entertainment, unless the person is aperson engaged
in a sport or entertainment; or(v)bringananimalontothegroundsotherthanaguidedogwithin the meaning of theGuide Dogs Act 1972; or(c)be drunk or disorderly or create a
disturbance on the grounds; or(e)interfere with a person engaged in a sport
or entertainment; or(f)damagevegetation,astructureorotherimprovementonthegrounds.Maximum
penalty—10 penalty units.˙Power to deal with
persons21.(1)Anauthorisedofficerwhofindsapersoncontraveningsection 20(2)(c)
may direct the person to leave the grounds.(2)The
person must not, without reasonable excuse, fail to comply
withthe direction.Maximum
penalty—10 penalty units.˙Power to hand over
certain offenders to the police22.Anauthorisedofficerwhofindsapersoncontraveningsection
20(2)(b)(iv), (c), (e) or (f) may take the person immediately to
apolice officer, using only reasonable and
necessary force.

1993†PART 5—MISCELLANEOUS˙Duties of officers, etc. of
Trust23.(1)The secretary
and the other officers and employees of the Trustmust—(a)perform the functions the Board decides;
and(b)be paid the remuneration the Board
decides.(2)The Trust may pay a person an
honorarium for services to the Trust.˙Custody of Trust’s seal24.(1)ThesecretaryisresponsibleforthecustodyofthesealoftheTrust.(2)The
seal may be used only under a resolution of the Board.˙Amendment or repeal of by-law25.This by-law may be repealed or amended
only at a special meeting.
