s 1 5 s 1A Justices Regulation 1993 JUSTICES REGULATION 1993 [as amended by all amendments that commenced on or before 1 December 2003] PART 1—PRELIMINARY 1 Short title This regulation may be cited as the Justices Regulation 1993 . PART 2—PROCEDURE FOR CERTAIN SUMMONSES AND WARRANTS Division 1—Procedure if warrant of apprehension issued 1A Copy of complaint to be filed if warrant of apprehension issued—Act, ss 57 or 59 (1) This section applies if a complaint is made and, under section 57 or 59 of the Act, 1 a justice issues a warrant to apprehend a person. (2) If the warrant is issued at a place appointed for holding a Magistrates Court, the complainant must, at the time the warrant is issued, file a copy of the complaint with the clerk of the court. (3) If the warrant is issued at a place other than a place appointed for holding a Magistrates Court, the complainant must, within 3 days of the warrant’s issue, file a copy of the complaint with the clerk of the court nearest the place where the warrant was issued. 1 Section 57 (Cases in which warrants may be issued) or section 59 (Warrant in the first instance) of the Act
s2 6 s4 Justices Regulation 1993 Division 2—Computer warrants 2 Prescribed warrants—Act, s 66(4) For section 66(4) 2 of the Act, the following types of warrant are prescribed— (a) a warrant issued under the Bail Act 1980 ; (b) a warrant issued under the Justices Act 1886 ; (c) a warrant of commitment issued under the Penalties and Sentences Act 1992 ; (d) an arrest warrant under the Police Power and Responsibilities Act 2000 ; (e) a warrant under the State Penalties Enforcement Act 1999 . 3 Approved procedures for computer warrants—Act, s 67(1)(b) For section 67(1)(b) 3 of the Act, the following procedures for computer stored information are approved— (a) procedures made by the chief executive and stated in the departmental document titled ‘Computer Warrant Procedures’; 4 (b) procedures made by the commissioner of the police service and stated in the Department of Police document titled ‘Operational Procedures Manual’, section 13.20. 5 4 Prescribed information—Act, s 69B(2) A document made under the approved procedures and used to execute a computer warrant must include— 2 Section 66 (Purpose and application of division) 3 Section 67 (Approved procedures for computer warrants) 4 A copy of the document may be inspected, free of charge and during normal working hours, at any Magistrates Court and the department’s head office. The department’s head office is at State Law Building, George and Ann Streets, Brisbane. 5 A copy of the document may be inspected, free of charge, at any police station, or bought from the Department of Police, Police Headquarters, 100 Roma Street, Brisbane.
s5 7 s5 Justices Regulation 1993 (a) the following information about the warrant— (i) type; (ii) reference number; (iii) date of issue; (iv) issuing entity’s name and location; (v) Act under which it was issued; (vi) for a warrant of commitment for failure to pay an amount— (A) amount payable; and (B) default period of imprisonment; (vii) for a warrant of execution—the amount payable; and (b) the following information about the person to whom the warrant relates— (i) name; (ii) address stated on the warrant; (iii) latest known address; and (c) the following information about the offence or alleged offence in relation to which the warrant was issued— (i) description of the offence or alleged offence; (ii) provision of the Act or statutory instrument that was contravened or allegedly contravened; (iii) date of the offence or alleged offence; (iv) place where the offence or alleged offence happened. 5 Certification of a document made under the approved procedures and used to execute a computer warrant or written warrant—Act, ss 69B(5)(b) and 69E(4)(b) (1) For section 69B(5)(b) 6 of the Act, if anyone is arrested on execution of a computer warrant using a document made under the approved procedures, the document is to be certified by the arresting officer. 6 Section 69B (Execution of a computer warrant)
s 6 8 s 6A Justices Regulation 1993 (2) For section 69E(4)(b) 7 of the Act, if anyone is arrested on execution of a written warrant using a prescribed document, 8 the prescribed document is to be certified by the arresting officer. 6 Prescribed document—Act, s 69E(1)(b) The document titled ‘Warrant work list’, made under the approved procedures and used to execute a written warrant is prescribed for section 69E(1)(b) 9 of the Act. Division 3—Procedure if summons to or warrant for witness issued 6A Copy of summons to be filed if summons issued to witness—Act, s 78 or 83 (1) This section applies if a request is made that, under section 78 or 83 of the Act, 10 a justice issue a summons to a witness. (2) If the summons is issued at a place appointed for holding a Magistrates Court, the person who made the request must, at the time the summons is issued— (a) file a copy of the summons with the clerk of the court; and (b) pay the prescribed fee. (3) If the summons is issued at a place other than a place appointed for holding a Magistrates Court, the person who made the request must, within 3 days of the summons’s issue— (a) file a copy of the summons with the clerk of the court nearest the place where the summons was issued; and (b) pay the prescribed fee. 7 Section 69E (Facilitation of execution of written warrant) 8 See section 6 (Prescribed document—Act, s 69E(1)(b)). 9 Section 69E (Facilitation of execution of written warrant) 10 Section 78 (Power to issue summons to witness) or section 83 (Production of documents before justices) of the Act
s 6B 9 Justices Regulation 1993 s7 6B Copy of complaint for issue of warrant to be filed if warrant issued for witness—Act, s 81 (1) This section applies if a complaint for the issue of a warrant is made requesting that a justice, under section 81 of the Act, 11 issue a warrant to bring a person before justices to testify. (2) If the warrant is issued at a place appointed for holding a Magistrates Court, the person who made the request must, at the time the warrant is issued— (a) file a copy of the complaint for the issue of the warrant with the clerk of the court; and (b) pay the prescribed fee. (3) If the warrant is issued at a place other than a place appointed for holding a Magistrates Court, the person who made the request must, within 3 days of the warrant’s issue— (a) file a copy of the complaint for the issue of the warrant with the clerk of the court nearest the place where the warrant was issued; and (b) pay the prescribed fee. PART 3—MISCELLANEOUS 7 Bench charge sheet to be given to clerk of court (1) This section applies to each charge of an offence for which a proceeding may be brought under the Act if the defendant is— (a) arrested on the charge, with or without a warrant; or (b) served with a notice to appear under the Police Powers and Responsibilities Act 2000 . (2) However, this section does not apply to a charge of an offence if another Act requires a bench charge sheet for the charge to be prepared. 12 11 Section 81 (Warrant in the first instance) of the Act 12 See, for example, the Bail Act 1980 , section 14(2) (Release of persons apprehended on making deposit of money as security for appearance).
s 8 10 s 8 Justices Regulation 1993 (3) A police officer must give a bench charge sheet for each charge of an offence to the clerk of the court before which the defendant is brought. (4) The bench charge sheet must state the names of the defendant and of the complainant. (5) The bench charge sheet must also state the offence with which the person is charged in a way, and with whichever of the following particulars, that may be necessary to inform the defendant of the nature of the charge— (a) particulars of the alleged time and place of committing the offence; (b) particulars of the person (if any) alleged to be aggrieved; (c) particulars of the property (if any) in question. (6) Any circumstances of aggravation on which it is intended to rely must be stated in the bench charge sheet. (7) It is sufficient to describe an offence in the words of the Criminal Code or the statute defining it, or in similar words. (8) A description of persons or things that would be sufficient in an indictment is sufficient in a bench charge sheet. 13 (9) Subsections (4) to (8) do not apply if section 42(2) of the Act applies to the charge. 14 (10) This section and section 8 do not limit the information that may be stated in a bench charge sheet. 8 Information that must be recorded on all bench charge sheets (1) This section applies to a charge stated in a bench charge sheet before a court in a proceeding under the Act. 13 See, for example, the Criminal Code, sections 565 (General rules applicable to indictments) and 566 (Particular indictments). 14 The Act, section 42(2) already requires particulars of the charge to be entered on the bench charge sheet in the circumstances described in section 42(2).
s 9 11 s 10 Justices Regulation 1993 (2) If the charge is amended, other than under section 42(1A) of the Act, 15 the court must ensure that particulars of the amendment are entered on the bench charge sheet. (3) If the court accepts a plea of a defendant, or enters a plea for a defendant, to a charge, the court must record the plea on the bench charge sheet. (4) Also the court— (a) must ensure the decision on the charge is recorded on the bench charge sheet; and (b) may make, or allow to be made, any entry on the bench charge sheet the court considers appropriate. 9 Bench cover sheets (1) This section applies to— (a) a charge for which a proceeding may be brought under the Act for an offence, if no Act requires a bench charge sheet to be prepared for the charge; and (b) an application made under the Act to a court. (2) The court must record the following information on a form called a bench cover sheet— (a) the names of the parties; (b) the nature of the complaint or application; (c) any plea of the defendant (whether accepted, or entered, by the court); (d) the court’s decision on the charge or application. (3) This section does not limit the information that may be stated in a bench cover sheet. 10 Magistrates Courts districts, divisions of Brisbane district, and places for holding courts (1) Schedule 1 sets out— 15 The Act, section 42(2) already requires particulars of the charge to be entered on the bench charge sheet if the charge is amended under the Act, section 42(1A).
s 11 12 s 13 Justices Regulation 1993 (a) the districts (other than the metropolitan district) that are Magistrates Courts districts; and (b) the names of the districts; and (c) the divisions of the Brisbane Magistrates Courts district; and (d) the names of the divisions of the Brisbane Magistrates Courts district; and (e) the places appointed for holding Magistrates Courts in the districts and divisions. (2) For schedule 1— (a) the whole area within the external boundary of a city or shire is taken to be part of the shire, even if it is not part of the city or shire; and (b) an island in Queensland waters, that is not within the external boundary of a city or shire is taken to be part of the city or shire nearest to the island; and (c) each point forming part of Queensland waters, that is not within the external boundary of a city or shire is taken to be part of the city or shire nearest to the point. 11 Metropolitan district The metropolitan district 16 consists of the Beenleigh, Brisbane, Cleveland and Redcliffe Magistrates Courts districts. 12 Scale of costs for the Act, pt 6, div 8 and pt 9, div 1 The scale of costs for part 6, division 8 and part 9, division 1 17 of the Act is in schedule 2. 13 Fees The fees payable to the clerk of the court are in schedule 3. 16 The metropolitan district is mentioned in the Small Claims Tribunals Act 1973 . 17 Part 6 (Proceedings in case of simple offences and breaches of duty), division 8 (Costs) and part 9 (Appeals from the decisions of justices), division 1 (Appeal to a District Court judge)
s 14 13 s 14 Justices Regulation 1993 14 Filing fee if state-related complainant (1) Despite section 13, a state-related complainant may file a document with the clerk of the court under any of the following sections of the Act without payment of a fee— section 54(2); section 78; section 81; section 83. 18 (2) However, if an order is made against a defendant in relation to the relevant complaint, the court must order the defendant to pay to the clerk of the court the amount of any filing fee that would have been paid if the complainant were not a state-related complainant. (3) In this section— “state-related complainant” means— (a) the Sovereign; or (b) the State or a person acting for the State; or (c) an entity, or a person acting for the entity, whose expenditure is wholly payable out of amounts from the consolidated fund. 18 Section 54 (Form of summons and filing of complaint and summons), 78 (Power to issue summons to witness), 81 (Warrant in the first instance) and 83 (Production of documents before justices) of the Act
14 Justices Regulation 1993 SCHEDULE 1 MAGISTRATES COURTS DISTRICTS AND PLACES FOR HOLDING COURTS section 10 1 Beaudesert (1) The name of the district is Beaudesert Magistrates Courts district. (2) The area of the district is Beaudesert Shire as shown on map number LGB 12, edition 2. 19 (3) The place for holding Magistrates Courts in the district is Beaudesert. 2 Beenleigh (1) The name of the district is Beenleigh Magistrates Courts district. (2) The area of the district is Logan City as shown on map number LGB 78, edition 6 and Gold Coast City as shown on map number LGB 58, edition 3, north of a line ( “the Beenleigh-Gold Coast dividing line” )— from the boundary of the Beaudesert Magistrates Courts district at the north bank of Cedar Creek along Cedar Creek to the south-western corner of portion 53, parish of Darlington along the southern then eastern boundary of the parish to the north bank of the Pimpama River along the north bank of the Pimpama River to the south-eastern corner of portion 77, parish of Pimpama then east to South Stradbroke Island. (3) The place for holding Magistrates Courts in the district is Beenleigh. 19 The plans mentioned in this schedule are held by the department administering the Local Government Act 1993 . The maps may be inspected at that department’s office at 41 George Street, Brisbane.

31 Justices Regulation 1993 SCHEDULE 2 SCALE OF COSTS FOR THE ACT, PART 6, DIVISION 8 AND PART 9, DIVISION 1 section 12 PART 1—GENERAL 1 Scale sets out amounts up to which costs may be allowed This scale sets out— (a) the only items for which costs may be allowed for part 6, division 8 and part 9, division 1 of the Act; and (b) the amount up to which costs may be allowed for each item. 22 2 Item of costs covers work by solicitor, counsel or both An item in part 2 covers all legal professional work whether done by a solicitor, counsel or by a combination of solicitor and counsel. 3 Only necessary or proper costs may be allowed A cost is to be allowed only to the extent to which— (a) incurring the cost was necessary or proper to attain justice or to defend the rights of the party; or (b) the cost was not incurred by over-caution, negligence, mistake or merely at the desire of the party. 22 See the note at the end of this schedule for when a higher amount of costs may be allowed.

33 Justices Regulation 1993 SCHEDULE 2 (continued) 2 Disbursements as allowance to witness for attending—defendant’s witnesses An allowance paid, payable or that will be paid by the defendant to a witness to attend a proceeding may be allowed up to an amount equal to the amount approved by Governor in Council for the comparable allowance (if any) to prosecution witnesses attending criminal proceedings in a Magistrates Court. 23 3 Disbursements as allowance to witnesses for attending—prosecution witnesses Costs allowed to the complainant may include an amount up to the amount required to reimburse a payment by the State of an allowance, approved by the Governor in Council, paid or that will be paid to prosecution witnesses attending the proceedings.
