1—PRELIMINARY1Short titleThisby-lawmaybecitedastheDentalTechniciansandDentalProsthetists
By-law 1992.2CommencementThis by-law
commences on 9 October 1992.PART 2—THE
BOARD3Notice of meetings(1)Theregistraristogive7 dayswrittennoticeofameetingoftheBoard to each
member of the Board.(2)The notice is to specify the day,
place and time of the meeting andthe business to
be conducted at the meeting.4Order
of businessThe business of a meeting is to be conducted
in the following order—(a)reading of
minutes of the previous meeting;(b)adoption or otherwise of the minutes;(c)consideration of business arising out
of the minutes;

outward correspondence;(e)consideration of
inward correspondence;(f)financial
matters;(g)restoration of registrations
as—(i)dental technicians; and(ii)dental
prosthetists;(h)registrations—(i)as
dental technicians; and(ii)as dental
prosthetists; and(iii)of additional
qualifications;(i)general business.5Board’s seal(1)The
Board’s seal must be kept in the custody of the registrar and
maybe used only as authorised by the
Board.(2)JudicialnoticemustbetakenoftheimprintoftheBoard’ssealappearing on a document and the document must
be presumed to have beenproperly sealed until the contrary is
proven.6Appointment and duties of honorary
treasurer(1)The Board may appoint a member to be
honorary treasurer.(2)The honorary treasurer’s duties
are—(a)toreceivefromtheregistrar,andpresenttotheBoard,astatement of all funds received and spent;
and(b)to ensure that the statement is
reconciled with the statements foraccounts kept by
the board with a financial institution.

By-law1992PART 3—MISCELLANEOUS7Advertising not to be false,
misleading, deceptive, harmful etc.(1)A
dental technician must not—(a)advertiseabouttheperformanceofdentaltechnicalworkinawaythatisfalse,misleadingordeceptiveorlikelytobemisleading or deceptive; or(b)advertisedentaltechnicalworkthatisharmfulorlikelytobeharmful; or(c)advertiseabouttheperformanceofdentaltechnicalworkinaway that is vulgar or sensational in a
way that would be likely toaffect adversely
the standing of the dental technology profession.Maximum penalty—10 penalty units.(2)A dental prosthetist must not—(a)advertiseaboutaclinicalpracticematterinrelationtotheprovisionofdentalprostheticservicesinawaythatisfalse,misleading or
deceptive or likely to be misleading or deceptive;or(b)advertise dental
prosthetic services that are harmful or likely tobe
harmful; or(c)advertiseaboutaclinicalpracticematterinrelationtotheprovision of dental prosthetic
services in a way that is vulgar orsensational in a
way that would be likely to affect adversely thestanding of the dental prosthetics
profession.Maximum penalty—10 penalty units.(3)In subsection (2)—“clinicalpracticematters”,inrelationtotheprovisionofdentalprosthetic
services, includes—(a)expected treatment outcomes,
including, for example, cures, painrelief or other
beneficial outcomes; and(b)thenatureorqualitiesofproducts,materials,techniques,proceduresorequipmentusedinthecourseofprovidingtheservices; and

Prosthetists By-law1992s8(c)thefieldofpractice,including,forexample,aspecialareaofpractice expertise.(4)However,“clinicalpracticematters”donotincludebusinessorcommercial matters in relation to the
service, including, for example—(a)the
name of the practice providing the services; and(b)the fees payable for services provided
by the dental prosthetist.7ABusiness name
approval feeAn application for approval of a business
name under section 35(1) ofthe Act must be
accompanied by the prescribed fee.7BExamination feeA person must
pay the prescribed fee before undertaking an examinationmentioned in section 25(2)(b)(iii) of the
Act.8Fees(1)The
fees specified in the schedule are the fees prescribed in respect
ofthe matters specified.(2)If a
person is registered as a dental technician or dental prosthetist
inDecember of a year, the annual registration
fee for the following year iswaived.
