3 Electricity (Superannuation Scheme Determination) Regulation 1993 ELECTRICITY (SUPERANNUATION SCHEME DETERMINATION) REGULATION 1993 [reprinted as in force on 10 June 1993 2 ] † PART 1—PRELIMINARY ˙ Short title 1. This regulation may be cited as the Electricity (Superannuation Scheme Determination) Regulation 1993 3–4 . ˙ Commencement 2. This regulation commences on 1 March 1993. ˙ Purpose 3. This regulation sets out a determination, under clause 4(2A) of Schedule 5 to the Act, which varies the existing and accruing rights, privileges and liabilities of certain contributors to the Scheme. ˙ Definitions 4. In this regulation— “Articles” means the Articles of the Queensland Electricity Supply Industry Employees’ Superannuation Scheme; “full-time hours” for a period means the total number of hours that a full-time employee is employed to work during the period; “working hours” for a period, for an employee, means the total number of hours that the employee was scheduled to work during the period, other than on overtime, and whether on a full-time or part-time basis.

This Part applies in respect of a member who, under section 18 of the Articles, contributes to the Scheme in accordance with the trust deed of a superannuation fund mentioned in the Schedule. ˙ Meaning of “relevant trust deed” 6. In this Part— “relevant trust deed” for a member means the trust deed of the superannuation fund mentioned in the Schedule under which the member contributes to the Scheme. ˙ Determination of benefit under cl.4, 5, 7 or 8(b) of relevant trust deed for part-time employees 7.(1) This section applies if— (a) a benefit is payable to a member under clause 4, 5, 7 or 8(b) of the relevant trust deed; and (b) the member was, for a period, a part-time employee; and (c) the entire period would, but for this section, be included in the member’s membership period. (2) For the purpose of calculating the benefit, the following proportion of the period is included in the membership period— W F where— “W” is the number of the member’s working hours for the period; “F” is the number of full-time hours for the period.

For the purpose of calculating a benefit payable to a member under the relevant trust deed, the member’s salary during any period that the member is employed part-time is taken to be the amount that would be the member’s salary if the member were employed full-time. ˙ Determination of benefit under cl.8(a) of relevant trust deed for part-time employees 9.(1) This section applies if— (a) a benefit is payable to a member under clause 8(a) of the relevant trust deed; and (b) the member was a part-time employee on the day the member ceased to be an employee. (2) For the purpose of calculating the benefit, the member’s membership period is to be multiplied by the following fraction— W F where— “W” is the number of the member’s working hours for the period; “F” is the number of full-time hours for the period. † PART 3—SEAQ SUPERANNUATION FUND ˙ Application of this Part 10. This Part applies in respect of a member who, under section 18 of the Articles, contributes to the Scheme in accordance with the trust deed.

In this Part— “trust deed” means the trust deed of the Southern Electric Authority of Queensland Superannuation Fund—Defined Benefit Plan. ˙ Determination of benefit under r.8, 9, 11, 12(3) or 12(4) of trust deed for part-time employees 12.(1) This section applies if— (a) a benefit is payable to a member under rule 8, 9, 11, 12(3) or 12(4) of the trust deed; and (b) the member was, for a period, a part-time employee; and (c) the entire period would, but for this section, be included in the member’s membership period. (2) For the purpose of calculating the benefit, the following proportion of the period is included in the membership period— W F where— “W” is the number of the member’s working hours for the period; “F” is the number of full-time hours for the period. ˙ Determination of salary for part-time employees 13. For the purpose of calculating a benefit payable to a member under the trust deed, the member’s salary during any period that the member is employed part-time is taken to be the amount that would be the member’s salary if the member were employed full-time. ˙ Determination of benefit under r.12(1) or (2) of trust deed for part-time employees 14.(1) This section applies if—

(2) For the purpose of calculating the benefit, the member’s membership period is to be multiplied by the following fraction— W F where— “W” is the number of the member’s working hours for the period; “F” is the number of full-time hours for the period.
