s1 3 s4 Dental Technicians and Dental Prosthetists By-law 1992 DENTAL TECHNICIANS AND DENTAL PROSTHETISTS BY-LAW 1992 [as amended by all amendments that commenced on or before 1 May 2002] PART 1—PRELIMINARY 1 Short title This by-law may be cited as the Dental Technicians and Dental Prosthetists By-law 1992 . 2 Commencement This by-law commences on 9 October 1992. PART 2—THE BOARD 3 Notice of meetings (1) The registrar is to give 7 days written notice of a meeting of the Board to each member of the Board. (2) The notice is to specify the day, place and time of the meeting and the business to be conducted at the meeting. 4 Order of business The business of a meeting is to be conducted in the following order— (a) reading of minutes of the previous meeting; (b) adoption or otherwise of the minutes; (c) consideration of business arising out of the minutes;

s5 4 s6 Dental Technicians and Dental Prosthetists By-law 1992 (d) consideration of outward correspondence; (e) consideration of inward correspondence; (f) financial matters; (g) restoration of registrations as— (i) dental technicians; and (ii) dental prosthetists; (h) registrations— (i) as dental technicians; and (ii) as dental prosthetists; and (iii) of additional qualifications; (i) general business. 5 Board’s seal (1) The Board’s seal must be kept in the custody of the registrar and may be used only as authorised by the Board. (2) Judicial notice must be taken of the imprint of the Board’s seal appearing on a document and the document must be presumed to have been properly sealed until the contrary is proven. 6 Appointment and duties of honorary treasurer (1) The Board may appoint a member to be honorary treasurer. (2) The honorary treasurer’s duties are— (a) to receive from the registrar, and present to the Board, a statement of all funds received and spent; and (b) to ensure that the statement is reconciled with the statements for accounts kept by the board with a financial institution.

s7 5 s7 Dental Technicians and Dental Prosthetists By-law 1992 PART 3—MISCELLANEOUS 7 Advertising not to be false, misleading, deceptive, harmful etc. (1) A dental technician must not— (a) advertise about the performance of dental technical work in a way that is false, misleading or deceptive or likely to be misleading or deceptive; or (b) advertise dental technical work that is harmful or likely to be harmful; or (c) advertise about the performance of dental technical work in a way that is vulgar or sensational in a way that would be likely to affect adversely the standing of the dental technology profession. Maximum penalty—10 penalty units. (2) A dental prosthetist must not— (a) advertise about a clinical practice matter in relation to the provision of dental prosthetic services in a way that is false, misleading or deceptive or likely to be misleading or deceptive; or (b) advertise dental prosthetic services that are harmful or likely to be harmful; or (c) advertise about a clinical practice matter in relation to the provision of dental prosthetic services in a way that is vulgar or sensational in a way that would be likely to affect adversely the standing of the dental prosthetics profession. Maximum penalty—10 penalty units. (3) In subsection (2)— “clinical practice matters ”, in relation to the provision of dental prosthetic services, includes— (a) expected treatment outcomes, including, for example, cures, pain relief or other beneficial outcomes; and (b) the nature or qualities of products, materials, techniques, procedures or equipment used in the course of providing the services; and

s 7A 6 Dental Technicians and Dental Prosthetists By-law 1992 s8 (c) the field of practice, including, for example, a special area of practice expertise. (4) However, “clinical practice matters” do not include business or commercial matters in relation to the service, including, for example— (a) the name of the practice providing the services; and (b) the fees payable for services provided by the dental prosthetist. 7A Business name approval fee An application for approval of a business name under section 35(1) of the Act must be accompanied by the prescribed fee. 7B Examination fee A person must pay the prescribed fee before undertaking an examination mentioned in section 25(2)(b)(iii) of the Act. 8 Fees (1) The fees specified in the schedule are the fees prescribed in respect of the matters specified. (2) If a person is registered as a dental technician or dental prosthetist in December of a year, the annual registration fee for the following year is waived.
