this regulation—“channel supply”means the supply
of water from a channel constructedby the chief
executive.“consumer offtake”means water
outlet works comprising a meter, valveandpipefittingsinstalledonabulkwatersupplypipelineforconveying water to individual
consumers.“drainage rate”means a rate
prescribed under section 26.“ground
water”means an underground source of water.“ground water area”means an area
determined by the chief executiveunder section 11
to be a ground water area.“irrigationproject”meansanareadeterminedbythechiefexecutiveunder section 10 to be an irrigation
project.“localservices”meanswater,sewerageorsullagedisposalservicesorgarbage removal services.“nominal allocation charge”means a charge payable under section
17.1This regulation is continued in effect
under section 1131 of theWater Act 2000. Inthis
regulation, any reference to a section of the Act is a reference to
a section of therepealed Act.

storage of water made for purposes otherthan merely
domestic purposes.“re-lift area”means an area
within which the channel supply to a holdingcannotbeeffectedmerelybygravity,butrequireswatertobepumped from a
channel.“rural residential purposes”of
the use of water on land with an area notmore than 10 ha
that is in a rural residential zone (however described)under a planning scheme under theLocal Government (Planning andEnvironment)Act1990,includesagriculturalandhorticulturalpurposes.“serviced land”means land on
which there is an improvement for whichthe State
provides local services.“Suncorp Metway business variable
lending rate”means the variablebaseinterestratesetbytheSuncorpMetwayBankforloanstobusiness entities.“surfacewater”meanswaterinawatercourseotherthanachannelconstructed by
the chief executive.“water charge”means a charge
payable under part 3.“waterharvesting”meansthetakingofwaterfromasourceduringaperiodthatthechiefexecutivehasnotifiedundersection7tobeaperiod of unregulated flow in relation to
the source.“water year”in relation to a
rate, assessment or charge, means the periodspecified in
this regulation of not more than 1 year for which the rate,assessment or charge is made or
levied.4Charges payable to the chief

section applies if an application is made under section 45 of
theAct for an amended licence for the Giru
ground water area for the purposeofincreasingasurfacewaterallocationbyanamountanddecreasingaground water allocation by the same
amount.(2)For the purposes of section 42(1)(c)
of the Act, the prescribed fee is$150.00foreachMLbywhichthesurfacewaterallocationistobeincreased.4BFees generallyFees payable
under the Act are in schedule 5.5Interest on outstanding debtFor
the purposes of this regulation (other than section 18), the
interestrateonanoutstandingdebtistheratethatis2%abovetheSuncorpMetway business
variable lending rate as applying from time to time.PART
2—PROVISIONS RELATING TO WATER SUPPLY6Regulated section of a watercourse(1)The chief executive may determine a
part of a watercourse to be aregulated section
of the watercourse if the chief executive considers thatthe
water supply in that part is increased from time to time as a
result ofworks constructed or operated by the chief
executive.(2)The chief executive must note on a
licence that permits water to betaken from a part
of a watercourse that is a regulated section, that the part
isa regulated section.7Water
harvesting during periods of unregulated flow(1)Ifatanytimethechiefexecutiveconsidersthatthewatersupplyavailable from a source exceeds the expected
demands on the water supplyat that time, the
chief executive may make a notification under this
section.

to be made to the persons licensed to harvest water from thesource; and(b)istodeclareaperiodofunregulatedflowinrelationtothesource; and(c)may
specify days on which the period starts and finishes, or maydeclarethattheperiodistocontinueuntilthechiefexecutivemakes a further notification specifying the
day that the period isto finish; and(d)may
be made by public notice or any other suitable means.(3)For the purpose of calculating a water
charge payable, by a personlicensedtoharvestwater,foranamountofwatertakenfromasourceduring a period
of unregulated flow, that amount—(a)is
to be included in a determination of the amount of water
takenby water harvesting; and(b)is
not to be included in a determination of the amount of watertaken made by reference to an announced
allocation or nominalallocation of a holding.(4)If,inanotificationmadeunderthissection,thechiefexecutivedeclares—(a)a
period of unregulated flow in relation to a regulated section
ofthe Condamine River North Branch; and(b)that,duringtheperiod,eithergeneralwaterharvestingorrestricted water harvesting is to
apply;a person must pay the charge, for water taken
during the period, that isspecifiedinthisregulationinrelationtogeneralwaterharvestingorrestricted water harvesting (as the case may
be).8Water taken during periods of
unrestricted flow(1)Ifatanytimethechiefexecutiveconsidersthatthewatersupplyavailable from a source exceeds the expected
demands on the water supplyat that time, the
chief executive may make a notification under this
section.

be made by public notice or any other suitable means.(3)For the purpose of calculating a water
charge payable for an amountof water taken
from the source during a period of unrestricted flow, thatamount—(a)is
to be charged at the specified rate for taking water during aperiod of unrestricted flow; and(b)istobeincludedinanydeterminationoftheamountofwatertaken made by
reference to an announced allocation or nominalallocation of a
holding.10Irrigation projects(1)If the chief executive—(a)operates, or has constructed, works
outside an irrigation area; and(b)considers that the water supply in an area
outside an irrigationarea has been increased as a result of
the works;the chief executive may determine the area to
be an irrigation project.(2)The chief
executive may name an irrigation project for the purposesof
the Act, for example—the ‘Mary Valley project’.(3)The
chief executive must display at an office of the department,
orothersuitableplace,inornearanirrigationproject,amapshowingtheboundaries of the irrigation
project.(4)The chief executive may make further
determinations adding an areato, or excluding
an area from, an irrigation project.

be added to or excluded froman irrigation
project, the chief executive must have regard to the effect
theworksarehavingonthewatersupplyintheareaatthetimeofthedetermination.(6)If
the chief executive determines that an area be added to or
excludedfromanirrigationproject,thechiefexecutivemust,bypublicnoticeorother suitable means, notify the
persons licensed to take water from thearea.11Ground water areas(1)If
the chief executive—(a)manages the
ground water resource in an area; or(b)operates,orhasconstructed,worksthatthechiefexecutiveconsiders have—(i)increased the ground water supply in an
area; or(ii)reduced the
demand for ground water in an area;the chief
executive may determine the area to be a ground water area.(2)The chief executive may name a ground
water area for the purposesof the Act, for
example—the ‘Horseshoe Lagoon ground water area’.(3)The chief executive must display at an
office of the department, orother suitable
place, in or near a ground water area, a map showing theboundaries of the ground water area.(4)The chief executive may make further
determinations adding an areato, or excluding
an area from, a ground water area.(5)In
determining whether an area should be added to or excluded
froma ground water area, the chief executive must
have regard to—(a)anyrepresentationmadebyapersonaffectedbythedetermination; and(b)any
other evidence;as to the effect the works are having on the
ground water supply, or demandfor ground water,
in the area at the time of the determination.(6)If
the chief executive determines that an area be added to or
excludedfrom a ground water area, the chief executive
must, by public notice or

allocations(1)This section applies if—(a)a person holds a nominal allocation
for land in an area mentionedin schedule 1;
and(b)the chief executive has decided an
announced allocation for theland for a water
year; and(c)thepersonhasnotusedallthewater,availableundertheannounced allocation, during the water
year.(2)The person may apply to the chief
executive to carry over all or partof the unused
water from the water year to the next water year.(3)The application must be accompanied by
an application fee of $100.(4)The chief
executive may approve the carryover if the chief executiveis
satisfied it is reasonable to do so having regard to—(a)the storage capacity available in the
area; and(b)the quantity of water for which the
chief executive estimates acarryover might
be requested during the water year.(5)Thechiefexecutivemayapprovethecarryoveronconditionsincluding—(a)the time within which the carried over
water must be used; and(b)how much of the
carried over water is available for use.(6)The
chief executive may also approve carryovers for all or part of
anarea, without application by holders of
nominal allocations for land in thearea.11B
Forward draw of water allocations(1)This
section applies if—(a)a person holds a nominal allocation
for land in an area mentionedin schedule 1;
and

for a water year; and(c)thepersonreasonablyexpectstouseallthewater,availableunder the announced allocation, during the
water year.(2)The person may apply to the chief
executive to forward draw, to thewateryear,allorpartofthewatertobeavailableunderanannouncedallocation for
the next water year.(3)The application must be accompanied by
an application fee of $100.(4)Thechiefexecutivemayapprovetheforwarddrawifthechiefexecutive is satisfied it is reasonable to do
so having regard to—(a)the availability
of water in the area; and(b)the impact the
forward draw might have on the supply of waterforotherpersonsintheareawhowouldbeentitledtoreceivewater in the
next water year.(5)Thechiefexecutivemayapprovetheforwarddrawonconditionsincluding—(a)the time within which the forward draw
water must be used; and(b)thattheforwarddrawwatermaynotbethesubjectofanagreement under section 2313of the Act to allow another
personto use the water.(6)The
chief executive may also approve forward draws for all or part
ofan area, without application by holders of
nominal allocations for land inthe area.(7)Ifaquantityofwaterisforwarddrawnunderthissection,thequantity of water is to be deducted from the
announced allocation availablefor use in the
water year from which it was drawn.(8)In
subsection (1)(c)—“announced allocation”, if a person’s
nominal allocations for licences arecombinedon1noticeforpaymentundersection14A,4meanstheaggregate of the announced allocations for

3—WATER CHARGES12DefinitionsIn this
part—“land”meansaholdingorlandforwhichwatermaybetakenunderalicence.“relevant
area”, in relation to land, means—(a)in the case of land in an area
mentioned in schedule 1—the areamentioned;
or(b)in any other case—the area mentioned
in schedule 1 from whichwater may be taken under a licence for
the land.13Water charges for sch 1 land(1)Achargeisleviedonwaterallocated,suppliedortakenfromaschedule 1 area for land.(2)The charge is levied for the water
year specified in schedule 1 for thearea.(3)Subject to sections 14 and 16, the
charge for the water is the amountspecified in
schedule 1 as the charge for water from the relevant source
inthe relevant area.14Minimum annual account fee(1)A minimum annual account fee is
payable for a water year on eachnominal
allocation granted to land for which water may be taken from
anarea mentioned in schedule 1.(2)If the charge levied under section 13
for the water year is less thantheminimumannualaccountfeestatedinschedule1forthearea,theminimum annual account fee is
payable.14A Combining nominal allocations for
charging purposes(1)This section applies if—(a)a person holds more than 1 licence for
a schedule 1 area; and

notice for payment; and(c)the application
is accompanied by an application fee of $50.(2)Thechiefexecutivemaycombinethenominalallocationsforthelicencesin1noticeofpaymentifthechiefexecutiveissatisfieditisreasonable to do so having regard
to—(a)the distance between the parcels of
land for which the nominalallocations were granted; and(b)whether the parcels of land are
serviced by the same works.(3)If nominal
allocations for the licences are combined in 1 notice forpayment,section
14mustbeappliedtotheaggregateofthenominalallocationsforthelicences,andtheaggregateofthecorrespondingannounced
allocations, as if the nominal allocations were 1 allocation
andthe announced allocations were 1
allocation.16Charges for water in excess of
entitlements(1)Achargeisleviedonwaterinexcessofanentitlementunderanannouncedallocationthatistakenunderanauthoritygrantedundersection 229 of
the Act.(2)The charge may be worked out using the
formula—amount payable for water + percentage amount
of nominal allocation.(3)In
the formula—“amount payable for water”is
the amount payable under this regulation(other than this
section) for the water.“percentageamountofnominalallocation”is5%ofthenominalallocation
charge specified in schedule 2 for each megalitre of watertaken under the authority for the
land.16A Notice for payment of charges or
fees(1)A charge under section 13 or 16, or a
fee under section 14—(a)may be made and
levied—(i)for the period decided by the chief
executive; or

the chief executive does not decide a period—quarterly;and(b)may be made and
levied by giving written notice to the person towhom
water is supplied; and(c)becomes payable
on the day the notice is issued; and(d)must
be paid within 30 days after the notice is issued; and(e)foranypartofthechargeorfeeremainingunpaidafter30 days—accrues
interest at the rate stated in section 5.(2)A
notice given under subsection (1)(b) must state—(a)the amount of the charge or fee and
the period for which it islevied; and(b)the
time and place for payment; and(c)that
any part of the charge or fee remaining unpaid after 30 daysaccrues interest; and(d)the
interest rate.(3)Interest payable on any part of a
charge under section 13 or 16, or afee under section
14, remaining unpaid after 30 days applies from the daythe
notice is issued to the day the fee or charge is paid.16B
Recovery of charges and fees(1)Anypartofachargeundersection13or16,orafeeundersection 14, that becomes payable under
section 16A may be recovered bythe chief
executive by action in a court of competent jurisdiction.(2)Interest payable on a charge or fee
may be recovered in the same waythe charge or fee
may be recovered.17Nominal allocation charges(1)Before the chief executive grants a
nominal allocation for land in anirrigation area
or irrigation project, the owner of the land must pay to thechiefexecutivethenominalallocationchargespecifiedforthelandinschedule 2.

specified in schedule 2 do not apply to the sale, underpart
5 of the Act, of an entitlement to be issued with a licence for a
nominalallocation.(2)Despitesubsection(1),thechiefexecutivemaygrantthenominalallocation if the
owner of the land arranges for payment of the nominalallocation charge for the land by instalments
on terms satisfactory to thechief
executive.(3)The owner of the land is not required
to pay the nominal allocationcharge for the
land if—(a)the owner acquires the land through an
auction under theLandAct 1994;
and(b)anominalallocationisgrantedforthelandbeforethelandisoffered for auction.18Payment of a nominal allocation charge by
instalments(1)This section applies if an owner of
land pays a nominal allocationcharge by
instalments.(2)The owner must—(a)pay
interest on the unpaid part of the charge; and(b)comply with the agreed terms for payment of
instalments.(3)Interest on the unpaid part of the
charge—(a)accrues from the day the nominal
allocation is granted; and(b)ispayableataratethatis1.5%abovetheSuncorpMetwaybusinessvariablelendingrateapplyingonthedayeachinstalment is payable.PART 4—LOCAL
SERVICES CHARGES19Meaning of “owner”In this
part—“owner”does not include
the State.

provided to serviced land.(2)The charge for a
local service is the amount specified in schedule 3for
the service.(3)The chief executive must give written
notice to an owner of servicedland
specifying—(a)the amount of the charges payable for
the owner’s land; and(b)the local
services for which the charges are made; and(c)the
period to which the charge applies; and(d)the
day by which the charges must be paid; and(e)the
way in which payment must be made.21Owner
must pay within 30 days(1)Theownermustpaytheamountspecifiedinthenoticewithin30
days after receiving the notice.(2)Payment must be made at the place, or in the
way, specified in thenotice.22Notice to the chief executive concerning
dealings with land(1)Anownerwhodisposesofaninterestinservicedlandmustgivewrittennoticeofdisposaltothechiefexecutivewithin7daysafterdisposal.(2)The
notice must specify—(a)thenameandaddressofthepersongainingtheinterest(the“purchaser”); and(b)the nature of the interest; and(c)the day on which the purchaser becomes
liable to pay chargesunder this part.(3)An
owner who vacates land in which the State has an interest
mustgive written notice of vacation to the chief
executive within 7 days aftervacation.

excuse, does not give notice tothe chief
executive under subsection (1) or (3) continues to be liable
forcharges payable for local services to the
land after the day of disposal orvacation.(5)However, the owner ceases to be liable
for charges payable for localservicesprovidedtothelandafterthefirstofthefollowingeventshappens—(a)the
chief executive receives written notice—(i)in
the case of land in which the State has an interest—thatthe
owner has vacated the land; and(ii)in
other cases—of the name and address of the purchaser ofthe
land;(b)the chief executive sends a notice
under section 20 addressed tothe
purchaser.(6)Subsection (4) does not limit the
liability of the purchaser for chargespayable for local
services to the land after the day on which the purchaseracquires an interest in the land.(7)A person must not state something in a
notice that the person knowsis false or
misleading in a material particular.Maximum
penalty—20 penalty units.(8)If a former
owner of serviced land continues, under subsection (4), tobeliableforchargespayableforlocalservicestotheland,thechiefexecutive may
recover the amount payable from either—(a)the
former owner; or(b)the purchaser of the land.23Evidentiary provisions(1)This section applies to a proceeding
for the recovery of a debt underthis part.(2)Acertificatepurportingtobesignedbythechiefexecutiveandstating the following matters is
evidence of the matters—(a)land described
in the certificate is serviced land;

the owner of serviced landis the owner of the land;(c)specifiedchargesforaspecifiedperiodwerepayableforlocalservices
provided to the land;(d)a specified
amount is owing to the State by the person named inthe
certificate.24Collection of garbage(1)Thissectionappliesifthechiefexecutiveprovidesagarbageremoval service
for serviced land.(2)The occupier of the serviced land must
ensure that—(a)agarbagebinusedforthecollectionofrubbishbythechiefexecutive is
made of galvanised iron or plastic and has a capacitythat
is not more than—(i)themaximumcapacityapprovedbythelocalgovernmentfor the area in
which the land is situated; or(ii)ifthelocalgovernmenthasnotapprovedamaximumcapacity—85 L;
and(b)the bin is not filled beyond its
capacity; and(c)only household garbage is put in the
bin; and(d)wet garbage is wrapped before being
put in the bin; and(e)if the bin must be placed for its
contents to be collected—the binis placed as
nearly as possible to the corner of the house mostdirectly in line with the entrance.(3)The chief executive is not required to
remove rubbish in a bin if theoccupier does not
comply with this section.(4)If, under
subsection (3), the chief executive does not remove rubbish,it
does not affect the obligation of the person required to pay an
annualcharge for the local service to pay the full
annual charge.

5—OTHER CHARGES26Drainage rates(1)For
the purposes of section 116 of the Act, this section sets
out—(a)a charge that may be levied by the
chief executive; and(b)the basis for
levying the charge.(2)The chief executive may, in relation
to each water year, levy a chargeontheowneroflandwithinanirrigationarea,attheratesetoutinschedule 4 for the irrigation area.(2A)The charge may
be levied—(a)for the period decided by the chief
executive; or(b)if the chief executive does not decide
a period—quarterly.(3)The chief executive may levy the
charge on a person by sending tothe person a
notice specifying—(a)the amount of the charge; and(ab)the period for
which it is levied; and(b)the day, not
before 30 days after the date of the notice, by whichthe
amount is payable.(4)Apersonwhoreceivesanoticesentundersubsection(3)mustcomply with the
notice.(5)A levy made under this section in
relation to land is to be determinedaccording to the
area of the land at the date of the notice.27Making and levying assessments—Act, s
175(1)Thefollowingboardsmaymakeandlevyanassessmentundersection 175 of the Act—•North Burdekin Water Board•Pioneer Valley Water Board•South Burdekin Water Board.(2)The assessment must be—

and(b)ifmadeandleviedbytheNorthBurdekinWaterBoard—notmore
than $1.20 on a tonne; and(c)ifmadeandleviedbytheSouthBurdekinWaterBoard—notmore
than 75c on a tonne; and(d)if made and
levied by the Pioneer Valley Water Board—not morethan
$20.20 on a tonne.(3)The proportions for paying the
assessment are—(a)for North and South Burdekin Water
Boards—•sugar mill owner—one-third;•sugarcane grower—two-thirds;
and(b)for Pioneer Valley Water Board—•sugar mill owner—100%•sugarcane grower—nil.(4)The time fixed for paying the
assessment is 2 months after the boardgives notice of
the assessment to the owner of the sugar mill on whom theassessment is made and levied.(5)In this section—“crushingseason”,forasugarmill,meanstheperiodduringwhichsugarcane is
received at the mill and crushed.
